PLANNING COMMISSION RESOLUTION 1307
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-24
AND RELATED MODIFICATIONS TO OPERATE AN EATING
EST ABLlSHMENT AT 328 EAST FOOTHILL BOULEY ARD
WHEREAS, on December 24, 1985, an application was filed by Carmelo
Palazzolo to operate an eating establishment, Planning Department Case No, CU.P. 85-
24, on property located at 328 East Foothill Boulevard, more particularly described
as follows:
Lot 7. Block A, Tract 7723 in the City of Arcadia, County of Los Angeles, State
of California as per Map recorded in Map Book 93, Pages 41 and 42 in the
County Recorder's office.
WHEREAS. a public hearing was held on January 14. 1986, at which time all

.. NOW, THEREFORE, THE PLANN1NG COMM1SSlON OF THE CITY OF ARCAD1A
HEREBY RESOL YES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission finds:
I. That tile granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such
zone or vicinity.
2. That the use applied for at the location indicated is properly one for which
a Conditional Use Permit is authorized.
3. Although the site is substandard in parking, it was the consensus of the
Commission that the addition of two tables with seating for eight persons would not

. not significantly increase the customer traffic to this site; however, the addition of
the on-premise sale and consumption of beer and wine may encourage more people
to stay on the premises, thereby, increasing the potential traffic to and from the site.
The Planning Commission determined that the sale and consumption of beer and
wine on the premises should be prohibited:
4. That the site abuts streets ancihighways adequate in width and pavement
type to carry the kind of traffic generated by an eating establishment.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan since the General Plan designation for this site is
commercial and an eating establishment is consistent with the commercial
designation.
6, That the use applied for will not have a substantial adverse impact on the
environment.

. Section 3. That for the foregoing reasons this Commission grants a Conditional
Use Permit to operate an eating establishment upon the following conditions:
1. That the on-premise sale and consumption of beer and wine shall be
prohibited.
2. That fire-safety shall be prOVided to the satisfaction of the Fire
Department.
3. That the landscaped areas along Foothill Boulevard shall be weeded and
maintained weed free.
4. That a plan for striping the parking area shall be submitted to the
Planning Department for its review and approval and no occupancy permit shall be
issued until such time as the striping has been completed to the satisfaction of the
Planning Department.

approved by the Planning Department.
6. That seating shall be limited to a malimum of eight persons.
7. That a modification be granted for a minimum of four parking spaces in
lieu of 28 spaces required.

8. That the garage shall be used for parking purposes only. No storage shall
be allowed inside the garage.
9. That C.U.P. 85-24 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approvaL
10. Noncompliance with the provisions and conditions of this
Conditional
Use permit shall constitute grounds j:or the immediate suspension or revocation of
. said Permit.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of January 14. 1986 and the following vote:

Section 'i. The Secretary shall certify to the adoption of this Resolution and

PROPOSAL
The building contains 2,140 square feet and is divided into two uses. A shoe
repair store occupies the easterly 1,070 square feet of the building and the
pizza place will occupy the westerly 1,070 square feet.
The vacant portion of the building is being remodeled into a Pizza-to-go
establishment. The applicant is requesting a conditional use permit to place
two tables with seating for eight persons in the facility and is requesting a
liquor license for the sale of beer and wine to be served on the premises.
A 20'120' garage is located behind the westerly portion of the building. The
garage is currently vacant, however, the applicant has not indicated if he will
be uSing it for parking purposes. The area between the garage and the
proposed eating establishment is enclosed with a fence and gate.
Parking is located at the rear of the building, however, there are no striped
parking stalls. Based upon code requirements, (5 parking spaces for a retail
commercial use and 20 parking spaces for an eating establishment) 28
parldng spaces would be required for this site; 6 for the shoe shop and 22
for the eating establishment. Including the 'garage, four cars could be
parked on the site, Two additional cars could be parked in front of tne
garage, however, these cars would obstruct entrance to the garage and would
only have a 22'-2" back up area in lieu of 25' required.
There is no trash enclosure and no landscaping behind the building.

There are two landscaped areas in front of the building within the public
right-Of-way. These areas need to be weeded and properly maintained.
ANALYSIS
An eating establishment is a permitted use in the C-2 zone with an approved
conditionaiuse permit. In the past the City has granted several conditional
use permits and parking modifications for eating establishments which have
had seating for 12 or less persons and have not met the parking
requirements.
Access to the parking is from the alley south of the site. This alley is heavily
travelled and parking is a prOblem in the area.
It is staIrs opinion that the addition of two tables will not significantly
increase the customer traffic to this site; however, the. addition of the on-

,premise sale and consu--:lption of beer and wine may encoJase more people
to stay on the premises, therefore. increasing the potential traffic to and
from the site.
A conditional use permit is for the use of the property and once issued any
similar use can operate under said permit. If beer and wine are allowed to
be served on the premises and there is a Change in ownership. a new owner
could change the use to primarily a beer and wine establishment which
serves food. This could result in a substantial increase in traffic to the site.
Staff would recommend that the serving bf beer and wine for consumption
on the premises be prohibited. If the..applicant wishes to sell beer and wine
it should be for off-premise consumption only.
In order to provide the maximum number of parking spaces on the site; staff
would recommend that the garage be maintained for parking purposes only
aM that no storage Shall be allowed inside the garage which would prohibit
the parking of two automobiles. The garage should be used for parking of
employees cars so that the area behind the garage can also be used for
parking. The area directly behind the shoe repair shop should be striped for
two parking spaces.
The applicant should provide a trash enclosure. The enclosed area between
the garage and the pizza establishment may be used; however, if the
applicant does not wish to utilize this area then a trash area enclosed on
three sides by a 6'-0" high wall with a solid gate must be provided.
The landscaped areas in the front should be weeded and properly
maintained.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial stUdy did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project inCluding land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 85-24 SUbject to
the following conditions:

Conditional Use permit shall constitute grounds for the immediate s
uspension or revocation of said Permit.
FINDINGS AND MOTIONS

If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and
find that the project will not have a significant effect on the environment
and direct staff to prepare the appropriate resolution incorporating the
specific findings and conditions of approval set forth in the staff report (or as
modified by the Commission).

Generation of substantial additional vehicular movement. The
proposed project has the potential of increasing the traffic within the
area. It has been staff's experience, however, that seating for less
than 12 people is gene ally for convenience of patrons,and does not
increase the traffic to and from an eating facility. Staff is
recommending that no alcoholiC beverages be served on the site. This
should also help to mitigate the potential traffic numbers.
There will be an effect on the existing parking because the site is
