PLANNING COMMISSION RESOLUTION NO, 1369
A RESOLUTION GRANTING CONOITIONAl USE PERMIT 88-006 TO
CONSTRUCT A NEW SERVICE STATION AT 679 WEST DUARTE ROAD.
WHEREAS, on March 30, 1988 an application was filed by Mobil Oil
Corporation to construct a new service station, Planning Department Case No.
C.U.P. 88-006, on property commonly known as 679 West Duarte Road, more
particulary described as follows:
SEE EXHIBIT "A"
WHEREAS, a public hearing was held on April 26, 1988, at which time all
interested persons were 9iven full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOllOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, 10adin9,
landscapin9 and other features are adequate to adjust said use with the land and
uses in the nei9hborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the 9ranting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.

Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to construct a new service station, upon the following
conditions:
1. That the conditions as outlined in the report from the Department
of Public Works shall be complied with to the satisfaction of the Director of
Public Works.
A. Submit grading and drainage plan prepared by a registered
civil engineer subject to the approval of the Director of
Public Works.
B. Plant parkway trees at locations determined by the Director of
Public Works per City of Arcadia Standard S-13.
C. Close existing driveways not to be used and reconstruct curb,
gutter and sidewalk to match existing.
D. Remove and replace deficient or damaged curb, gutter or
sidewalk to City Engineer's satisfaction.
E. Gravity drainage outlets and commercial driveway aprons shall
be constructed to conform to Drawing S-II.
F. Construct P.C.C. ramp for the handicapped per City Standard
Drawing No. S-22. Existing traffic signal pull box shall be
lowered to grade and electrical conduit in the pull box shall
be modified for adequate clearance.
NOTE: All survey monuments, centerline ties and survey
reference points shall be protected in place or re-
established where disturbed. This work will be the
responsibility of the permittee and shall be at the
permittee's expense.
2. That fire safety shall be provided to the satisfaction of the Fire
Department.
3. That the twin fixture light standards located in the landscaped
areas shall not exceed a height of 15'-0" as measured from the adjacent paved
area to the top of the standard.
4. That the parking spaces shall comply with Sections 9269.7.1
(parking stall size) and 9269.8.1 (marking of spaces).

S. That the northerly planting area adjacent to the parking stalls
shall be extended into the parking stall such that the curb bordering the
landscaped area will also serve as the wheel stop for the parking stall.
6. That automobile service station shall comply with Sections 9275.4.7
of the Arcadia Municipal Code which includes in part:
A. The service station shall be equipped with a pump emergency
shut off switch located at the cashier's station.
B. All retail sales shall be limited to beverages, food, dairy
and tobacco products that are bottled, canned, packaged or
sealed. The display, sale or storage of books, periodicals,
magazines, health and beauty aids, households soaps and
cleaners and alcoholic beverages is prohibited.
C. No food, snack or beverage shall be prepared, cooked, heated
or warmed on the premises. The room used to display, sell or
store the merchandise shall not contain any cooking
facilities, i.e., oven, microwave or heating utensil.
7. All repair work shall be done inside the service bays.
8. There shall be no storage, sale, display or advertisement for sale
or lease of motor vehicles, trucks or trailers on the subject site.
9. That the pegasus emblem as illustrated in the plans be allowed on
the light between the canopy columns.
10. That C.U.P. 88-006 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
11. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of April 26, 1988 and the following
vote:

BACKGROUND
The existing service station was constructed in 1957, In 1973, the Planning
Commission granted Conditional Use Permit 73-9 to remodel the station, The
station currently sits diagonally on the lot with the service bays facing the
street. There are two pump islands; one adjacent to Duarte Road and one
adjacent to Baldwin Avenue,
PROPOSAL
The applicant is proposing to demolish the existing service station and pump
islands and construct a new three bay service station with three pump
islands, The station will be a combination self-serve and full-serve, A 200
square foot sales/snack room will be located inside the station building,
Building Information
.
The service station is proposed adjacent to the easterly property line and is
set back 25'-0" from Duarte Road, The 2,380 square foot building will be
14'-6" in height. The structure contains three service bays, a 200 square
foot sales room, an office, a storage area and male and female restrooms,
Access to the service bays will be from the northerly side of the building and
will not be visible from either Duarte Road or Baldwin Avenue,
The building facade will be grey brick veneer with white metal fascia,
There are three pump islands; each island contains two pumps with double
dispensers, A total of 12 cars can be service<! at anyone time. A 9a'-a" long
white-colore<! canopy, 16'-3" in height will cover the pump islands, The
canopy will be set back 42' from Baldwin Avenue and a minimum of 12'
from Duarte Road,
A 12'-2" by a'-2" trash enclosure is proposed at the northeast corner of the
lot, The trash enclosure will be 6'-0' in height and have a grey brick veneer
to match the building facade, with metal gates painted the same color as the
brick veneer,

Parking and Landscap-ing
Twelve parking spaces are provided on tbe site; eleven of tbe spaces are
adjacent to tbe nortllerly property line and one handicap space is located
soutb of tbe building, The eleven spaces are 9'-0. in widtb by 18'-0. in
lengtb, Code requires a minimum 9'-0. by 20'-0. parking stall.
Access to tbe property Will 00 from two driveways on Duarte Road and two
driveways on Baldwin Avenue,
A 1'-0' wide landscape strip is proposed along tbe nortberly property line
adjacent to tbe parking area, A planting area is also proposed along tbe
entire lengtb of tbe easterly property line, Landscape buffers 5'-0. in Widtb
are proposed adjacent to tbe street and landscape areas are located on tbe
corner of Baldwin and Duarte and on tbe nortbwest corner of tbe property,
There are existing block walls along tbe nortb and east property line,
Signing

A 175 sq, ft. free standing sign is proposed at tbe soutbwest corner of tbe
site, This free standing sign includes tbe Mobil identification sign as well as
tbe price sign,
An II sq, ft. Mobil ID sign will be located on tbe front portion of tbe canopy,
facing Baldwin Avenue, Two 19+ sq, ft, Mobil pegasus discs are proposed on
tbe west and soutb face of tbe building and a 7+ sq, ft. Mobil Mart sign will
00 mounted on tbe west side building facia, A Mobil Service sign is proposed
on tbe nortll face of tbe building,
The applicant is also requesting tbat tbe pegasus emblem 00 allowed on tbe
light unit between tbe canopy columns,
ANALYSIS
The proposed station will 00 an appropriate improvement to tbe site and Will
significantly enhance tbe appearance of tbis corner, The layout of tbe station
provides easier access to tbe gasoline pumps and ootter on and off -site
traffic circulation, .

The required par!r.ing stall siZe is 9' x 20', The applicant's plans show 9' x 18'
parking spaces, There is adequate room on the site to accommodate 2 O' long
spaces, .
Landscaping exceeds the 5~ code requirement, however, Section 9261.5,1
requires that "where the front end of a parking stall abuts a landscaped area,
the landscaped area shall 00 extended into the parking stall such that the
curb bordering the landscaped area will also serve as the wheel stop for the
parking stall", The 1'-0" landscape planter along the north side should be
increased by 39" to accommodate the car overhang,
Signing complies with code requirements with the exception of the Pegasus
emblem on the lights between the canopy columns, Staff d~ not feel that
this emblem is inappropriate and would recommend approval of the signs as
shown,
ARCHITECTURAL DESIGN REVIEW
Concurrent with tile consideration of this conditional use permit, tile
Planning Commission may approve, conditionally approve or deny the
applicant's design concept plans,

It is staffs opinion that the applicant's proposal complies witil the intent of
the design criteria set forth in the City's Architeetural Design Review
Regulations,
Pursuant to the provisions of the ca11fornia Environmental Qual1ty Act, the
Planning Department has prepared an initial study for the proposed project,
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance, Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of C,U p, 88-006 subject to
the following conditions:

In response to your memorandum, the item(s) which this department has concern
or special knowledge of are listed below:
1. The existing parkway widths are thirteen and one-half (13,5) feet on
Baldwin Avenue and ten (lO) feet on Duarte Road.
2. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system.
This department has reviewed the subject CUP and recommends the following
conditions of approval:
