HomeMy WebLinkAbout1315 I e t PLANNING COMMISSION RESOLUTION NO. 1315 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 86-7 TO ENLARGE A VETERINARY HOSPITAL AT 311 NORTH SANTA ANITA AVENUE. WHEREAS, on March 11, 1986 an application was filed by Marvin F. Saya to enlarge a veterinary hospital by adding a reception ropm, Planning Department Case No. C.U.P. 86-7, on property commonly known as 311 North Santa Anita Avenue, more particu1ary described as follows: That protion of Lot 2 of Tract No. 949, in the City of Arcadia, as per Map recorded in Book 17, Page 13 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point in the Easterly line of said Lot 2, distant South 01" 03' 43" East thereon, 207.77 feet from the Northeasterly corner thereof; thence South 010 03' 43" East long said Easterly line 78.37 feet; thence South 890 39' 41" West 144.68 feet; thence North 000 20' 19" West 80.17 feet to a line extending from the point of beginning, to a point in the Westerly line of said Lot 2, distant Southerly thereon, 633.25 feet from the Northweater1y corner of said Lot 2, thence South 89037' 18" East 143.70 feet to the point of beginn i ng. WHEREAS, a public hearing was held on April 9, 1986, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. I e . Section 2. This Commission finds: 1. That the granting of such Conditional Use Pennit will not be detrimental to the public health or welfare, or injurious to the property or ,.improvements in such zone or vicinity. 2. That -the use applied for at the location indicated is properly one for which a Conditional Use Pennit is authorized. 3. That the site for the pr'oposed use is adequate in size and sh,ape to accommodate said use, and all yards, spaces, walls, fences, parking, \oading, 1 andscapi ng and other features requi red to adjust sa id use with the 1 and and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Pennit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commi ssion grants a Conditional Use Pennit for the enlargement of a veterinary hospital upon the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. Fire protection shall be provided as required by the Fire Department. 3. Any new water service shall be installed by the Arcadia Water Department at the developer's expense. 4. Conditions as outlined in the attached report from the Arcadia Redevelopment Department shall be complied with to the satisfaction of the Assistant City Manager for Economic Development. 5. The foll owi ng exi sti ng nonconfonni ng conditions shall be all owed to remain: A. Veterinary hospital with outside runs (9275.1.59). B. B parking spaces in lieu of 20 (9269.5). That C.U.P. 86-7 shall not take effect until owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. 7. Section 4. The decision, findings and conditions contained in this Resolution reflect the COOlmission's action ~f April 9, 1986 and the following vote: AYES: NOES: ABSENT: Commissioners Amato, Galinski, Hedlund, kovacic, Papay, Szany None Commissioner Fee Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the Ci ty Council of the City of Arcadia. ANAYLSIS A veterinary hosptial is a permitted use in the C-M zone with an approved conditional use permit. The existing animal hospital was built in 1946, which was before the requirement of a conditional use permit. Any expansion requires a conditional use permit to be filed. The applicant proposes to add a 112 square foot reception area which will join the two existing buildings on the property. Repainting of the structures is propos ed. The Redevelopment Agency staff will require the following (see attac~ed memora ndum) : 1. Design review before the Redevelopment Agency. 2. Repainting of buildings and wans. 3. Construction of sidewalk along St. Joseph Street. A handicspped ramp has been required by the Public Works Department. The Planning Department believes that the new reception area will not create a significant increase in the demand for parking. Also, since the proposal is for a minor addition (112 sq. ft.), it is staff's opinion that the existing nonconforming parking lot should be allowed to remain. The nearest reSidentially zoned property to the hospital is over 400 feet away to the west on San Miguel Drive. Abutting the hospital are light industrial buildi ngs and a mixture of commerci al uses. Staff does not recommend any change to the existing outside runs. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions withi~ the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesth~tic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 86-7 subject to the foll owi ng condi tons: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. C.U.P. 86-7 4/9/86 Page. 2 ~ . . 2. FINDINGS AND MOTIONS Appr ova I If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. The existing parkway widths are six (6) feet on St. Joseph Street and five (5) feet on Santa Anita Avenue. 2. Construct P.C.C. sidewalk, with tree wells, as per City of Arcadia Standard Drawing S-17 along St. Joseph Street. 3. Construct P .C.C. ramp for the handicapped per City of Arcadia Standard Drawing No. $-22. 4. Applicant should be notified that before permits can be issued for this project it will be subject to a formal Design Review before the Redevelopment Agency. A design review of this nature requires that the applicant submit 10 complete sets of all plans depicting work to be done and either a colored elevation of the proposed eastern facade or rendering of same. The elevation should be of the entire property showing how the addition will interface with the existing structures. Redevelopment staff will need the above materials at least 14 days before the Agency meeting in which the item is to be considered. A brief review of the partial plans submitted thus far elicit the following probable Redevelopment Agency staff conditions for this project: 1. The entire property shall be repainted selecting from those colors conceptually developed by Willdan for the Downtown Revitalization Area. Structures to be repainted include the exterior of both existtng structures on Santa Anita, the new addition and the exterior of the brick wall on the southern property line. 2. The public right-of-way between the curb on St. Joseph st. and the southerly property line will be developed'as a con- crete sidewalk consistent with City of Arcadia specifications. Should the applicant choose to pave the minimum five foot width required, the balance of the public right-of-way left unpaved will be landscaped'and fully sprinklered. Maintenance of this and any other landscaping on the subject site will be required. . 3. Provide and maintain landscaping as may be required by the City Code and the Planning Department.
