PLANNING COMMISSION RESOLUTION NO. 1363
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-005 TO
OPERATE A CHURCH AT 330 EAST DUARTE ROAD.
WHEREAS, on January 29, 1988 an application was filed by Wesleyan
Holiness Community Chapel Church to operate a church, Planning Department Case
No. C.U.P. 88-005, on property commonly known as 330 East Duarte Road, more
particulary described as follows:

WHEREAS, public hearings were held on February 23, and March 8, 1988, at
which time all interested persons were given full opportunity to be heard and to
present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.
4, That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.
~ Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate a church upon the following conditions:
1. That the conditions as outlined in the report from the Department
of Public Works shall be complied with to the satisfaction of the Director of
Public Works.
Future parking area shall drain to 4th Avenue and not to
adjacent properties.
Construct P.C.C. sidewalks, as per City standard.
Remove and replace deficient or damaged curb, gutter or
sidewalk.
Construct P.C.C. driveway apron according to Arcadia Standard
Drawing No. S-ll.
Construct P.C.C. ramp for the handicapped per City of Arcadia
Standard Drawing No. 5-22.
Arrange for underground utility service and dedicate easements
to utility companies.
All survey monuments, centerline ties and survey
reference points shall be protected in place or re-
established where disturbed. This work will be the
responsibility of the permittee and shall be at the
permittee's expense.
2. The exact location of the sidewalks and the tree removal along
Fourth Avenue shall be submitted to the City Engineer for review and approval
prior to construction.
3. That all the structures on the property be brought into compliance
with all building code requirements, including handicap requirements, electrical,
plumbing, heating, insulation, occupancy separation, etc. That permits shall be
obtained for the roofs and the siding.
4. That a total of 14 parking spaces be provided on the site; 12 open
parking spaces shall be provided as per section 9269 of the Arcadia Municipal
Code and two covered parking.
5. A landscape and irrigation plan shall be submitted to the Planning
Department for its review and approval.
6. That the trailer shall be removed.

~ 7. That a structural engineer shall prepare a study to determine if
the existing one-story home can be remodeled to accommodate a second-story
addition.
8. That fire safety shall be provided to the satisfaction of the Fire
Department.
9. That a sewer study shall be performed on the sanctuary building to
determine if it is hooked up to the sewer. If said study indicates that the
sewer is not connected, said connection shall be completed prior to occupancy of
the building.
10. That occupancy shall be limited to 56 persons at anyone time.
11. That the parking area adjacent to Duarte Road shall be paved with
grass-crete or other similar material. Said material and design of the parking
area shall be sumbitted to the Planning Department for review and approval prior
to installation. The Planning Department shall have the discretion to waive this
condition, if it is not feasible.
12. That the sanctuary may be used when all building code deficiencies
are completed to the satisfaction of the Building Deparmtent and fire safety is
~ provided to the satisfaction of the Fire Department. All other improvements with
the exception of the construction of the parsonage must be completed within one
year after the adoption of the resolution.
13. That C.U.P. 88-005 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
14. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of March 8, 1988 and the following
vote:

~ Section 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of

GENERAL PLAN DESIGNATION:
Single-family residential 0-6 du/ac
BACKGROUND
There are no building permits on file for any of the existing structures,
ho~ver, based upon information noted on subsequent permits, the existing
structures ~re all built prior to 1939. The Building Department's records
indicate that the single-family residence was hooked up to Ule se~r in
1953. The records do not indicate Utat Ute second structure (chapel) was
hooked up to Ute se~rs.
There are no records to indicate that the premises were previously used for
church purposes.

According to the County records, the First Wesleyan Holiness Church of
Pasadena purchased the subject property in January of 1987.
In December, 1987, the Fire Department made an inspection of the sUbject
property and noted that the house had been changed to a church (assembly
occupancy) and that there were several fire and building code deficiencies
Which needed to be corrected. Also, the Fire Department advised the church
that a conditional use permit was necE S S U'Y to operate a church on the
premises.
Because of the number of fire and electrical hazards at that location, the
Building Division posted "unsafe to enter" signs on the two main buildings.
Attached is a memo from the Building Division outJinlng some of the building
code deficiencies they noted on the site.
PROPOSAL
The applicant is proposing to operate a church on the subject property. The
building fronting on Duarte Road Will be utilized for a sanctuary, church
offices and resttooms. The sanctuary contains approXimately 714 square
feet Which would allow a maXimum occupancy of 102 persons. The applicant
has indicated that they bave approXimately 25 members and that the
maXimum seating capacity is for 65 members.

The single-story building fronting on Fourth Avenue is proposed to be
remodeled into a two-story parsonage.
Par1cing
currenUy Ulere is no on-site parking with the exception of a two car garage
located at the southwest corner of the property.

The applicant is proposing to provide a total of 10 parking spaces; 8 open
parking spaces and two covered parking spaces (in the garage). Based upon
a occupancy of 65 persons, 13 parking spaces are required (1 space for each
five fiXed seats).
The driveway to the parking area would be along the south side of the lot - -
with the entrance off of FourUl Avenue.
aNALYSIS
Buildings
There are a significant number of building code defidendes on Ule SUbject
site (see the attached memo from the Building Division).
The existing building to be used for the parsonage is in complete disrepair.
The ceiling and walls are missing or loose; none of the electrical complies
with code; and the foundation is not adequate to support the proposed two-
story building.
The Sanctuary building also has significant deficiencies relating to electrical,
insulation, etc. Handicap fadJities must be provided for this building.

test should be performed to determine if this building is hooked-up to Ule
se~r system.
If the parsonage remains attached by the covered porch to the sanctuary, a
one-hour occupancy separation will be required.
New siding llas been recenUy placed on portions of the "chapel" building and
new roofs have been installed on all three buildings. No permits ~re
obtained for the roofs or the new siding.
A fire alarm system will be required as ~11 as detectors installed per NFPA
regulations.
Parking
The existing driveway located on the south side of the property is broken
and in total disrepair.
.
A minimum of 13 QRtJl parking spaces should be provided for the church
(not including the garage). one of these spaces should be a handicap space.
A 5'-0" landscape buffer and 6'-0" high block wall should be provided along
the southerly property line to buffer the residential property on the south
from the proposed parking area.
A church is a permitted use in the R-l zone with an approved conditional
use permit.
There are several major Building Code deficiendes (i.e., structural, electrical)
Which do not make a more intensive occupancy appropriate.
Staff does not believe that there would be suffidenton-site parking for the
church use if such use increases to the allowable building occupancy of 102
persons.
The parking area is not buffered from the adjoining residential property.
The site, including the proposed improvements, is not adequate in siZe to
accommodate the proposed use (church, parking, parsonage, etcJ.

Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMliNDA rION
The Planning Department recommends denial of C.U P. 88-005.
If the Commission determines that this is an appropriate use the Planning
Department would recommend the fOlloWing conditions of approval:
1. That conditions as ouUined in the attached report from the
Department of Public Works shall be complied with to the satisfaction
of the Director of Public Works.

2. That all the structures on the property be brought into compliance
with all building code requirements, including handicap requirements,
electrical, plumbing, heating, insulation, occupancy separation, etc.
3. That 13 open parking spaces-"Sbal.1 be provided as per section 9269 of
Ute Arcadia Munidpal Code.
4. That a 5'-0" wide landscape buffer and 6'-0- high wall, reductng to 4'-
0" in height shall be provided betwoeen the proposed driveway and the

shall be submitted to the Pl~nnlf\g Department for its review and
approvaJ.

specific findings and conditions of approVal set forth in the staff report (or as
modified by the Commission).

In response to your memorandum, the item(s) which this department has concern
or special knowledge of are listed below:
1. The existing parkway widths are ten (10) feet on Duarte Road and twelve
(12) feet on Fourth Avenue.
2. Traffic volume will be increased, but there will be no major impact.
3. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system.
This department has reviewed the subject CUP and reconrnends the following
conditions of approval:

6A. NOISE. The use of the property for church purposes Will increase the
noise level on the property because of the noise associated with
parishioners coming to and from the property. The hours of operation
of the church Will mitigate most of the noise impacts because services
do not start unW 9:45 a.m.
7. LIGHT AND GLARE. There may be additional1ight on the property as a
result of the church activities. Ho~ver, the AMC regulates lighting in
residential areas and the applicants would be required to comply with
these standards.
6. LAND USE. The proposed church is an alteration to the existing land
use of single-family residential. Ho~ver, a church is a permitted use
in the residential zone witll an approved conditional use permit.

138. TRAFFIC. The proposed church Will generate more traffic than a
residential use. CurrenUy the church membership is limited to 25
persons, ho~ver, if the enroUtnent increases there could be a many
more cars coming to and from the site, resu1ttng in an impact to the
adjoining residential properties.
13b. PARKING. The proposed church requires a minimum of 13 parking
spaces based upon a mnlmum attendance of 65 persons. On-site
parking does not comply with code. Because this is a corner lot
persons may park on both Fourth Avenue and Duarte Road, Which
could also have an impact on the adjoining neighbors. Parking Should
comply with code to encourage on-site parking.
