PLANNING COMMISSION RESOLUTION 1295 A RESOLUTION GRANTING CONDITIONAL USE PERl11T 65-12 TO ALLOW THE OUTSIDE STORAGE OF NEW VEHICLES ON THE PROPERTY LOCATED ElEHIND THE ARCADIA NISSAN DEALERSHIP AT 333 EAST HUNTINGTON DRIVE WHEREAS, on June 13, 1965, an application was filed by Bruce Low on behalf of Arcadia Nissen to allow the outside storage of new vehicles, Planning Department Case No. C.U.P. 85-12, on property located behind Arcadia Nissan dealership ot 333 Eost Huntington Drive, more particularly described as follows: Those portions of Lots 3 ond 5, Block 84, of the Santa Anita Tract in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 34, Pages 41 and 42, Miscellaneous Records, in the office of the County Recorder of sai d Countu. WHEREAS, a pUblic hearing was held on August 13, 1985, at which time all interested pesons were given full opportunity to be heard and to present evi dence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL VES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SecUon 2, ThIs Commission finds: I. That the granting of such ConditIonal Use Permit will not be detrimental to the public health or welfare, or injUrioUS to the property or improvements in such zone or vicinity, 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and Shape to accommodate said use, and all yards, spaces, walls, fences, parking, loadIng, landscaping -1- 1295 . . . and other features required to adjust said use with the land and uses uses in the neighborhood. 4. That the site abuts streets and hi ghways adequate in wi dth and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensi ve General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. . Section 3. That for the foregoing reasons this Commission grants a Conditional Use permit to allow the outside storage of new vehicles upon the following conditions: 1. That the site shall be maintained free of all weeds and debris. 2. That C.U.P. 85-12 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the condit ions of approva L 3. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's ection of August 13, 1985 and the following vote: AVES: NOES: ABSENT: Commissioners Fee, Galinski, Harbicht, Hedlund, Szany, Dixon None Commissioner Kovacic Section 5. EXISTING LAND USE & ZONING: SURROUNDING LAND USE & ZONING: The subject site is vacant; zoned CPD-l NORTH: SOUTH : EAST: WEST: Developed with outdoor storage; zoned CPD-l Developed with Arcadia Nissan; zoned CPD-l Developed with the Flood Control; zoned CPD-l Developed with mixed residential, storage uses; zoned CPD-l GENERAL PLAN DESIGNATION: Planned Development-1 SPECIAL INFORMATION The subject site is owned by the City. On May 7, 1985 the City Council approved leasing of the property to Arcadia Nissan for the purpose of storing new automobiles on the site. This approval was subject to the conditions that Arcadia Nissan obtain an approved conditional use permit and that they agree to the conditions of approval set forth in the conditional use permit. Arcadia Nissan entered into a lease agreement with the City which became effective May 7, 1985. This lease is on a month to month basis. . PROPOSAL AND ANALYSIS . The applicant is proposing to store new cars on the property and has utilized the property for car storage on and off during the past few years. The property is surrounded by a chain link the Arcadia Nissan property to the south. automobiles will be parked on the dirt. fence and has access across The site is unpaved and This proposal has been reviewed by the Redevelopment Agency staff. They have noted that the continued maintenance should be required of the site. The City requires that all automobiles be parked on a paved surface. Because the use.of this property for automobile storage is a temporary use and is leased on a month by month basis, staff recommends that this requirement be waived. Because of its location the site is not highly visible from adjoining properties and/or right-of-ways, therefore, staff does not feel it is necessary to provide any additional screening. . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 85-12 subject to the following conditions: 1. That the site shall be maintained free of all weeds and debris. 2. That C.U.P.85-12 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 3. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. . FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. . .
