PLANNING COMMISSION RESOLUTION NO. 1365 A RESOLUTION GRANTING MC 88-014, DENYING AN APPEAL OF THE MODIFICATION COMMITTEE'S APPROVAL OF AN ATTACHED PATIO STRUCTUR E WITH A 10' -0" REAR SETBACK OF THE SUPPORT POSTS, AND OVERHANGS TO MAINTAIN A 7' -0" CLEARANCE FROM THE REAR PROPERTY LINE AT 1619 OAKHAVEN DRIVE. WHEREAS, on March I, 1988 an application was filed by Mr. Wallace Qua appealing the Modification Committee's approval of an attached patio structure with a 10' -0" rear setback of the support posts, and overhangs to maintain a 7 '- 0" clearance from the rear property line, Planning Department Case No. MC 88-014, on property commonly known as 1619 Oakhaven Drive, more particulary described as follows: Lot 8 of Tract 29867, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 291, Pages 35-36 inclusive of Maps, in the office of said County Recorder. WHEREAS, a public hearing was held on April 26, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of MC 88-014 will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vi ci nity. 2. Approval of MC 88-014 would secure an appropriate improvement. 3. The appearance of the attached patio structure with a 10' -0" rear setback of the support posts, and overhangs which shall maintain a 7'-0" clearance from the rear property line will be compatible with the neighborhood. 4. That the granting of MC 88-014 will not adversely affect the comprehensive General Plan. 5. That the use applied for will not have a substantial adverse impact on the environment. . . . Section 3. That for the foregoing reasons this Commission denies the appeal of the Modification Committee's approval of an attached patio structure with the following conditions: 1. The attached patio structure shall maintain a 10'-0" rear setback of the support posts, and overhangs shall maintain a 7'-0" clearance from the rear property line, 2. The attached patio structure shall not interfere with the accessibility of the Sanitary Sewer Easement and that any such existing interference shall be remedi ed at the property owner's expense. 3. That MC 88-014 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of April 26, 1988 and the following vote: AYES: Commissioners Amato, Clark, Papay, Szany NOES: None A8SENT: Commissioner Hedlund Section 5. Approximalely 9,350 square feel (0.21 acre) 94.66 feel along Oakhaven Drive LOT AREA: FRONT AGE: EXISTING LAND USE & ZONING; The subject site is deyeloped wilh a I-slory, single family dwelling with an attached 3-car garage; zoning is R-l 7,500. GENERAL PLAN DESIGNATION: SF-4, Single-family residential (4 d.u.lacre). SURROUNDING LAND USE & ZONING; . The surrounding properties are all developed with single femily residences. The erea is zoned R-l 7,500. . BACKGROUND The Mod1ficatlon Committee (Clark, Bocian and Woolard) at a publlc hearing on February 23, 19BB, acted to amend and approve request number MC B6-014 to allow an attached patio structure with a 10'-0. rear setback of the support posts, and for any overhang to be a minimum 5'-0" clear of the rear property line. This approval is subject to the condition that the subject structure shall not interfere with the accessibllity of the Sanitary Sewer Easement and that any such existing interference shall be remedied at the property owner's expense. The Modification Committee's decision Is being appealed by the owner of an adjacent property to the rear. His position and arguments are stated in the attached presentation. Findings Of Public Hearing MC 66-0 I 4 . The applicant was cited by Code Enforcement for construction of the patio cover without a building permit. The modification is necessary because any portion of the main dwelling, or any structure attached to it, requires a 25'-0" setback from the rear property line. The applicant explained that he wished to locate the support posts 5'-0" from the rear propertllllne and that there would be no overhang. He also presented letters of approyal from four (4) neighbors (6I1t1Ch8t1) The PUblic Works Department confirmed that a 10'-0" wide sanitary sewer easement is located along the rear of the subject property and that no struc- ture should be placed upon It. The Committee did not consider the request unreasonable since the proposal Is an open patio cover and a detached accessory building could be located only 3'-0" from the rear property \lne. The Committee, however, cannot approve construc- tion upon the easement and, therefore, determined that approval of Me 66-014 for a 10'-0" rear setback would secure an appropriate improvement. . It is not acceptable. Reducing the code requirement or 25 feet to 5 feet is incon- ceivable, especially as no significant purpose is served. . Code standards were carefully designed to prevent haphazard development of the city. They should be followed unless public need for variance can be clearly established. Disregard of these code requirements can only serve to degrade quality of the city and neighborhood. There can be no justification of one party infringing on the rights of others, especially by whim or without inquiring of the city and affected individuals. There is no visible pUblic benefit for this variance approval. To the contrary, there are very good reasons for denial-- respect for the code ,and 'community we~l-being ~itft~t prive- lidge for a few. The structure is unsightly and impinges on treasured views of our mountains too. As built, it is less than 2 feet from the property line. Attempting to force the physical structure on others--without either notice, discussion, or complying with the code intent, is simply far beyond what can be reasonably accepted. OBSERVATIONS Code for R-1 zone requires a 25' setback from adjacent rear property lines. Reference Code Sec. 9252.2, Lines 13-16. * ~he requested variance approval is wholly inconsistent with surrounding properites. Structure was built without permit and stopped only upon neighbors inquiry. Structure as built is less than two feet from property line. No discussion is known to have occurred with neighbors or city before commencing construction. As-built structure utilizes virtually all of the setbach space, approximately 25 of 27 feet of yard. Earth fill of 2 feet in back yard raises structure accordingly, making it more visible still, especially with proposed neglible setback. 8. Question--Was building permit obtained for first expansion? 9. Non-compliance can negatively affect surrounding propery values. 10. Code Section 9252 REAR YARD states that "There shall be a rear yard of not less than twenty-five (25) feet (7.62 meters)." 11. Natural grade in this part of the city makes this structure more visible than evident on area plat. Non-complying construction of a widely unapproved construction in an R-1 zone without permit has been essentially finished framing. It is in total violation of the Coce rear setback re- quirements of 25 feet at 1-1/2 feet. It is also unsightly, and blocks valued view of the mountains. Enlarging one house so close to others is unreasonable. The Arcadia buildina code should be followed to retain a yard of reasonable size and seoaration from neiahbors, This will also better maintain orooerty values for all of us in the area, not a small concern.
