.
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 86 -5 TO
OPERATE A CHURCH AT 303 EAST LIVE OAK A VENUE
WHEREAS. on March 3, 1986, an application was filed by Assembly of God of
Garvey Church, to operate a church, Planning Department Case No. C.U.P. 86-5. on
property located at 303 East Live Oak Avenue. more particularly deSQ"Ibed as
follows:
Lot 53 and 54 of Tract 13217, in the City of Arcadia, County of Los Angeles,
State of California as per Map rerorded in Book 264, Pages 26 and 27 of Maps
In the OITice of sald County Recorder,
WHEREAS. public hearings were held on March 25 and April 9, 1986, at which
time all interested persons were given full opportunity to be heard and to present
evIdence;
NOW. THERIiFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
. HEREBY RESOL VIiS AS FOLLOWS:
SIiCTION 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
SIiCTION 2. This Commission finds:
1, That the granting of such CondItional Use Permit will not be detrImental to
the pUblic health or welfare, or Injurious to the property or improvements In such
zone or viclnlty.
2. That the use applied for at the location indIcated is properly one for which
a Conditional Use PermIt is authorized.
3. That the sIte for the proposed use Is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, landscaping and other
features required to adjust sald use with the land and uses in the neighborhood.
4. That there is concern regarding the parking Impact on the residential
properties on Third Avenue. There have been parking problems on Sundays
. resulting from the exillting church located on the northwest corner of Third Avenue
, and Live Oalc and it WllS the consensus of the Commission that precautions should be
talcen not to a'eate mote problems for the residential property owners. Based upon
these concerns the Plannillg Commission felt the parking ratio should be one parking
space for each four seats which is consistent with the Church on the northwest
corner of Third And Live Oak rather than the minimum requirement of one parking
space for each five seats.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6, That the use applied for will not have a substantial adverse impact on the
environment.
. $BCTION 3, That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate a church upon the follOWing conditions:
I. That fire safety shall be complied with to the satisfaction of the Fire
Department.
2. That the parking lot shall be restriped as per Section 9629.8 of the
Arcadia Municipal Code.
3. That the ratio of seating to parking be one parking space for each four
, seats with the flexibility that if the 92 seats results in a portion of a pew that the
applicant will be allowed a full pew.
4. That C.U.P. 86- 5 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.

5, Noncompliance with the provisions and conditions of this Conditional Use
, .permit shall constitute grounds for the immediate suspension or revocation of said

Resolution reflect the Commission's action of April 9, 1986 and the following vote:

The applicant is proposing to convert the existing 4,506 sq, ft. office building
into a church. The applicant is not proposing any major alterations to the
t>lli1ding; there will be some minor interior alterations,
The easterly portion of the building will be conY( rtoo into a sanctuary with
seating for 115 persons ( 16 pews, 12 feet long),
The remainder of the builCing will be used for fa !lily cOt',nseling and offices,
The church meets three times a week for public'lfOrship; Wednesday
evening and twice on Sunday (once in the morning and once in the evening).
According to the applicant there will 00 no outdo:>r activities or children's
day school.
There are 22 parking spaces on the site, Based upon the current code
requirements (Section 92695), 23 parking space; are required for 115 seats,

A church is a permitted use in the C-2 zone with an approved conditional use
permit
one of the major con~rns that staff has is par~ng. Currently there is a
serious parking problem on Sundays from an existing church located on the
northwest corner of Live Oak and Third Which impacts the residential
properties to the north,

Based upon the current congregation size, staff does not for~ a parking
problem with the proposl?d church, However, staff is concerned that if the
church should reach its maximum capacity of 115 persons, there could 00 a
need for additional on-site parking, The current parking requirement of one
plfking space for each 5 fixed seats is a minimum requirl?ment. Because of

the location of this church adjacent to the residential property, staff would
recommend that th>? parking ratio W I space for each 4 fixed seats Which
would allow a maximu..rn seating for M persons. This is consistent with the
church located to the west.
The adjoining restaurants (Carmines and the Royal Turtle) are not open
Sunday mornings. Carmines does open for dinner on Sundays, However, at
this time there is no arrangement to allow for church parking on these
properties.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance, Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
The Planning ~partment recommends approval of C.U.P. 86-5 subject to the
following conditions:
1. That fir€. safety shall be complied with to the satisfaction of the Fire
Department,
2. That the parking lot shall W restriped as per Section 9629,8 of the
Arcadia Municipal Code.

13A. Generation of substantial additional vehicular movement. The proposed church
may create addi tional vehicular traffic to the area on Sundays. However, there
will be only limited weekday traffic on ~Tedne5clay evening when the)' have Bible
studies. Presently the church has a congregation of 35 persons. Based upon
the maximum occupancy church occupancy of 115 persons, staff does not believe
that there will be a substantial increase of traffic in the area with the possible
exception of Sunday and based upon the current congregation of 35 persons this
increase should be insignificant.
13B. Effects on existing parking facilities or demand for new parking. Based upon
