PLANNING COMMISSION RESOLUTION NO. 1328 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-2 TO EXPAND THE EXISTING BOARD' AND CARE FACILITY BY ADDING 82 ROOMS (TOTAL 187 ROOMS) AND RELATED PARKING MODIFICATIONS AT 716-734 W. CAMINO REAL AVENUE. WHEREAS, on December 17, 1986 an application was filed by Orlando Clarizio to expand the existing board and care facility by addin9 82 rooms (total 187 roans) and related parking modifications, Planning Department Case No. C.U.P. 87-2, on property commonly known as 716-734 W. Camino Real, more particulary desc ri bed as fo 11 ows : Lots 1 and 2 of Parcel Map lIllO, in the City of Arcadia, County of Los Angeles, State of California., as per Map recorded in Book 110, Page 54 of Maps in the Office of said County Recorder of said County. WHEREAS, a public hearing was held on January 13, 1987, at which time all interested persons were 9iven full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached repQrt is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the proposed board and care facility is an appropriate use in the R-3 zone and that it is a less intense use than a multiple family development. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized because of the reasons set forth in No.1 and because conditions have been applied to mitigate potential problems and concerns pursuant to Section 3 below. . . . 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. The Commission noted that based upon studies of existing facilities in other communities and the existing facilities in the City, that the 70 parking spaces are adequate to serve the facility. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. It was determined that this type of use does not generate a large amount of traffic. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. The Commission determined that the proposed use would not have a significant effect on the environment and that the use would not be more intense than a multiple-family use which is permitted in the R-3 zone without a conditional use permit. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to expand the existing board and care facility by adding 82 rooms (total 187 rooms) and related parking modifications upon the following condi t ions: 1. That conditions listed below from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. A. Plant parkway trees at locations determined by the Director of ,Public Works per City of Arcadia Standard S-13. B. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Oirector of Public Works. C. Remove and replace deficient or damaged curb, gutter or sidewalk. 2. That conditions listed below from the Fire Department shall be complied with to the satisfaction of the Fire Chief: A. Access to the buildings shall comply with the requirements of 10.207 UFC. B. On-site hydrant may be required - location to be determined when proper access is provided. 1328 -2- . . . C. Sprinkler valves and connections need 6" diameter clear space around them. D. All buildings to be fire protection sprinklered; alarm to be to remote central station. 3. That a modification shall be granted for 70 parking spaces. 4. That a modification be granted for a density of one unit per 571 square feet of lot area and that there shall be a maximum of 187 units. 5. That the minimum age for residency in this facility shall be 60 years and that a covenant in a form and content to be approved by the City Attorney shall be filed guaranteeing that the minimum age of residents shall be 60 years. 6. That the maximum building height shall be 35'-0". 7. That the final plans shall bein substantial compliance with the plans on file in the subject case. Any changes deemed by the Planning Department to be significant will require review and approval of the Planning Commisison. 8. That deliveries shall be restricted to the hours of 7 a.m. to 7 p.m.. Mondays through Fridays. 9. That the maximum density shall not exceed an average of 1.1 residents per room. The developer shall be required to provide a covenant or other agreement as deemed necessary by the City Attorney to implement this condition. 10. That a covenant shall be recorded consolidating the property fronting on Baldwin Avenue with the property on Camino Eal Avenue. Said covenants shall ~e in a form and content approved by the City Attorney and filed prior to the issuance of a Building Permit. 11. That C.U.P. 87-2 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 12.. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. 1328 -3- . . . Section 4. ThIs wall would prohibit dIrect access to the property from Baldwin Avenue. Pursuant to the provisions of the Caltfornla Environmental aualtty Act, the Planning Department has prepared an Initial study for the proposed projeet. The existing parkway width is ten (10) feet on Camino Real Avenue and varies from 6 feet at the north property line to 8.5 feet at the south property line on Baldwin Avenue. 2. The subject property is served by a sewer line that has the capacity to transport sewage flows generated in accordance with land use reflected in the City's current general plan to CSD's system. This department has reviewed the subject CUP and reconunends the following conditions of approval: 1. Plant parkway trees at locations determined by the Director of Public . Works per City of Arcadia Standard S-13. 2. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works. 3. Remove and replace deficient or damaged curb, gutter or sidewalk. NOTE: All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the permittee and shall be at the permittee's expense.
