A RESOLUTION GRANTING ZONE VARIANCE '.1-86-1 TO EXPAND
AN EXISTING AUTOMOBILE GARAGE WHICH IS A LEGAL NON-
CONFORMING USE ON C-2 ZONED PROPERTY AT 635 EAST LIVE
OAK AVENUE

WHEREAS, on November 17, 1986, an application was filed by Erlc
Duyshart on behalf of Jack Kawahata to expend an existing automoblle
garage which Is alegel non-conforming use on C-2 zoned property, Plenning
Department Ctlse No. '.1-86-1, on property commonly known as 635 East Live
Oak Avenue, more pllrtlcularly descrlbed as follows:

Portion of Lot 1261n the ArcadIa Acreage Tract In the City of
Arcadia, County of Los Angeles, State of California as per Map
recorded In Map Book 10, pege 18 in the County Recorder's Office.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1. Thtlt the factuel dllte submitted by the Planning

slime zone or vicInity, The subject property Is unusulIlln that It Is
surrounded on three sides by public rlghts-of-way; the County Flood Control

2, Thllt IIpprovlll of this zone vlIrlance would not be detrlmentlll to

or vicinity. The proposed 600 sq, ft. IIddltlon would upgrllde the property IInd
enhance the building IIppellrllnce,
3. That such varlance Is necesslIry for the preservation IInd
enjoyment of a substantial property rlght of the applicant possessed by
other property In the same zone and vicinity. The garage Is currently
existing and It Is the Commission's opinion that the proposed addition Is
minor IInd would not significantly Increase traffic to and from the site,
4. That the granting of such yarlance wl1l not adversely affect the
Comprehenslye Genertll Plan. The automobile garage Is an existing use IInd
the proposed addition wlll not change the use of the site.
Section 3. That for the foregoing reasons this Commission grtlnts a
zone varlance for the expansion of an existing lIutomoblle garage which Is a
leglll non-conformIng use upon the following conditIons:
1. Thllt the building shall be In compllllnce with the plllns on file In
the subject case.
2. Conditions as outlined below from the Department of Public Works
shllll be complied with to the slltlsfactlon of the Director of Public Works.

10. Noncompliance with the provisions and conditions of this
Conditional Use permit shall constitute grounds for the Immediate
suspension or revocation of said Permit.

being purchased by the City's Redevelopment Agency as part of the Grlbble
project.
The existing brake shop has been located on this site since 1963, It Is a
legal non-conforming use,

The owner of ArcadIa Muffler, Jtlck Kawahatll, Is Interested In purchasing
the property and relocating hIs muffler shop to this site, The existing
building contains 1,240 square feet; the appllcllnt Is III so proposing to
elCpand the building by adding an 600 square foot addition, The operation
wl11 consist of a brake shop and a muffler shop,
The building Is concrete block and the new addition wl11 be concrete block,
The applicant Is proposing to paint the building and add awnIngs on the
front.

All the bays, Including the new one, face to the east. The existing building
Is 14'-0. In height. The new addition wl11 be 17'-0. In height to
accommodate tallervehlcles such tlS vans, motor homes, etc.
There are five existIng parking spaces; no new spaces tlre proposed, The
applicant Is proposing to pave the existing County rlght-of-way adjacent to
the east side of the property.

Landscaping w111 be provided along the front of the building, A 2'-0. planter
area Is proposed adjacent to the westerly property line and a 3'-0. planter
Is proposed adjacent to the rear of the building,

(Expansion of an Existing Automotive Garage)
The following conditions of approval are recommended:
1. Submit grading and drainage plan subject to the approval of the Director
of Public: Works.
2. The existing parkway width is twelve (12) feet.
3. Plant parkway trees at locations determined by the Director of Public
Works per City of Arcadia StandardS-13.
4. Gravity drainage outlets, and driveway aprons shall be constructed to
conform to Drawing S-ll.'
5. The subject property is served by a sewer 1 ine that has the capacity to
transport sewage flows generated in accordance with land use reflected in
th~ City's current general plan to CSD's system. .
6. This City owns the 25' behind the site in fee only. At this time, the
City has no plans for it.
7. All survey monuments, centerline ties and survey reference points shall be
protected in place or re-established where disturbed. This work will b",
the responsibility of the permittee and shall be at the permittee's'
expense.

8. The above items are to be comp 1 ied with to the sati sfact ion of the
Director of Public Works in accordance with the applicable provisions of
the Arcadia Municipal Code.
