PLANNING COMMISSION RESOLUTIDN 1293 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-10 TO ALLOW THE OPERATION OF A DAYTIME CHILD CARE CENTER AT 2607 SOUTH SANTA ANITA AVENUE. WHEREAS, on June 3, 1985, an application was filed by Mr. and Mrs. Henry J. Aguilar to operate a pre-school, Planning Department Case No. C.U.P. 85-10, on property commonly known as 2607 South Santa Anita Avenue, more particularly described as follows: A portion of Lot 66 of Santa Anita Colony in the City of Arcadia, 'County of Los Angeles, State of California, as per Map Recorded in Book 42, Page 87 of Miscellaneous Records, in the Office of the County Recorder of said County. WHEREAS, a public hearing was held on June 25, 1985, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY 4It RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences. parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts 'itreets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. , 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, . . . . ~, 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Pennit for the operation of a pre-school upon the following condi tions: 1. That the maximum occupancy for the pre-school shall be 25 children. 2. That a 5' high fence shall be constructed around the paved play yard and a modification be granted for said fence in lieu of a 6' high wall. 3. That a modification be granted for the 5' high chain link fence in lieu of a 6' high wall which surrounds the existing grass play yard. 4. That the parking area be cleaned of all weeds and maintained in a neat and orderly manner. 5. That the pool violations noted in the staff report shall be corrected to the satisfaction of the Building Department prior to the opening of the pre- school. 6. That fire safety shall be provided to the satisfaction of the Fire Depa rtment. 7. That C.U.P. 85-10 shall not take effect until the owner and appl icant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 8. That the doors on the east side of the classroom shall be locked and secured when the pre-school is in operation or emergency alanns shall be installed on said doors. Such safety measures shall be subject to the review and approval of the Fire Department. 10. Noncompliance with the provlslons and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Pennit. Section 4. Aguilar 2607 South Santa Anita Avenue Conditional Use Permit to operate a pre-school at the Arcadia Congregational Church LOT AREA: FRONTAGE: Approximately 125,311 sq. ft. (2.9 acres) 235 feet on Santa Anita Avenue EXISTING LAND The subject site is developed with the Arcadia Congregational USE & ZONING: Church; zoned R-2 SUR ROU NO I NG LAN D USE & ZONING: NORTH: Properties to the north are developed with single-family dwell i ngs; zoned R-l SOUTH: Properties to the south are developed with a neighborhood shopping center; zoned C-2 EAST: Properties to the east are developed with single-family dwellings; zoned R-l WEST: Properties to the west are developed with single-family dwellings; zoned R-l GENERAL PLAN DESIGNATION: Single-family residential (0-6 du/ac) HISTORY The church was constructed in 1945. At that time a church was a permitted use in an R-2 zone. In 1957 the classrooms and meeting room were added. The new sanctuary was constructed in 1961 and in 1966 the garage and storage area were completed. According to the applicant, a half-day nursery school has operated on the premi ses in the past. . . . PROPO SAL The applicants are proposing to utilize the existing 1,100 sq. ft. classroom building located on the southwest portion of the site for the operation of a daytime child care center. This single-story building contains two classrooms; one classroom contains 605 sq. ft., the other contains 275 sq. ft. Two children's restrooms, an adult restroom and closets occupy the renaining portion of the building. The hours of operation will be Monday through Friday between 6:30 a.m. and 6:00 p.m. The pre-school will be for children two to six years old. The applicant has advised that there will be a maximum of 24 to 26 children. Section 9275.3.3 of the Arcadia Municipal Code requires a minimum of 35 sq. ft. of indoor play area for each child. Based on the size of the existing classrooms, 25 children would be allowed. There are two play yards; the southerly play yard adjacent to the neighborhood shopping center is a grass area enclosed on the south by a 6' high wall and the renainder of the area is enclosed with a 5' high chain link fence. The northerly play yard is paved and enclosed with a 3' high open wood fence. The code requi res that the outside play yard be surrounded by a 6' high masonry wall. A pool is located east of the classroom. During an inspection by the Building Department staff, the following violations were noted at the pool area: 1. The chain li nk fence at the northwest corner of the pool area is less than the requi red 4' -0" in he i ght. 2. The gates are not self-closing or self-latching. 3. There are no signs on the gates noting "pool area - keep this gate closed". 4. The dual receptacle in the pool/patio area is not grounded or GFI protected. S. The pumps should meet current 1978 NEC standards. According to a notice posted in the patio area, church members pay an annual fee to use the pool. The sign also notes that there is no supervision on the premises. The paved parking area would provide adequate the pre-school. ANALYSIS A chi1d-care center/pre-school is allowed in the R-2 zone with an approved conditional use pennit. It is staff's opinion that the Arcadia Congregational Church is an appropriate site for this proposed use. Staff is concerned, however, with (1) the 3' high fence surrounding the paved play yard area. Because this play area is adjacent to the parking lot and the pool area is within a short distance of this area, staff would recommend that a minimum 5' high chain link fence be installed to replace the existing 3' high wood fence, and (2) because of the close proximity of the pool to the classroom areas, the pool could be a safety problem if not properly gated and fenced. It is staff's recommendat ion that prior to the opening of the pre-school, that the pool violations be corrected. Also, the parking area should be cleaned of all weeds. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDAT ION The Planning Department recommends approval of C.U.P. 85-10 subject to the following conditions: 1. That the maximum occupancy for the pre-school shall be 25 children. 2. That a 5' high fence shall be constructed around the paved play yard and a modification be granted for said fence in lieu of a 6' high wall. 3. That a modification be granted for the 5' high chain link fence in lieu of a 6' high wall which surrounds the existing grass play yard. 4. That the parking area be cleaned of all weeds and maintained in a neat and order1y manner. S. FINDINGS AND MOTIONS Approva 1 If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the envi roranent and di rect staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission) . Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
