PLANNING COMMISSION RESOLUTION 1291 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 85-8 TO ALLOW THE OUTSIDE STORAGE OF NEW VEHICLES AT 52 NORTH THIRD AVENUE WHEREAS, on May 14, 1985, an application was filed by Becherer Buick. Inc. to allow the outside storage of new vehicles. Planning Department Case No. C.U.P. 85-8, on property commonly known as 52 North Third Avenue, more particularly described as follows: Lot 27, Tract 6860, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 78. Page 75, in the Office of said County Recorder. WHEREAS, a public hearing was held on June 11, 1985, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW. THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Condit ional Use Pennit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. S. That the granting of such Conditional Use Pennit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Ie . . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to allow the outside storage of new vehicles upon the following conditions: 1. That a 6' high fence shall be constructed along the westerly property line (Thi rd Avenue frontage) and the portion of the fence along the southerly property line shall tie into the 6' high wall. Said fence shall have screening subject to the approval of the Planning Department. 2. That C.U.P. 85-8 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 3. Noncompliance with the provisions and conditions of this Conditional Use Pennit shall constitute grounds for the immedi ate suspension or revocation of said Pennit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 11, 1985 and the following vote: AYES: NOES: ABSENT: ABSTAIN: Section S. and shall cause a Arcadi a. On May 7, 1985, the City Council approved leasing of the property to Becherer Buick for the purpose of storing new automobiles on the site. This approval was subject to the conditions that Becherer Buick obtain an approved conditional use pennit and that they agree to the conditions of approval set forth in the conditional use pennit such as fencing and screening. Becherer Buick has entered into a lease agreanent which became effective June 1, 1985. Thi s lease is on a month to month basi s. (. . ~ PROPOSAL AND ANALYSIS The applicant is proposing to store new cars on the property. A chain link fence is presently located along the northerly property line. A 6' high wall is located along the easterly property line and extends along a portion of the southerly property line, reducing to 3' in height as it approaches Third Avenue. The applicant is proposing to place a chain link fence with a 10' gate along the front of the property and construct a 6' high chain link fence along the southerly property line which will tie into the 6' high wall. Automobiles will be parked on the dirt surface. This proposal has been reviewed by the Redevelopment Agency staff. They have noted that the fence should be "screen" type (e.g. slats) or have adequate landscaping which will screen the automobiles. Also the fencing on the south side should tie into the existing 6' high wall. The City requires that all automobiles be parked on a paved surface. However, because the use of this property for automobile storage is a temporary use and is leased on a month by month basis, staff recommends that this requirement be waived. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 85-S subject to the following conditions: 1. That a 6' high fence shall be constructed along the westerly property line (Third Avenue frontage) and the portion of the fence along the southerly property 1 i ne shall tie into the 6' high wall. " FINDINGS AND MOTIONS Ap pr ova 1 If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project wi 11 not have a significant effect on the envi ronment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modIfIed by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
