PLANNING COMMISSION RESOLUTION NO. 1320
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 86-10 TO
OPERATE AN EATING ESTABLISHMENT AT 160 EAST DUARTE ROAD #E.
WHEREAS, on August 8, 1986 an application was filed by Young Eun Choi to
operate an eating establishment, Planning Department Case No. C.U.P. 86-10, on
property commonly known as 160 East Duarte Road, #E, more particulary decirbed as
follows:
Parcel 1 and 2 of parcel map No. 15487 in the
City of Arcadia in the City of Arcadia, County of
Los Angeles, State of California, as per Map
recorded in Book 167, Pages 88 and 89 of Maps,
in the Office of said County Recorder.
WHEREAS, a public hearing was held on September 10, 1986, at which time all
interested persons were given full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.

6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate an eating establishment upon the following
conditions:
Seating shall be limited to a maximum of ten persons.
A modification be granted for 23 parking spaces in lieu of 34
spaces. This approval shall not constitute an approval for a
general reduction in parking for the total site. That this parking
modification shall only be for the use approved by CUP 86-10
(eating establishment).
3. Fire-safety shall be provided to the satisfaction of the Fire
Department which may include fire extinguishers and that both exit
doors be operable from inside without key or special knowledge per
Section 3115.2.5 (no dead bolts).
4. The eating establishment shall be maintained per the plans on file
in the Planning Department.
5. That C.U.P. 86-10 shall not take effect until the owner and
applicant have executed a form available at the Planning Department
indicating awareness and acceptance of the conditions of approval.
6. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate
suspension or revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of September 10, 1986 and the
following vote:

PROPOSAL AND ANALYSIS
The applicant is requesting a conditional use permit to operate an eating
establishment with seating for ten persons. 8y adding tables with chairs, the
business changes from a retail activity to an eating establishment which requires
a conditional use permit.

A frozen yogurt shop is proposed that contains 751 squre feet. The yogurt shop
is part of a 4.577 square foot retail building which was recently completed.
Twenty-three on-site parking spaces are provided which meets the requirements for
4.577 square foot retail building. Due to the proposed 751 square foot eating
establishment. 34 parking spaces are required. This increase is due to the
difference in required parking; retail areas need 5 spaces per 1.000 square feet
of floor area while an eating establishment requires 20 spaces per 1.000 square
feet.
It is staff's opinion that allowing limited seating in food establishments would
not be determintal to the site or surrounding properties. but would serve as a
convenience for customers. Staff has consistently recommended that seating for
12 person should be the maximum allowed without requiring additional parking.
Since 1982 there have been ten conditional use permits granted for similar types
of uses and as of this date we have not had any complaints about the operation of
these eating establishments. Following is list of these approved conditional use
permits:

2. CUP 82-10, 150 E. Duarte Rd.
3. CUP 82-15, 31 E. Duarte Rd.
4. CUP 82-17, 922 S. Baldwin Ave.
5. CUP 83-2, 1002 S. Baldwin Ave.
6. CUP 83-7. 106 E. Foothill Blvd.
7. CUP 83-13. 651 W; Duarte Rd.
8. CUP 83-18, 160 E. Duarte Rd. (within Alpha Beta ShoPpin9 Center)
9. CUP 84-10, 124 E. Live Oak Ave.
10. CUP 85-24. 328 E. Foothill Blvd.
Pursuant to the provisions of the California Environmental Qualtiy Act. the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land. air. water. minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. Therefore. a Negative Declaration has been
prepared for this project.

RECOMMENDATION
The Planning Department recommends approval of C.U.P. 86-10 subject to the
following conditions:
1. Seating shall be limited to a maximum of ten persons.
2. A modification be granted for 23 parking spaces in lieu of 34

the project will not have a significant effect on the environment and direct
staff to prepare the appropriate resolution incorporating the specific findings
and conditions of approval set forth in the staff report ( or as modified by the
Commission).

Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of
that decision.

Commissioner Kovacic asked when this development was approved was it approved
under the assumption that it not be used for food service because of the limited

explained that take-out food service is a pennltted use, but once tables are put
in the use is detennined to be an eating establishments.
Commissioner Papay asked when they go from a take out to an eating establishment
are they required to provide restroom facilities? Staff indicated they would
have to comply .rtth the Building Code and County Health Department regulations.
Commissioner Kovacic indicated that if this was to meet code 34 parking spaces
would be required and they ,have 23. Isn't this going to create a parking problem?

Staff noted that the seating is just a convenience and incidental to the food
service. Staff did not think it would generate the amount of trafffc that would
require the addftional parking.
Chainnan Szany indicated that there is a parking problem on the site and asked if
there is on-street parkfng on Second Avenue? It was noted that there ~ be on-
street parking south of the driveways.
. There was discussion regardfng the parking requirements for retail businesses and
eatfng establfshments.
Commfssioner Papay indicated that from his experfence most of the people going to
these places tend to take their food with them.
The public hearfng was opened.
J. Choi. son of the applicant. spoke in favor of the proposal. He did not feel
there would be a parking problem with thfs business.
Staff indicated that there was a reciprocal parking arrangement between the Alpha
Beta property and the subject property.
In response to the Commissioner's questions staff indicated that there is always
parking spaces available on this site but often by Second Avenue and not in the
immediate vfcinity of the Alpha Beta. Staff was not aware of any historical
parking problem on this site. .
MOTION
It was moved by Commissioner Kovacic. seconded by Commissioner Papay to
close the public hearing. The motion passed by voice vote with none
dissenting.
Commissioner Galinski noted that he did not feel the proposed use would be any
more intense than someone shopping at another retail shop. It is not an intense
eating establishment. He felt it was a reasonable request.
MOTION
It was moved by Commissioner Galinski. seconded by Commissioner Kovacfc to
approve C.U.P. 86-10 subject to the conditfons set forth in the staff
report.
