PLANNING COMMISSION RESOLUTION NO. 1310 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-21 FOR THE CONSTRUCTION AND OPERATION OF AN AUTOMOBILE AND TRUCK DRIVING SCHOOL AT 11723 CLARK STREET. WHEREAS, on November 26, 1985 an application was filed by Richard F, Dootson DBA Dootson Driving School for the construction and operation of an automobile and truck driving school, Planning Department Case No, C,U.P. 85-21, on property canmonly known as 11723 Clark Street, more particulary decirbed as fo 11 ows : Lot 631 to 641 inclusive, Lots 863 to 887 inclusive and Lots 1107 to 1129 inclusive of The Chicago Park Tract, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 30, Page 100 of Miscellaneous records, in the Office of said County Recorder, WHEREAS, a public hearing was held on March 11, 1986, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Pennit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity, 2, That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. ,3. That the site for the proposed use is adequate in size and shape to accanmodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood, 4, That the site abuts pavement type to carry the kind streets and highways of traffic generated .~ adequate in width and by the proposed use, . . . 5. That the granti ng of such Conditional Use Permit will not adversely affect the canprehensive General Plan, 6. That the use applied for will not have a substantial adverse impact on the environment, Section 3. That for the foregoing reasons this Commission grants a Conditional Use Pennit for the construction and operation of an automobile and truck driving school upon the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. Fire protection shall be provided as required by the Fire Department. On site fire hydrants will be required. 3. New water service shall be installed by the Arcadi a Water Department at the developer's expense. 4. A covenant or Parcel Map shall be recorded which will hold the lots as one parcel. The covenant shall be completed to the satisfaction of the City Attorney and Planning Department before issuance of Buil di ng Pe nnit s, 5. No vehicles shall be parked on the premises which are offered for sale, lease or rent, 6. Driving school trucks shall be parked on the designated paved areas as shown on the plans on file in the Planning Department. Driving school trucks shall not interfere with parki ng spaces designated for the industrial buildings, loading areas and driveways. 7. Storage of inoperative vehicles shall be prohibited. 8. Automotive repair shall be prohibited unless a conditonal use permit is granted for such use. 9, The office building (building no, 1) shall be used only for the driving school operation or for other pennitted uses in the M-1 zone, 10. That C. U, p, 85-21 shall not take effect unt il the owner and appl i cant have executed a fonn available at the Planning Department indicating awareness and acceptance of the conditions of approval, 11. Dootson, DBA Dootson Driving Schools 11723 Clark Street Conditional use permit to operate an automobile and truck driving school. LOT AREA: FRONTAGE: Approximately 218,213 square feet (5.01 acres) 575 feet on Clark Avenue EXISTING LAND USE & ZONING: The subject site is currently vacant; zoned M-1 & D. SURROUNDING LAND USE & ZONING: NORTH: SOUTH: EAST: WEST: Vacant, zoned M-1 & D Vacant and industrial buildings; zoned M-1 & D Vacant and industrial buildings; zoned M-1 & D Vacant and industrial building; zoned M-1 & D GENERAL PLAN DESIGNATION: Commerci al Ii ndustri al PROPO SAL The applicant proposes to construct a two-story 7,592 square foot office building (for the driving school) and seven single-story industrial buildings totaling 89,169 square feet, The construction will be in two phases. Phase I will consist of an office building and three industrial buildings totaling 28,739 square feet (buildings 1 through 4 of site plan). Phase II will consist of four industrial buildings totaling 60,430 square feet (buildings 5 / through 8 of site plan), 92 parking spaces will be provided in Phase I, 88 spaces are required. When Phase II is completed a total of 211 parking spaces will be provided, 209 spaces are required, This project will exceed many of the requirements for the M-1 zone. Following is a comparison of the project with the M-1 zone requirements: . l. Lot coverage 2, Compact spaces 3. Dri veway width 4. Due to the nature of the business and its location within an industrially zoned area, staff believes the proposal can be accommodated on the site, Driving school automobiles will be out during the day and taken home by the instructors at night. On occasion, automobile instructors will visit the site for meetings, parki ng spaces for the drivi ng school's office have been provided at 4 spaces per 1,000 square feet of gross floor area, not at the industrial standard of 2 spaces per 1,000 square feet of gross floor area. Trucks of the driving school will be parking on a paved area away from the main circulation patterns of the project (see site plan). The use of the site for trucks may be temporary, since when Phase II is constructed the applicant proposes to store the trucks at another location. Pursuant to the provisions of the California Environmental Quality Act, the planning Department ,has prepared an initial study for the proposed project, Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. . C.U.P. 85-21 3/11/86 Page 2 ~ RECOMMENDATION The Planning Department recommends approval of C.U.P, 85-21 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works, 2. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. February 27, 1986 TO: PLANNING DEPARTMENT FROM: PUBLIC WORKS DEPARTMENT SUBJECT: CUP 85-21 - 11723 CLARK STREET This department has reviewed the subject CUP and reconvnends the following conditions of approval: " Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works. 2. The existing parkway widths are eight (8) feet on Clark Street, 3, Plant parkway trees at locations determined by the Director of Public Works. . 4, Construct P.C.C. sidewalk, as per City of Arcadia Standard Drawing S-17, 5, Gravity drainage outlets, and driveway aprons shall be constructed to conform to Drawing S-ll. 6, The subject property is served by a sewer line that has the capacity to transport sewage flows generated in accordance with land use reflected in the City's current general plan to CSD's system, 7, All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the permittee and shall be at the permittee's expense. 8.
