HomeMy WebLinkAbout1321 .. - e PLANNING COMMISSION RESOLUTION NO. 1321 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 86-11 TO EXPAND AN EXISTING RESTAURANT (COCO'S) AT 59 WEST LAS TUNAS DRIVE. WHEREAS, on August 28, 1986 an application was filed by Grace Restaurant Company to expand an existing restaurant (Coco's), Planning Department Case No. C.U.P. 86-11, on property commonly known as 59 West Las Tunas Drive, more particulary described as follows: Parcel 4 of parcel map No. 3568 in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in 800k 43, Pages 85 of Maps, in the Office of said County Recorder. WHEREAS, a public hearing was held on September 23, 1986, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HERE8Y RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. .. ~ e 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to expand an existing restaurant upon the following conditions: 1. That the hours of operation including the delivery of supplies and maintenance of the property shall be between the hours of 6:30 a.m. and 11:00 p.m. with the exception that the hours on Friday and Saturday evening be extended to 1:00 a.m. 2. 7:00 a.m. and 3. That construction is prohibited between the hours of 7:00 p.m. and on Sundays and Holidays. That C.U.P. 86-11 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 4. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of September 23, 1986 and the following vote: AYES: NOES: A8SENT: Commissioners Amato, Fee, Galinski, Kovacic, Szany None Section 5. and shall cause a Arcadia. Sept. 16.1986 ~ c.UP... -SG-II This letter is to initiate a complaint involving CoCo's restaurant at 59 W.Las Tunas St. We. the neighbors who live immediately adjacent to said restaurant, have complained to the management of said restaurant for some time about the noise of trucks unloading supplies during the night and their apparent disregard for the fact that they are in a residential area. These trucks arrive at approximately 0430am and park with their motor ", running at a fast idle and radio playing until someone shows up at CoCo's to unload the truck. Despite complaints to their management the noise has continued and the only improvement has been that they no longer play the radio loudly. The tractor for these trucks is parked no more than 40 ft. from the bedrooms of three homes and the noise is quite loud at that time of morning. The conditional use permit which allows Coco's to do . business at this location limits the hours in which they may do business. The unloading of these trucks should also be accomplished during these hours. The trucks should not be allowed to wait there or anywhere else on their property until business hours. If the unloading of trucks and supplies does not fall under the heading of doing business, what does? This company apparently has little regard for its neighbors or the fact that they are in a residential neighborhood and continues to do as they wish Which includes the violation of the conditions established by their conditional use permit or regulations established by the city of Arcadia. An example being that there is a hearing on 9/23/86 to request the city council to allow them to expand their restaurant by 20 seats. I wish to inform you that they have already accomplished this task. We know because they did the work between the closing hours of business to 0700am for a solid week or more despite complaints from us that the operation of power tools both in and out of restaurant kept us all awake especially when accompanied by yelling that went on. It is bad enough that we the neighbors have to put up with the smell of different foods cooking, cleaning of the grills but to be awakened at 0430am each morning is to much. When one calls the police dispatcher they sympathize with you but are at a loss as to what they can do. Our response to this is that if Coco's cannot live up to the conditions of their conditional use permit then perhaps they should not be allowed to do business at all.
