PLANNING COMMISSION RESOLUTION NO. 1323
A RESOLUTION GRANTING CONDITIONAL USE PERMIT B6-13 TO
OPERATE AN EATING ESTABLISHMENT AT 30 WEST LAS TUNAS DRIVE.
WHEREAS, on September 10, 19B6 an application was filed by Ray Robinson
to operate an eating establishment, Planning Department Case No. C.U.P. B6-13, on
property commonly known as 30 West Las Tunas Drive, more particulary described as
follows:
The portion of Lot 69 of Santa Anita Colony, in
the City of Arcadia, County of Los Angeles, State
of California, as per Map recorded in Book 42,
Page B7 of Miscellaneous Records in the Office of
said County Recorder of said County as described
as follows:
Beginning at the intersection of the westerly
line of said lot with a line parallel with and 50
feet southerly, measured at right angles, from
the northerly line of said lot; thence easterly
along said parallel line, 0.01 feet to the
beginning of a curve concave to the South, having
a radius of 450 feet and being tangent to said
parallel line, thence easterly along said curve a
distance of 109.96 feet to the end of same;
thence southeasterly along a line tangent to said
curve concave to the West, having a radius of 25
feet and being tangent to said last mentioned
line; thence southerly along said last mentioned
curve 6B.52 feet to the end of same; thence
westerly along a line parallel with and 50 feet
northerly, measured at right angles, from the
southerly line of said lot and being tangent to
said last mentioned curve, 4Bl.07 feet, more or
less, to the westerly line of said lot; thence
northerly along said westerly lien 229.17 feet,
more or less, to the point of beginning.
EXCEPT the westerly 145.00 feet thereof.
WHEREAS, a public hearing was held on October 14, 19B6, at which time all
interested persons were given full opportunity to be heard and to present
evidence;

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate an eating establishment upon the following
condi t ions:
1. The business shall be limited to the retail sales of donuts,
coffee, soft drinks and similar items.
2. Seating shall be limited to a maximum of twelve (12) persons.
3. A modification shall be granted for 5B parking spaces in lieu of 77
spaces. This approval shall not constitute an approval for a general reduction
in parking for the total site. That this parking modifictation shall only be for
the use approved by C.U.P. B6-13.
4. Fire safety shall be provided to the satisfaction of the Fire
Department.
5. The eating establishment shall be maintained per the plans on file
in the Planning Department.

6. That C.U.P. B6-13 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
7. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of October 14, 19B6 and the following
vote:
AYES: Commissioners Gali nski, Hedlund, Kovacic, Papay, Szany
NOES: None
ABSENT: Commissioners Amato, Fee
Section 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of
Arcadia.

. PROPOSAL AND ANALYSIS
The applicant is requesting a conditional use permit to operate an eating
establishment with seating for twelve persons. By adding tables with chairs, .
the business changes from a retail activity to an eating establishment which
requires a conditional use permit.

The subject eating establishment (donut shop) contains 906 square Ceet. The
shop is part or a 12.552 square Coot retail center.
On July 10, 1984 a modification (M-84-77) was granted to permit 58 parking
spaces in lieu or 63 spaces. It was determined that the lot was unique since
it has frontage on both Las Tunas and Live Oak; also the lot was like an
"island." This situation would allow Cor additonal street parking being
available to the lot.
Due to the proposed 906 square foot eating establishment, '14 additional
parking spaces are required for a total or 77 spaces. This increase is due to
the difference in required parking; retail areas need 5 spaces per 1,000
square feet or floor area while an eating establishment requires 20 spaces
per 1,000 square feet.
It is staff's opinion that allowing a limited number or seating in food
establishments would not be detrimental to the site or surrounding
properties, but would serve as a convenience for customers. Staff has
consistently recommended that seating for 12 persons should be the
maximum allowed without" requiring additional parking.
Since 1982 there have been eleven conditional use permits granted for
similar types or uses and as or this date we have not had any complaints, nor
has staff observed any problems caused by the operation or these eating
establishments. Following Is a list or these conditional use permits:

Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project
Said initial study did not disclose any substantial or potentially substantial
adverse change In any of the physical conditions within the area affected by
the project Including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. Tberefore, a Negative
. Declaration has been prepared for this project.

The Planning Department recommends approval of C.UP. 86-13 subject to
the following conditions: .
1. Seating shall be limited to a muimum of twleve (12) persons.
2. A modification shall be granted for 58 parking spaces In lieu of
n spaces. This approval shall not constitute an approval for a
general reduction In parking for the total site. That this parking
modification shall only be for the use approved by CUP 86-13
(eating establishment).
3. Fire safety shall be provided to the satisfaction of the Fire
Department.
4. The eating establishment shall be maintained per the plans on
file in the Planning Department

modified by the Commission).
