HomeMy WebLinkAbout1298 . . .' ..-:;" PLANNING COMMISSION RESOLUTION NO. 1298 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-16 FOR ADDITIONS AND IMPROVEMENTS TO A MORTUARY AND A SINGLE-FAMILY DWELLING IN THE C-2 ZONE AT 500-5D6 SOUTH FIRST AVENUE WHEREAS, on August 27,1985 an application was filed by Richard Minick for John F. Lamb, Jr. for additions and improvements to a mortuary and a sin91e- family dwelling in the C-2 zone, Planning Department Case No. C.U.P. 85-16, on property coollnonly known as 500-506 South First Avenue, more particularly describea as follows: Lots 33,34, 35 and 36, Block 63-1/2, Tract No. 866, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 16, Pages 198 and 199 of Maps, in the Office of said County Recorder. WHEREAS, a public hearing was held on August 5, 1985, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the nei ghborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the ki nd of traffic generated by the proposed use. 5. That the granting of such Conditional Use Pennit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. - 1 - 1298 . . . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for additions and improvements to a mortuary and single-family dwelling in the C-2 zone upon the following conditions: 1. A covenant shall be recorded holding the four lots as one parcel. Said covenant shall be subject to the review and approval of the City Attorney and the Planning Department. 2. The single-family dwelling at 506 South First Avenue shall only be occupi ed by the owner(s) of the property or owner(s) of the business located at 500 South First Avenue, or employee(s) of the business located at 500 South Fi rst Avenue. 3. All mechanical equipment shall be screened from public view. 4. That C.U.P. 85-16 shall not take effect until owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 27, 1985 and the following vote: AYES: Commissioners Harbicht, Hedlund, Kovacic, Szany, Dixon NOES: None ABSENT: Commissioners Fee, Galinski Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadi a. The sewer permit listed 500 and 506 South First as the location and l. O. Glasser as the owner. In 1954 the second-story dwelling and garage were added to the mortuary. Glass & Miller are the owners on the buildi ng permit. In 1959 a variance/special use permit was granted to allow additions to the mortuary. A condition of approval required the lot to the west to be maintained for off-street parki ng. Business license records from as Glasser & Miller Mortuary. & lamb Mortua ry. 1956 to 1968 show the mortuary was doing business In 1969 the business was renamed to Glasser-Miller ANAL YSIS The applicant is proposing a 589 square foot addition and hot tub to the existing dwelling, a five-car carport, trash enclosure, 6'-0" high block wall to enclose the parking lot, and landscaping. Presently, the parking lot is landscaped by one tree. This proposal will provide for landscaping along El Dorado Street and five tree wells along the east property line. It is staff's opinion that the new landscapin9 with the 6'-0" high wall will provide for an adequate buffer between the parking lot and the adjacent residential property. A mortuary is a permitted use with an approved conditional use permit. Also, residential uses in conjunction with a commercial development are permitted with an approved conditional use permit. Due to the uniqueness of the mortuary business, the Planning Department believes the dwelling at 506 South First Avenue is an integral part of the business and that the proposal would be appropriate. Staff will recommend as conditions of approval a covenant to hold the four lots as one parcel, and restrictions to the occupancy of the dwelling at 506 South Fi rst. Pursuant to the prOV1Slons of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not di sclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. C.U.P. 85-16 8/2 7 /85 Page 2 , ) . RECOMMENDATION The Planning Department recommends approval of C.U.P. 85-16 subject to the following conditions: 1. A covenant shall be recorded holding the four lots as one parcel. Said covenant shall be subject to the review and approval of the City Attorney and the Planning Department. 2. The single-family dwelling at 506 South First Avenue shall only be occupied by the owner(s) of the property or owner(s) of the business located at 500 South First Avenue, or employee(s) of the business located at 500 South First Avenue. 3. All mechanical equipment shall be screened from public view. 4. That C.U.P. 84-12 shall not take effect until owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. . FINDINGS AND MOTIONS Approval If the Pla~ning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. .
