PLANNING COMMISSION RESOLUTION NO. 1301
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-18 TO ADD A
SPRAY BOOTH TO THE EXISTING AUTOMOTIVE GARAGE AT 132 WEST LAS
TUNAS DRIVE.
WHEREAS, on September 3, 1985, an application was filed by Luis
Buonsanti (C & L Auto Body) to add a spray booth to the existing
automotive garage, Planning Department Case No. C.U.P. 85-18, on property
commonly known as 132 West Las Tunas Drive, more particularly described as
follows :
Part of lot 68, Santa Anita Colony Tract, in the City of Arcadia,
County of Los Angeles. State of California, as per Map recorded in
Book 42, Page 87 of Miscellaneous Records, in the office of said
Coun ty Recorder.
WHEREAS, a public hearing was held on September 24, 1985, at which time all
interested persons were given full opportunity to be heard and to present
evidence:
NOW. THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section ,. Tha t the factual da ta submi tted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. Tha t the granting of such Condi tional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicini ty.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use wi th the land and uses
in the neighborhood.
4. Tha t the si te abuts

5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.

6. Tha t the use applied for will not have a substantial adverse impact

Section 3. That for the foregoing reasons this Commission grants a
Condi tional Use Permi t to add a spray booth to the existing automotive garage
upon the following condi tions:
1 . Fire protection shall be provided as required by the Fire
Derartment.
2. The parking lots shall be restriped to provide for at least 34
parking spaces. A site plan shall be sumbitted to the Planning Department for
review and approval.
3. The spray booth shall be painted an earth tone color to match the
existing building on the property. The Planning Department may require the
repainting of said booth in the future.
4. Additional landscaping will be required along Live oak Avenue.
Said landscaping shall provide for a minimum 6'-0. high buffer and shall be
maintained in perpetuity. All plants shall be a minimum size of 15-gallon.
The landscape plan shall be subject to the Planning Department's review and
approval.

The automotive garage shall adhere to the conditions of approval
in Planning Commission Resolution 1240, which granted Conditional Use Permit
83-11.
6. All buildings and improvements shall be in compliance with the
Building Department requirements.
7. All condi tions of approval shall be completed to the satisfaction
of City Departments by November 18, 1985. If said work is not completed .by
November 18, 1985, action shall be taken for the suspension or revocation of
C.U.P. 83-11 and C.U.P. 85-18.
8. Conditional Use Permit 85-18 shall not take effect until owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
9. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension
or revocation of said Permit.

Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of September 24, 1985 and the
following vote:

HISTORY
on June 14, 1983 the planning Commission approved Conditional Use Permit 83-11
for the operation of an automotive garage at 132 West Las Tunas Drive. This
approval was subject to several conditions, one of ..mich required the parking lot
to be striped to accommodate 35 parking spaces.

The applicant converted an existing 4,100 square foot retail building into an
automotive garage. Originally, there were only 11 striped parking spaces and
sparse landscaping. The applicant was required to construct concrete sidewalls
and driveways on Las TUnas Drive, provide a trash enclosure, restripe the parking
lot and plant additional landscaping.

Five parking spaces have been lost due to the spray booth. Staff believes four
or five spaces could be accommodated in the existing parking lot on Las Tunas.
This area would have to be restriped. Restriping should also be required for the
parking lot on Live Oak since the spaces are no longer visible.
It is the Planning Department's opinion that the spray booth is unattractive and
incompatible with recent improvements to the area. The Spray booth should be
painted or additional landscaping should be required along Live Oak Avenue.
The proposed use of the site is permitted with an approved conditional use
permi t.
Pursuant to the provisions of the California Environmental QUality Act, the
Planning Department has ~epared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise, and
objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
REX::CMMENDATION
The Planning Department recommends approval of C.U.P. 85-18 subject to the
following condi tions:
1. Fire protection shall be provided as required by the Fire Department.
2. The parking lots shall be restriped to provide for at least 34 parking
