Lemm, Sr., to operate a vehicle storage yard, Planning Department Case No. C.U.P. 86-6, on property located at 5425 North Peck Road, more particularly described as follows: The northerly 40 feet of Lot 22, Tract 26345, in the City of Arcadia. County or Los Angeles, State of California as per Map recorded in Book 670. Pages 65 and 67 of Maps in the mice of said County Recorder. WHEREAS, a pUblic hearing was held on April 9, 1986, at which time an interested persons were given full opportunity to be heard and to present evidence; NOW, TIIERBFORB, THB PLANNING COMMISSION OF THE CITY OF ARCADIA HERBBY RESOL YES AS FOLLOWS: . SECTION 1. That the factual data submitted by the plAnning Department in the attached report is true and correct. SECTION 2, This Commission finds: I. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which . a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. . . 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not b.ave a substantial adverse impact on the environment. ~ECTION 3. That for the foregOing reasons this Commission grants a Conditional Use Permit to allow vehicle storage upon the following conditions: 1. Refrigeration units shall not be operated Oft the site. 2. No vehicle repairs shall be done on the site. 3. That each vehicle parked on the premises must be registered and operable. 4. That a minimum 6'-0", not to exceed 8'-0", high slumpstone wall to . match the eIisting building be provided along the north and south property line and along the Peck Road frontage as per the area identified in the staff report. 5. That an "BIit Only" sign be installed on the driveway on Peck Road. 6. That C.UP. 86-6 shall not take effect until the owner and applicant have . . elecuted a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 7., Noncompliance with the provisions and conditions of this Conditional Use permit shall co,nstitute grounds for the immediate suspension or revocation of said Permit. . 2 131<4 . SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of April 9, 1986 and the following vote: . The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. GENERAL PLAN DESIGNATION: Industrial The applicant is proposing to utilize the northerly 40 feet by 300 feet or his property for outdoor vehicle storage. This area is encloted with an eight foot high chain link fence with barbed wire on the top. There is a 14'-0" sliding chain link gate across the front. Access to the site will be from a 10'-0" wide sate at the rear of the property. Vehicles will eIit the site from the gate on Peck Road. The gate is setback approIimately 15'-6" from the Peck Road property line. Tbe eIisWlg termite building is slumpstone and was constructed in 1984. The storage yard is screened from Peck Road by an 8' high slumpstone wall. The remainder or the yard is enclosed by a chain link fence. OUtdoor storage is a permitted use in the M-l zone with an approved amditional use permit. One or staff's main amcerns regarding outdoor storage is that an area is properly saeened from pUblic view. The amditional use process provides us with the means to require adequate screening. Because Peck Road is a major arterial, it is staff's opinion that outdoor storage should be properly screened from the public right of way. If this project is approved staff would recommend that the 8 '-0" chain link fence located along the southerly 61'- n. feet, the northerly 37'- 2"!. and the 27'-9"!, along Peck Road be replaced with a slumpstone wall to match the eIistina building and wall. This would provide adequate screening or the vehicle storage area and make this an integral part of the property and building 10 the south. In the past the City has received complaints regarding the noise from trucks operating refrigeration units and the repair of trucks on the vacant property directly sOuth or the termite business. Staff would recommend that trucks with refrigerated units not be allowed to be stored in this area and that there not be any repair of vehicles on the site. C.UP. &6-6 April 9, 1986 Page 2 . . . Pursuant to the provisions of the California Environmental Quality Act, the PlAnning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change lnany of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ~MMiMDAT!Qlt The Planning Department recommends approval of C.U.P. 86-6 SUbject 10 the follo\viDg conditionJ: 1.
