PLANNING COMMISSION RESOLUTION NO. 1328
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-2 TO
EXPAND THE EXISTING BOARD' AND CARE FACILITY BY ADDING
82 ROOMS (TOTAL 187 ROOMS) AND RELATED PARKING MODIFICATIONS
AT 716-734 W. CAMINO REAL AVENUE.
WHEREAS, on December 17, 1986 an application was filed by Orlando
Clarizio to expand the existing board and care facility by addin9 82 rooms (total
187 roans) and related parking modifications, Planning Department Case No. C.U.P.
87-2, on property commonly known as 716-734 W. Camino Real, more particulary
desc ri bed as fo 11 ows :
Lots 1 and 2 of Parcel Map lIllO, in the City of
Arcadia, County of Los Angeles, State of
California., as per Map recorded in Book 110,
Page 54 of Maps in the Office of said County
Recorder of said County.
WHEREAS, a public hearing was held on January 13, 1987, at which time all
interested persons were 9iven full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached repQrt is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity because the proposed board and care
facility is an appropriate use in the R-3 zone and that it is a less intense use
than a multiple family development.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized because of the reasons set forth
in No.1 and because conditions have been applied to mitigate potential problems
and concerns pursuant to Section 3 below.

3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood. The Commission noted that based upon studies of existing
facilities in other communities and the existing facilities in the City, that the
70 parking spaces are adequate to serve the facility.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use. It was
determined that this type of use does not generate a large amount of traffic.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment. The Commission determined that the proposed use would not
have a significant effect on the environment and that the use would not be more
intense than a multiple-family use which is permitted in the R-3 zone without a
conditional use permit.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to expand the existing board and care facility by adding
82 rooms (total 187 rooms) and related parking modifications upon the following
condi t ions:
1. That conditions listed below from the Department of Public Works
shall be complied with to the satisfaction of the Director of Public Works.
A. Plant parkway trees at locations determined by the Director of
,Public Works per City of Arcadia Standard S-13.
B. Submit grading and drainage plan prepared by a registered civil
engineer subject to the approval of the Oirector of Public
Works.
C. Remove and replace deficient or damaged curb, gutter or
sidewalk.
2. That conditions listed below from the Fire Department shall be
complied with to the satisfaction of the Fire Chief:
A. Access to the buildings shall comply with the requirements of
10.207 UFC.
B. On-site hydrant may be required - location to be determined when
proper access is provided.

C. Sprinkler valves and connections need 6" diameter clear space
around them.
D. All buildings to be fire protection sprinklered; alarm to be to
remote central station.
3. That a modification shall be granted for 70 parking spaces.
4. That a modification be granted for a density of one unit per 571
square feet of lot area and that there shall be a maximum of 187 units.
5. That the minimum age for residency in this facility shall be 60
years and that a covenant in a form and content to be approved by the City
Attorney shall be filed guaranteeing that the minimum age of residents shall be
60 years.
6. That the maximum building height shall be 35'-0".
7. That the final plans shall bein substantial compliance with the
plans on file in the subject case. Any changes deemed by the Planning Department
to be significant will require review and approval of the Planning Commisison.
8. That deliveries shall be restricted to the hours of 7 a.m. to 7
p.m.. Mondays through Fridays.
9. That the maximum density shall not exceed an average of 1.1
residents per room. The developer shall be required to provide a covenant or
other agreement as deemed necessary by the City Attorney to implement this
condition.
10. That a covenant shall be recorded consolidating the property
fronting on Baldwin Avenue with the property on Camino Eal Avenue. Said
covenants shall ~e in a form and content approved by the City Attorney and filed
prior to the issuance of a Building Permit.
11. That C.U.P. 87-2 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
12.. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.

Resolution reflect the Commission's action of January 13, 1987 and the following

In 1966 the City adopted the current regultltlons for convalescent homes and
board and eare facilities. These regulations were established based upon a
proposed convalescent fllclllty which WllS beIng reviewed by the City.

At the time these regultltlons were tldopted, the concept of a .Retlrement
Hotel/Home. did not exist. When the first retirement facility WtlS proposed
In the City (1976) staff conducted extensive resellrch to determine how
these facilities were operated, the necessllry parkIng, density, etc. Since
1976 we have received two others requests (excluding the current request).
The City hilS reviewed etlch of these projects, projects In other cities llnd
hilS determined based upon our experience llnd the experience of other citles
that the Clty's ptlrklng and density standtlrds for Board and Cllre and
convalescent facilitIes are not appropriate for retirement faclllties,
The three approved appllctltions for retirement facilitIes have been granted
modlflclltlons to the regulations set forth In the Arcadia Munlclplll Code. We
have riot had llny compllllnts from adjoInIng resIdents regllrdlng the two
existIng operations.
The proposed project exceeds the unit density proposed for the Goldrlch
Kest project on Dutlrte Rotld (one unit per 582 sq. ft. vs. one unit per 582 sq.
ft.)

The proposed project does not comply with the densIty and ptlrklng

the surroundIng neighborhood llnd would be an approprlate additIon to the
site.
It is stllff's opinion thllt the density should not be grellter thtln the density
propoeed on the Goldrich Kest property which Is one unit per 571 sq. ft. of
lot aretl. This would tlllow 183 units.
Any long term noise llssoclllted with this project would be noise generllted
by the residents and vehicles to and from the site. Because of the age of the
residents llnd the type of ftlcility there will be mlnlmtll noise and trllffic
generllted at the proposed ftlcility,

The Code limits deltverles to the hours of 7 a,m. to 10 p.m. Staff would
would recommend that deltverles be restrlcted to the hours of 7 a,m. to 7
p,m.
The plans do not lndleate a wall along Baldwin Avenue. Staff would
recommend that a 6'-0. high wall be loeated between the building and the
north property Itne and the building and the south property line. ThIs wall
would prohibit dIrect access to the property from Baldwin Avenue.
A covenant should be requIred joining the property fronting on Baldwin
Avenue with the property fronting on Camino Real Avenue.
Pursuant to the provisions of the Caltfornla Environmental aualtty Act, the
Planning Department has prepared an Initial study for the proposed projeet.
Said InItial study did not disclose any substantial or potentially substantial
Ildverse change In any of the physical conditions within the area affected by
the project lneludlng land, air, water, minerals, flora, fauna, ambient noise
and objects of hlstorlcal or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.

The Planning Department recommends approval of C.U.P.67-2 subject to the
following eonditlons:
1. Conditions as outltned In the attached report from the Department
of PUbltc Works shtlll be eomplted wIth to the satlsftlctlon of the
Director of Publtc Works.
2. That fire safety shall be provided to the satisfaction of the Fire
Chief and per the conditions outlined In the attached report.
3. That a modification shall be grllnted for 70 parking spaces.

In response to your memorandum, the item(s) which this department has concern
or special knowledge of are listed below:
1. The existing parkway width is ten (10) feet on Camino Real Avenue and
varies from 6 feet at the north property line to 8.5 feet at the south
property line on Baldwin Avenue.
2. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system.
This department has reviewed the subject CUP and reconunends the following
conditions of approval:
1. Plant parkway trees at locations determined by the Director of Public
. Works per City of Arcadia Standard S-13.
2. Submit grading and drainage plan prepared by a registered civil engineer
subject to the approval of the Director of Public Works.
3. Remove and replace deficient or damaged curb, gutter or sidewalk.
NOTE: All survey monuments, centerline ties and survey reference points shall
be protected in place or re-established where disturbed. This work
will be the responsibility of the permittee and shall be at the
permittee's expense.
The above items are to be complied with to the satisfaction of the Director of
Public Works in accordance with the applicable provisions of the Arcadia
Municipal Code.

The existing project is a 105 unit retirement housing. consisting
of 5 two and three story buildings and a subterranean parking for
34 cars under 2 buildings facing Cam1no Real. Surface parking for
23cars is also provided. Existing site area is 87250 sq. ft.
The new addition will have 81 units.~s new wings will be added to
the existing buildings. also a new 3-story building will be build.
A vacant lot of 19600 sq.ft. will be added to the project. Additional
parking will be provided for the total of 70 cars.
There will be extensive landscaping. inclUding 5 ft. buffer strip
adjOining residential areas.
The new additions will have same use as the existing project. Since
this is a retirement facility. insignifficant additional traffic is
anticipated. New project will offer luxurious living for the occupants
