HomeMy WebLinkAbout1316 e . I PLANNING COMMISSION RESOLUTION NO. 1316 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 86-8 TO OPERATE A RESTAURANT AT 600 EAST LIVE OAK AVENUE. WHEREAS, on May 14, 1986 an application was filed by Cosmos Investment Company to operate a restaurant, Planning Department Case No. C.U.P. 86-8, on property commonly known as 600 East Live Oak Avenue, more particulary decirbed as follows: Lots 3, 4, 5 and 6 of Tract 15233 in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 332, Pages 29 and 30 of Maps, in the Office of said County Recorder. WHEREAS, a public hearing was held on June 10, 1986, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to operate a restaurnat upon the following conditions: 1. That fire-safety shall be provided to the satisfaction of the Fire Department. 2. That seating shall be limited to a maximum of sixty people. 3. That C.U.P. 86-8 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 4. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 10, 1986 and the following vote: AYES: Commissioners Amato, Fee, Galinski, Hedlund, Kovacic, Szany NOES: None ~ ABSENT: Commissioner Papay Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. NICHOLSON, ASSISTANT PLANNER C.U.P. 86-8 CASE NO.: GENERAL INFORMATION APPLICANT: LOCATION: REQUE ST: Cosmos Investment Company (owner/developer of the site) 600 East Live Oak Avenue A proposed conditional use permit to operate a restaurant with seating for sixty people. LOT AREA: FRONTAGE: 30,730 square feet (.71 acres) Approximately 204 feet on Live Oak Avenue Approximately 132 feet on Hempstead Avenue EXISTING LAND USE & ZONING: The site is developed with a new retail commercial shopping center; zoned C-2. SURROUNDING LAND USE & ZONING: NORTH: Developed with a church and mixed commercial uses; zoned C-2. SOUTH: Developed with single-family residences which are located within the Los Angeles County area. EAST: Developed with the Arcadia Mounted Police Facility; unzoned area. WEST: Developed with mixed commercial uses; zoned C-2. GENERAL PLAN DESIGNATION: Commerci al PROPOSAL The subject building contains 9,539 square feet and is divided into nine leasible areas. The proposed ~estaurant will occupy the westerly 1,175 square feet of said building. . . - On-site parking is located in the front and to the rear of the building. Based upon Code requirements (5 parking spaces per 1000 sq. ft. for a retail commercial use and 10 parking spaces per 1000.sq. ft. for a restaurant), 54 parking spaces would be required; 42 spaces for the other retail commercial uses within the building and 12 spaces for the proposed restaurant. A total of 58 on-site parking spaces exists on the subject site. ANAL YSI S A restaurant is a permitted use in the C-2 (General Commercial) zone with an approved conditional use permit. The existing on-site parking exceeds the Code requirement for this proposal. Access to the on-site parking is provided by two driveways; one along Live Oak Avenue and the other along Hempstead Avenue, and by an alley south of the site. The existing parking areas, landscaping and the trash enclosure comply with the commercial development standards. Pursuant to the provisions of the California Environmental Qualtiy Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minera1s, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Attached for your consideration are the proposed plans. RECOMMENDATION The Planning Department recommends approval of C.U.P. 86-8 subject to the followi ng condit ions: 1. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
