HomeMy WebLinkAbout1294 . . ~ PLANNING COMMISSION RESOLUTION 1294 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-13 FOR THE OPERATION OF AN AUTOMOBILE STORAGE FACILITY ON LOTS 1352-1356 IN THE CHICAGO PARK TRACT (FRONTING ON CLARK STREET) WHEREAS, on June 17, 1985, an application was filed by Ricardo S. and Dulce Arenas to operate an automobile storage yard, Planning Department Case No. C.U.P. 85-13, on property commonly known as Lots 1352, 1353, 1354, 1355, 1356, Chicago Park Tract, more particularly described as follows: Lots 1352, 1353, 1354, 1355 and 1356 in the Chicago Park Tract located in the City of Arcadia, County of Los Angeles, State of California, in Miscellaneous Records 3D, Page 100 in the County Recorder's Office. WHEREAS, a public hearing was held on July 9, 1985 and on August 13, 1985, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY ~ RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts pavement type to carry the kind streets and highways of traffic generated adequate in width and by the proposed use. . 1 1294 . . . . . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the property shall be surrounded on the east, west and south by a 6'_0" high block wall measured at the lowest grade. and that a 6'-0" slump stone or split face block wall shall be provided adjacent to Clark Street and that a building pennit shall be secured for said walls. 4. That the southwest and southeast corners of the site shall be landscaped and irrigated and that a landscape and irrigation plan be provided prior to issuance of the building pennit. S. That all the planter areas shall be surrounded by a 6" high concrete curb and that one tree shall be provided for each ten (10) parking spaces. 6. That all each vehicle stored on the premises must be registered. An inoperable vehicle may not be stored more than five (5) days. 7. That this site shall not be used for storage for an impounded vehicle for more than five (5) days. 8. That there shall be no mechanical work on vehicles stored on the site. 9. That C.U.P. 85-13 shall not take effect until owner and applicant have executed a fonn available at the Planning Department indicating awareness and acceptance of the conditions of approval. 10. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Pennit. 2 1294 . . . . . Section 4. NG LAND USE & ZONING: The subject site is vacant; zoned M-l SURROUNDING LAND USE & ZONING: NORTH: SOUTH: EAST: WEST: Developed with the riding stables; zoned M-l Vacant land: zoned M-l Industrial building; zoned M-l Vacant land; zoned M-I GENERAL PLAN DESIGNATION: Industri al PROPOSAL AND ANAL vS I S The applicants are proposing to utilize the property for automobile and recreational vehicle storage. According to the applicant spaces will be rented to persons wishing to store cars, recreational vehicles, and boats. The applicants may also utilize some of the spaces for storage of their tow trucks. The site will be paved with A.C. paving over a 6" base and be surrounded on the east, west and south by a 6' high concrete block wall. The wall adjacent to Clark Street will be slump stone or split face block and set back 10'-0" from the property line. This 10'-0" setback area will be landscaped. . . . (' ( Access to the parking area will be from two 25' wide driveways on Clark Street. Each driveway will have a rolling wrought iron gate. The southerly corners of the lot are noted on the plan as "landscape if required". Section 9269.13.B of the Arcadia Municipal Code states that "All unused space of reasonable size that results from the design of the parking area shall be landscaped". The proposed outdoor storage of vehicles is a permitted use in the M-l zone with an approved conditional use permit. It is staff's opinion that this is an appropriate use of this site. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or plYtentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 85-13 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public \/0 rk s . 2. 3. That the site shall be improved as per the plans on file in C.U.P. 85-13. That the property shall be surrounded on the east, west and south by a 6'- 0" high block wall and that a 6'-0" slump stone or split face block wall shall be provided adjacent to Clark Street and that a buil di ng permit shall be secured for said walls. 4. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepa~e an appropriate resolution incorporating the Commission's decision and findings in support of that decision. Construct full parkway width sidewalk per Arcadia City Standard No. S-17. 2. Submit a grading and drainage plan signed by a registered civil engineer for approval of the Director of Public Works. 3.
