PLANNING COMMISSION RESOLUTION NO. 1368
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-008 TO
ALLOW THE EXPANSION OF THE EXISTING AUTOMOTIVE GARAGE
WITH MODIFICATIONS AT 42 WEST LIVE OAK AVENUE.
WHEREAS, on April 6, 1988 an application was filed by William Skibsted to
allow the expansion of the existing automotive garage, Planning Department Case
No. C.U.P. 88-008, on property commonly known as 42 West Live Oak Avenue, more
particulary described as follows:
Lot 1 of Tract 10898, in the City of Arcadia,
County of Los Angeles, State of California, as
per map recorded in Book 8573, Page 19 inclusive
of maps, in the office of said County Recorder.
WHEREAS, a public hearing was held on April 26, 1988, at which time all
interested persons were given full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.

Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to allow the expansion of the existing' automotive garage
with modifications, upon the following conditions:
1. That the conditions as outlined in the report from the Department
of Public Works shall be complied with to the satisfaction of the Director of
Public Works.

A. Construct curb, gutter, sidewalk and driveway aprons per City
Standards on WeIland Avenue.
B. Construct ramps for handicapped per City standard at the
southeast corner of Live Oak Avenue and WeIland Avenue.
C. Submit grading and drainage plan for approval of the Director
of Public Works.
D. If gates are installed at driveway entrances. they shall not
open over the parkway.
E. Install six inch VCP sewer lateral to property line on Welland
Avenue to service proposed building.
F. Plant parkway trees on WeIland Avenue at locations determined
by the Director of Public Works per City of Arcadia Standard
S-13.
Remove and replace deficient or damaged curb, gutter or
sidewalk on Live Oak Avenue.
Arrange with Edison Company to install street
underground circuits. Location and number of
to approval of the Director of Public Works.
2. Fire protection shall be provided to the satisfaction of the Fire
Department. This shall include upgrading hydrant 514-8 and complying with
Chapter g of the Uniform Building Code.
3. A modification shall be granted for 29 parking spaces in lieu of 34
parking spaces. This shall not constitute an approval for any change in use that
would require more than 4 parking spaces per 1,000 square feet of gross floor
area. That any modification granted for parking shall only be for the use
approved by CUP 88-008.

4. A modification shall be granted for deletion of the 5'-0" wide
landscape buffer between the parking lot and Well and Avenue. Said 5'-0" wide
landscape buffer shall be provided within the public right-of-way.
5. A modification shall be granted for 490 square feet (3%) of
landscaping in lieu of 820 square feet (5%) within the parking lot.
6. All work for the automotive garage shall be done inside the
building. That the carport shall not be used for automotive repair work.
7. No vehicles shall be parked on the premises and offered for sale,
lease or rent.
8. The subject site shall be maintained as per the plans on file in
the Planning Department.
9. The wall along the westerly property line (WeIland Avenue) shall be
a solid 6'-0" high decorative masonry wall except when adjacent to a driveway
open wrought iron fence shall be used. The design, materials and color of said
wall shall be subject to the approval of the Planning Department.
10. That C.U.P. 88-008 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
11. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of April 26, 1988 and the following
vote:

HISTORY
On June 14, 1983 the Planning Commission voted 4 to 0 with 3 members
absent to approve CUP 83-12, a request to expand the existing automotive
garage by 4,195.62 square feet at 42 West Live Oak Avenue. The applicant,
Bill Skibsted, appealed the Commission's decision. The following
modifications ~re granted by the Commission:
A. 25 parking spaces in lieu of 32.

100 square feet of landscaping in lieu of 300 square feet within
the parking lot.
C. 5' -0' wide landscape buffer in lieu of 5'-3' in width be~n
the parking lot and We11and Avenue.
B.
D. 5'- 3" rear yard setback in lieu of 20'-0'.
On July 19, 1983 the City Council voted 5 to 0 approving the appeal which
included a revised plan that relocated the 5'-0' wide landscape buffer along
Welland Avenue from within the lot to the pUblic right-of-way. The
following modifications ~e granted by the Council:

provided within the public right-of-way.

PROPOSAL AND ANALYSIS
The applicant proposes to expand Ute eXisting automotive garage by adding
3,734.59 square feet to the garage, an 1,074.48 square foot two-story office
and a carport. This plan is similar to the proposal approved by CUP 83-12,
except for the office and carport. To accommodate the office the size of the
garage has been reduced.
PresenUy the site has 4 striped parking spaces, minimal landscaping and no
improvements in the rear half of the lot except for some paving. The new
improvements will include 29 parking spaces, a 6'-0" high wall with wrought
iron enclosing the garage, a trash enclosure and additional landscaping.

The office will be two-story 22'-0" in heightWbile the garage will be single-
story 16'-0" in heigbl The buildings will be architecturally tied together by
the use of similar materials, colors and a stucco fascia.
Developments in the C-M zone are required to have parking per the
commercial standards. Following is a breakdown of the required parking for
the uses on the site:

Since Weiland Avenue is residential beyond Ule subject site, Ule Public
Works Department has no objection to a 5' -0" wide sidewalk witll Ule
remainder of the right-of -way being used for landscaping.
It is Ute Planning Department's opinion that the modifications are
appropriate for tlle proposal and that Ute development is appropriate for Ute
site.
Pursuant to tlle provisions of the California Environmental Quality Act, Ule
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of Ute physical conditions within the area affected by
tlle project including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
ARCHITECTURAL DESIGN REVIEW
Concurrent wiUt the consideration of this conditional use permit, tlle
Planning Commission may approve, conditionally approve or deny the
applicant's design concept plans.

Staff believes that the applicant's proposal complies with the intent of the
design criteria set forth in the City'S Architectural Design Review Regulations.
The design elements (materials, colors and fascia) of the building provide Ute
necessary visual break up of the walls. The design and materials used for
Ute project Will be harmonious with the surrounding developments.
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit
88-008 subject to the following conditions:
1.
Conditions as ouUined in the attached report from the
Department of Public Works shall be complied with the
satisfaction of the Director of Public Works.
2.
Fire protection shall be provided to the satisfaction of the Fire
Department This shall include upgrading hydrant 514-8 and
complying with Chapter 9 of the Uniform Building Code.

FINDINGS AND MOTIONS

Ap-p-roval
If Ule Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration, find
that Ute project will not have a significant effect on the environment and
find that the design concept plans are in compliance wiUl the ADR criteria.
Also, direct staff to prepare Ute appropriate resolution incorporating Ule
specific findings and conditions of approval set forUl in the staff report or as
modified by Ute Commission.
Denial
If Ule Planning Commission intends to take action to deny this project, the
Commission should make specific findings based on the evidence presented, and
move to deny Ule project. Also, Ute Commission should direct staff to prepare an
appropriate resolution incorporating the Commission's decision and finditlgs in
support of that decision. The Planning Commission may wish to consider the
following motions and findings Which must be expanded upon with specific reasons
for denial:

In response to your memorandum, the item(s) which this department has concern
or special knowledge of are listed below:
1. The existing parkway widths are ten (10) feet on We11and Avenue and twelve
(12) feet on Live Oak Avenue.
This department has reviewed the subject CUP and recommends the following
conditions of approval:
Construct curb, gutter, sidewalk and driveway aprons per City Standards on

1. The project is located on the southeast corner of Live Oak Avenue
and WeIland. It is surrounded by commercial property on the east,
west, and north. On the south side is residential. All surrounding
land is level and flat. Fronting on live Oak is a small Foto Mat
stand and paved parking lot. South of the parking lot is an existing
two thousand square foot block building. The remainder of the lot
is 50% paved and 50% vacant land.
2. In the north parking area we will construct a thousand square foot
attached office building. On the south of the existing block building
we will attach an approximate thirty-seven hundred square foot block
building and pave and landscape the remainder of the lot.

west is the Superior Concrete Block Company. To the north is a com-
mercial retail shopping center. To the south is a residential apart-
ment building.
