PLANNING COMMISSION RESOLUTION NO. 1297 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-15 TO PERMIT THE EXPANSION OF A RESTAURANT AT 1121 EAST HUNTINGTON DRIVE WHEREAS, on August 5, 1985, an application was filed by Yi Fang Wu for the expansion of a restaurant, Planning Department Case No. C.U.P. 85-15, on property canmonly known as 1121 East Huntington Drive, more particularly described as fo 11 ows: Lot 32, Tract No. 14846, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 314, Pages 8 and 9 of Maps, in the office of said County Recorder. WHEREAS, a public hearing was held on August 27, 1985, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accanmodate said use. and all yards. spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. - 1 - 1297 . ,. - " 6. That the use applied for will not have a substantial adverse impact on the envi ronment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the expansion of a restaurant upon the following condi t ions: 1. That a modification is granted for 1,618 parki ng spaces in lieu of 1.648 spaces. 2. The restaurant shall comply with all relevant Fire and Building Code regulations 3. That the restaurant shall be maintained as per the plans on file in the Planni ng Department. 4. That C.U.P. 85-15 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Pennit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 27, 1985 and the following vote: AYES: NOES: ABSENT: Sect ion 5. and shall cause a Arcadi a. PROPOSAL/ANALYSIS On January 15, 1985 the Planning Commission voted 6 to 0 with one Commissioner absent to approve C.U.P. 84-25, a request to operate a 4,968 square foot restaurant at 1121 East Huntington Drive. The applicant is proposing to enlarge the restaurant by 852 square feet (12'x71'). A restaurant is a pennitted use in the C-2 zone with a conditional use pennit. It is staff's opinion that the restaurant would be an appropriate use for the site and that the parking deficiency of 1.8% (30 spaces) is minor. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 85-15 subject to the following conditions: 1. That a modification is granted for 1,618 parking spaces in lieu of 1,648 spaces. The restaurant shall cOOlply with all relevant Fire and Building Code regulations 2. 3. That the restaurant shall be maintained as per the plans on file in the Planning Department, C.U.P. 85-15 8/27 /85 Page 2 . . . ., J 4. That C.U.P. 85-15 shall not take effect until the owner and applicant have executed a fonn available at the Planning Departrrent indicating awa reness and acceptance of the condi t ions of approval. 5. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Ccxnmissionl. Denial If the Planning Commission intends to take action to deny this project, the Ccxnmission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
