PLANNING COMMISSION RESOLUTION NO. 1311
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 86-3 FOR
THE CONSTRUCTION AND OPERATION OF A CHURCH AT 1100 WEST
DUARTE ROAD.
WHEREAS, on February 20, 1986 an application was filed by Monsignor
Charles P. Donahue for the construction and operation of a church, Planning
Department Case No. C.U.P. 86-3, on property commonly known as 1100 West Duarte
Road, more particulary decirbed as follows:
The east 185 feet of the north 235 feet of Lot 1 in
Block C of the Santa Anita Land Company's Tract, in
the City of Arcadia, County of Los Angeles, State of
California, as per Map recorded in Book 6, Page 137 of
Maps, in the Office of said County Recorder.

WHEREAS, a public hearing was held on March 11, 1986, at which time all
interested persons were given full opportunity to be heard and to present
evidence;
. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Condi tional Use Permit will not adversely
affect the comprehensi ve General PI an.
6. That the use applied for will not have a substantial adverse impact
on the environment.
Sect ion 3. That for the foregoi ng reasons this Commi ssion grants a
Conditional Use Permit for the construction and operation of a church upon the

Conditions as outlined in the attached report from the Department of
Public Works shall be complied with to the satisfaction of the
Director of Public Works.
Fire protection shall be provided as

A covenant or Parcel Map shall be recorded which will hold the lots
as one parcel. The covenant shall be completed to the sati sfaction
of the City Attorney and Planning Department before issuance of
Building Permits.
A landscape and irrigation plan shall be submitted to the Planning
Department for its approval prior to issuance of Building Permits.
Landscaping shall wnply with A.M.C. 9269.13.A.
The parki ng lot shall comply with the standards setforth in A.M.C.
Sections 9269.5.1, 9269.7.1, 9269.7.3, 9269.8.1, 9269.8.3, 9269.9.1,
and 9269.12 and 9269.13.A. Note that compact spaces shall not exceed
20% of the total number of parking spaces. Final parking lot plan
shall be subject to approval of the Planning Department.
Two-way driveways shall be provided on Duarte Road and Temple City
Boul evard.
A modification is granted for 61 parking spaces in lieu of 64
required by the Fire Department.

8. Exterior lighting shall comply with A.M.C. 9263.6.1.
9. Removal or demolition of the rectory, existing church and multi-use
building shall be completed within one year from the date of issuance
of the first Building Permit. Also, if the new church is completed
prior to said one year period, all existing buildings shall be
removed or demolished within 30 days after the new church is ready
for occupancy (date of final inspection by the Building Department).

10. The parking lot shall be completed (striping, landscaping, paving,
curbs, wheel stops, etc.) within 45 days after removal or demolition
of a 11 exi st i ng buil di ngs.
11. The placement of permanent seating (pews) within phase one and phase
two of the sanctua ry shall be permitted under the foll owi ng
condi t ions:
A. Seating shall be limited to 320 persons within phase one
of the sanctuary per A.M.C. 9269.5.
B. The seating within phase two of the sanctuary shall not
be used until additional parking is provided per A.M.C.
9269.5 and 9269.6. Any new parking lot shall cOOlply with
the cOOlmercial standards as stated in A.M.C. 9269.5.1,
9269.7.1, 9269.7.3, 9269.8.1, 9269.8.3, 9269.9.1, 9269.12
and 9269.13.A. Said parking lot shall be sUbject to
approval by the Planning Department.
C. Final seating plan shall be subject to the approval of
the Planning Department.
12. That C.U.P. 86-3 shall not take effect until the owner and applicant
have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
13. NoncOOlpliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the COOlmission's action of March 11, 1986 and the following

HISTORY
On November 29, 1955 the regional Planning Commission of the County of Los
Angeles granted a zone exception for the establishment, operation and maintenance
of a church at 1100-1102 West Duarte Road. The application was filed by the
International Church of the Foursquare Gospel.
An appeal was filed, but was denied by the County of Los Angeles Board of
Supervisors on February 28, 1956.

PROPOSAL
Presently, Our Lady of the Angels Chapel operates from the site utilizing a
,ingle-story 2,080 square foot church, a two-story 3,106 square foot multi-use
building and a single-family dwelling which is the residence (rectory) for the
minister. The applicant proposes to construct a 16,000 square foot church with
uasement (lower floor).
The removal of the existing structures and improvements to the parking lot will
take place in two phases. After the new church is completed, the first phase
will occur which will include the removal of the existing church and multi-use
building. There is no timetable for the completion of phase two, which calls for
the removal of the dwelling, adding 18 parking spaces and the driveway on Duarte
Road (see site plan).
The church will have a lower floor which will contain twelve classrooms, a
kitchen and multi-purpose area. The first floor will contain the sanctuary and
pert i nent acces sory roans.
Seating within the sancturay will also be done in two phases. Phase one will
seat 320 persons, which requires 64 parking spaces, and phase two will seat an
additional 156 persons, which requires 32 parking spaces. When completed, the
sanctuary will seat a total of 476 persons, which requires 96 parking spaces.

62 parking spaces are proposed when the project is finally completed. There will
be 42 standard spaces with 20 compact spaces. The parking lot will comply with
the commercial standards set forth in the Zoning Ordinance except for the
percentage of compact spaces: 32% (20) proposed, 20% (12) allowed.
Ingress and egress to the site will be provided by a two-way driveway off of
Duarte Road and a one-way driveway from Temple City Boulevard.
ANALYSIS
A church is a permitted use in the R-3 zoned with an approved conditional use
permit.
The Planning Department has several concerns about the proposed development.
Parking for the site is inadequate as proposed. Staff's calculation of the
requi red parki ng (96 spaces) is based only on the sanctuary and does not take
into account special events or the use of the lower level and first floor at the
same time. Therefore, it is unacceptable to provide only 62 parking spaces.
Also, phase one only provides for 44 spaces while phase two does not have a
definite date for completion.
All the exi sting structures shoul d be removed at the same time from the site when
the church is canpleted to allow for the full development of the parking lot. A
timetable should be established to minimize the impact upon adjacent residential
properties. Competition for street parking is intensified since the surrounding
properties are developed with multiple-family units.

Also, seating for phase two of the sanctuary should not be permitted until
additional parking is provided. This would mean the prohibition of any type of
additional seating within the sanctuary. Per Code Section 9269.6, parking could
be on a site within 495 feet of the church. A covenant would have to be recorded
to insure the maintenance of the parking spaces as long as the church exists.

By limiting the sanctuary to seating for 320 persons, only 64 parking spaces
would be needed. If the number of canpact spaces is limited to 12 (20%), staff
believes only one space would be lost leaving 61 parking spaces, which would be
an an acceptable modification.
Since there are only two driveways, both should be for two-way traffic. The
driveway on Temple City Boulevard would have to be enlarged to 20'-0" in width.
The location of the trash enclosure along the south property line is mitigated
by the adjacent lot's driveway (approximately 25'-0" wide), which acts as a
buffer between the dwelling units.
The Planning Oepartment would be in favor of the proposal if limitations are
established to minimize potential negative impacts upon the surrounding
neighborhood.
Pursuant to the provi sions of the Cal i fornia Envi ronmental Qual ity Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not di sclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise, and
objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.

The Planning Department recommends approval of C.U.P. 86-3 subject to the
following conditons:

parking spaces are provided per A.M.C. Sections 9269.6 and 9269.5.
Any new parki ng lot shall comply with the standa rds set forth in
condition number 5 and shall be subject to the approval of the
Planning Department.
That C.U.P. 86-3 shall not take effect until the owner and applicant
have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for the immediate suspension or
revocation fo said Permit.

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific
findings and conditions of approval set forth in the staff report (or as
modified by the Commission).
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of
that decision.

This department has reviewed the subject CUP and recommends the following
conditions of approval:
1. Submit grading and drainage plan prepared by a registered civil engineer
subject to the approval of the Director of Public Works.
2. The existing parkway widths are ten (10) feet on Duarte Road and eight (8)
feet on Temple City Boulevard.
3. Close existing driveways not to be used.
4. Construct P.C.C. ramp for the handicapped per City of Arcadia Standard
Drawing No. S-22.
S. Gravity drainage outlets, and driveway aprons shall be constructed to
conform to Drawing S-ll.
6. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system.
The above items are to be complied with to the satisfaction of the Director of
Public Works in accordance with the applicable provisions of the Arcadia
Municipal Code.

C. Discussion of environmental evaluation 13a and 13b.
The construction of the proposed 16,000 square foot church
will generate additional vehicular movement, effect existing
parking facilities and create a demand for new parking.
While the new church is under construction, the surrounding
neighborhood will be effected by the loss of on-site parking.
During construction the existing church will still operate.
When the new church is completed, the existing buildings will
be removed and the area will become a parking lot.
To mitigate the situation the following limitations may be
imposed:
1, Limiting the seating within the sanctuary of the
new church until additional parking can be provided.
2, Establish a timetable for the removal of all existing
buildings and the completion of the new parking lot.
