PLANNING COMMISSION RESOLUTION 1312 A RESOLUTION GRANTING CONDITIONAL USE PERMIT &6-4 FOR THE CONTINUED USE OF TEMPORARY BUILDINGS AND APPROVAL OF A MASTER PLAN FOR THE KARE YOUTH LEAGUE AND RIO HONDO SCHOOL AT 5150 FARNA AVENUE WHEREAS, on February 20, 1906, an application was filed by Kare Youth League for the continued use of temporary buildings and approval of a master plan for the Kare Youtll League and Rio Hondo School, Planning Department Case No. C.UF. 06-4, on property located at 5 150 Farna A venue, more particularly described as follows: Portion of Lot 17, Rancho san Franctsquito Tract, in tlle City of Arcadia, County of Los Angeles. as recorded in Book 42. pages 93 and 94 of Miscellaneous Records in the office of tlle Recorder of said County. WHEREAS, a public hearing was held on March 25, 19&6, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THECITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department In the attached report is true and correct. SECTION 2, This Commission finds: 1. T11at Ule granting of SUCh Conditional Use Permit Will not be <!etrlmenta1 to the pUblic bealtb or welfare, or injurious to the property or improvements in such zone or vidnlty. 2. Tllat the use applied for at the location indicated is property one for whiCh a Conditional Use Permit is authorized. . . . , 3. That the site for the propo*<i use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use With the land and uses in the neighborhood, 4, That the site abuts streets and highways adequate in Width and pavement type to carry the kind of traffic generated by the proposed use, 5. That the granting of such Conditional Use Permit Will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. SECTION 3 That for the foregoing reasons this Commission grants a Conditional Use Permit for the continued use of the temporary buildings and approval of a master plan for the Kare Youth League and Rio Hondo School upon the folloWing conditions: 1. That the applicant shall comply With all the conditions set forth by the County of Los Angeles in Conditional Use Permit Case No. 2128-( 1) as noted ~low: a. This permit shall not ~ effective for any purpose until the applicant and the oWner of the property involved, or his dilly authorized representative, have filed at the office of the Department of Regional PI~nnjng, their affidavit stating that they are aware of, and agree to accept, all of the conditions of this permit. b, It is hereby declared to be the Commission's intent that if any proVision of this permit is held or declared to be invalid, the permit shall ~ void and the priVileges granted hereunder shall lapse. 2 1312 . . . c, It is further declared and made a condition of this permit that if any condition hereof is violated, or if any law, statute, or ordinance is violated, the permit shall 00 suspended and the privileges granted hereunder shall lapse; provided that the applicant has been given written notice to cease such violation and has failed to do so for a period of thirty (30) days. d. All requirements of the zoning ordinance (County) and of the specific zoning of the subject property must be complied with unless otherwise set forth in the permit or shown on the approved plot plan. e, The subject property shall 00 developed and maintained in substantial compliance with the plans and elevations on file marked Exhibit "A', "B" and 'C", In the event that subsequent revised plot plans are submitted the written authorization of the property owner is necessary. f. Three copies of a landscape planwtlich may be incorporated into a reVise<1 plot plan shall be submitted to and approved by the Planning Director prior to the issuance of a building permit, The landscape plan shall show size, type and location of all plants, trees and water facilities, g, The applicant shall install improvements on Farna Avenue to the satisfaction of the Los Angeles County Road Commissioner. .' h, All structures shall conform with the requirements of the Division of Building and Safety of the Department of County Engineer. " j, The subject facility shall be developed and maintained in compliance with requirements of Ule Los Angeles County Department of Health Services. Adequate water and sewage facilities shall 00 provided to Ule satisfaction of said Department. 3 1312 . . . j. Upon receipt of this letter, the applicant shall contact the Fire Prevention Bureau of Los Angeles County Forester and Fire Warden to determine facilities that may be necessary to protect the property from fire hazard, Water mains, fire hydrants, and fire flow shall be provided as may be required by said Department. Ie, The applicant shall secure any necessary permits from the South Coast Air Quality Management District. 1. The applicant shall contact the County Engineer to determine whether an Industrial Waste Disposal Permit is required. If required, such permit shall be kept in full force and effect during the life of the operation. 00, A minimum of 156 off -street parl'Jng spaces shall be provided on the subject property as shown on Exhibit 'A. and shall be developed in accordance with Section 2252,1060 and 252, 1070 of the Zoning Ordinance. n, All required parking shall be kept clear and open for guests and staff. Driveways shall be posted "No Parking' where required by the Forester and Fire Warden, o. Participants in school and youth league activities shall not part on neigbboring residential streets. Enforcement of this conditional shall be the responsibility of the league and school administration. p, To insure compliance with Condition 15, the league and school, administration shall: ( 1) Continue operation of the overflow parking, busing and van/carpool plans contained in the draft environmental impact report arid in the exhibits presented at the public bearing. Any proposed cbanges in these plans must be 4 1312 . . . submitted to the Director of Planning for review and approval before implementation, (2) Storage of trucks and heavy vehicles shall be provided at off -site locations indicated on the list on file entitled "Kare Youth League Vehicles" or at other off-site locations approved by the Director. (3) All drive'vVaYs and parking facilities INithin County territory shall be completed before commencement of any new construction on the subject property and, in any event, within one year from the date of this grant. (4) Continue in effect the agreement to use Water Company property for overflow parking. This grant will lapse if the agreement ceases. (5) Di~ontinue activities such as the previously ~heduled circus/carnival or the drill team competition involving attendance by more than 700 persons~ q. The ~hool shall be limited to 250 K-12 students, of which a maximum of 60 may attend grades 10 through 12. The maximum number of Youth League Team members shall be 750, r. Use of the outdoor paging/public address system shall be limited to Friday and Saturday and Sunday sporting events only. Other use of the system is prohibited. s. All external lighting shall be directed away from adjacent residences. The field lighting shall be turned off by 10:00 p.m, on Fridays and Saturdays, by 10:30 p.m. Monday through Thursday, May through September and by 8:00 p.m. Monday , through Thursday, October through April. There shall be no outdoor, night time activities on Sundays, 5 1312. . . . t. The structure indicated as a chapel shall '00 uwd only for individual meditation and shall not '00 used for organized services. u. The applicant shall comply with all regulations, ordinances and conditions of the Cities of Arcadia and El Monte v, This grant will expire 15 years from the date of grant for the youth league and 30 years from the date of grant for the school. w, In the event that the operation of any part of this facility should result in substantial complaints to the D~partment of Regional Planning or the Regional Planning Commission, the above described conditions may '00 modified if, after a duly advertised hearing by the Regional Planning Commission, such modification is deemed appropriate in order to eliminate or reduce said complaints, 2, That fire safety shall be complied With to the satisfaction of the Fire Department. 3. That Kare Youth League present a written status report on the progress of the Master Plan to the City every two years. 4, That prior to issuance of a building permit for any additions or new construction on the site; said plans shall be reviewed and approved by the Planning Commission to determine consistency with the Master Plan, 5._That if conditions change Within the area or the applicant.s violate any of the conditions of approval set forth in the staff report, the CommiSsion shall have the right through the hearing process, to add any additional conditions of approval wttich it deems necessary or terminate said conditional use permit. 6, That the material stored in the parking area shall be removed. 7, That the location and use of the existing trailers, if relocated, shall '00 subject to the review of the Building Division and Fire Department. 6 1312 8, That C,U p, 86-4 shall not take effect until the owner and applicant have . executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 9. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. SECTION 4, The decision, findings and conditions contained in this Resolution reflect the Commission's action of March 26, 1986 and the following vote: . . The applicant may request an extension at tne end of tne 30 montnperiod," On May &, 1979, tne Planning Commission granted a OM year time extension for C,U,P, 76-20 to May 2, 19&0 After several hearings, the Planning Commission granted another time extension for C.U p, 76-20 to OctoMr 2&, 19& 1. The City CouncH at its July 20, 19&2 meeting approved a request for a time extension to DecemMr 31, 19&4 On DecemMr 11, 19&4, the Planning Commission granted a one year time extension for C.U,P, 76-20 to ~cember 31,19&5 The Conditional Use Permit for the temporary classroom buildings has expired, CUP, 77-3.3_ In ~ptember, 197&, the City Council approved CU.P, 77-33 for the temporary gymnasium structure on the proposed site, A condition of approval of this C.U,P, was that the permit would expire on ~ptember 5, 19&0 On ~ptember 5, 19&0, tl1e school filed a request to modify this condition to allow for a two-year time extension, The City Council, upon the recommendation of the Planning Commission granted a two-year time extension to ~prember, 1982 with the stipulation that "at the end of this period, the City Council upon tlle recommendation of the Planning Commission may, at the request of the applicant, grant an additional time extension, " C.UP (lO-4 March 25, 19&6 Page 2 . . . The City Council at its July 20, 1982 meeting approved a request for a time extension to December 31, 19M On December II, 1984, the Planning Commission granted a one year time extension to December 31, 1985, The conditional use permit for the temporary gymnasium has also expired. SPECIAL INFORMATION On June 13, 1984. the County Regional Planning Commission granted conditional use permit 2128-( 1) [see attached El!1libit Al to continue and expand the Rio Hondo School and the Kare Youth League, An Environmental Impact Report was prepared for this proje<:t. It was note<! that the modest increase in youth league attendance and school enrollment would not significantly alter the level of traffic in the surrounding area, This Conditional Use Permit was approved subje<:t to the conditions outlined in the County's report (El!1libit A) PROPOSAL The applicant is requesting this conditional use permit to continue the use of the temporary classrooms and the temporary gymnasium and is requesting approval of a master plan for the school and youth league, The proposed Master Plan building schedule is as follows: December, 1985 As per the condition of the County, the first phase is to remodel the entrance to the subje<:t site, Only the landscaping remains to be completed, December, 1987 The first major building improvement Will be a classroom to replace the exiSting temporary trailers (CUP 70-20) The portable trailers Will then be used for temporary offices, C,U,P, 86-4 March 25, 1986 Page 3 . . . September, 1989 Remodel the existing temporary gymnasium (CU ,P 77 - 33) into a permanent structure, This involves adding a sprinkler system and compliance with City building ordinances (which will be required for a permanent structure). The existing curtain doors will be replaced with real doors, September, 1991 September, 1993 Administration and Library to be completed, Printshop and classrooms to be completed. The portable trailers will be removed upon the completion of the office and printshop buildings, Future considerations Remodel locker room, addition to music room, cafeteria and classrooms, classroom building and chapel The present school enrollment is 220 pupils. According to the applicant, there will not be a significant increase in school enrollment as a result of the proposed master plan, The County has limited enroUment to the foUowing: K-12, 250 students with a maximum of 60 students that attend grades 10 through 12, The maximum number of Youth League Team members is limited to 750 The County also required the discontinuance of activities Which involve attendance by more than 700 persons, These activities include the circus/carnival and drill team competition which are now being held at other locations, There are 156 off -str~t parking spaces, As noted previously, the improvements to the entrance and parking area are presently being completed. There is outside storage of school and sports related materials in the parking area located along the southeasterly portion of the property, This parking area abuts residential property and it should be cleared of all outside storage, C.UP 86-4 March 25, 1986 Page 4 . . . ANAL YSI S Staff does not have any problem with the retention of the temporary classroom trailers and the temporary gymnasium, It is staff's opinion that the Master Plan as submitted be approved with the following con<iitions: 1. That !{are Youth League present a written status report on the progress of the Master Plan to the City every two years 2, That prior to issuance of a building permit for any construction on the site; said plans shall be reviewed and approved by the Planning Commission, 3, That if conditions change within the area or the applicant's violate any of the conditions of approval set forth in the staff report, the Commission shall have the right through the hearing process, to add any additional conditions of approval Wl1ich it deems necessary, 4, That the master plan be approved subject to the conditions set forth by the County in the attached Exhibit A. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions I,oIljthin the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance, Therefore, a Negative Declaration has been prepared for this project. Four persons testified in opposition to the project on the grounds that the expansion would increase congestion, noise, and parking problems. They further stated that late night activities and certain in- tensive weekend activities interfered with their peace and com- fort. Letters were also received in support of the school and sports league. The case was continued to May 9, 1984 to allow the applicant to submit additional information and a field trip was scheduled. FIELD TRIP - Ms.:?' 4, 1984 A field inspection was made to the site by the Zoning Board, all members were present. SECOND PUBLIC HEARING - !'la,'?, 9. 1984 The applicant's representative submitted additional information concerning storage of service vehicles and number of cars entering the facility, and described the terms of the agreement with Southern California Water Company regarding continued use of the portion of the site Water Company ownership. The applicant is proposing to expand an existing X-12 school aDd sports league operation on the site. 2. The property has 4.7 acres wi thin the UDincortlorated County Area. The remaining areas are wi thin the Oi ties of Arcadia and El !'lonte. 3. The subject property wi thin the UDincorporated County area is located within the R-1 zone, which was designated to conditionally accomodate the proposed use. . . . 10. 4. The portion of the sub.iect property within the City ot Arcadia can conditionally accommodate the purposed use. Tho school gymnasium is presently developed in the jurisdication ot Arcadia under a temporary use llermit which expires in December, 1984. Subsequently the gynmas~um and surrounding class rooms and athletic facilities within the jurisdi~tion at Arcadia should be revised as conditional uses by said jurisdiction. 5, The portion of the subject property within the City of E1 Monte can accommodate the purposed use as a matter as course. 6. The sports league use (after school hours and all day, Saturday) is a more intensive that the school and is considered by the applicant as economically essential to the total operation. 7. The subject property is within the residential Low Density Category or the Land Use Policy Hap or the Los Angeles County General Plan characterized as suitable tor supportive development, including the proposed use. The access to the sub~ect property is through a residential area. by way of local residential streets, including North Farna Avenue which taps into the site at the north boundary and provides its sole means of vehicular access. 9. The applicant has an agreement with the Southern California Water Company to use its property for athletic field and overflow parking. The continued operation of the athletic facility is contingent upon the agreement between the applicant and the Water Company, sincp this property is necessary to provide parking for the athletic related events. The initial study for the project identified traffic/access and noise as potential environmental impacts. It was also determined that the project will not have significant adverse effects on the remaining environmental factors since the potential imports did not exceed the threshold criteria for significance, as established by the County of Los Angeles. The environmental impact report that the modest increase in youth league attendance and school enrollment will not significantly alter the level of traffic in the surrounding area. However, certain existing aspects of the school and youth league operations do have an adverse impacts on the adjacent local streets. These impacts will be mitigated to insignificant levels by the con- ditions ot approval and the project design in that: A revised parking and driveway system will be created to eliminate queues forming at eLtrance to the site at Farna Avenue; the operators of the school and league will continue to provide for a system of overflow parking busing and van/car pools and crowd control for large events as described in the environmental report and in exhibits presented at the public hearing; events currently held which attract more thB.'ll 700 patrons will be discontinued; and the school trucks and o~er peavy duty vehicles will be stored at off-site loca~ions. The site is currently developed with a school and youth sports league center. The "natural" plant and animal communities have been pre- viously replaced by structures, pavement and grass fields which in turn favor particular forms of urban wildlife. There are no known cultural or historical aspects associated with the site. The scenic qualities of the area are limited. The structures on the site are related to the school and the sports league. The largest structures are the pavilion on the northeasterly portion of the site, thg office-printshop-sportshop building, and the office and classroom building, both in the south central portion of the site, Other smaller buildings are two individual classroom buildings, a music building, and a warehouse, On the west central portion of the site is a Southern California Water Company compound building. . EXHIBIT C Environmental Setting of the Surrounding Area The topography of the surrounding area is similar to the subject property--gently sloping to the southeast. Single-family residential tracts are situated to the north, west and south of the subject property. To the north is a golf course; to the east and southeast. a flood control basin, The residential tracts and golf course have replaced the natural plant and animal community. The flood control basin, for the most part, is inundated. There are no known cultural or historical aspects associated with the surrounding area. Moreover, the scenic qualities are limited (the golf corse may be considered to have scenic qualities similar to the playing fields of the subject property).
