A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-004 TO
ALLOW OPERATION OF AN EATING ESTABLISHMENT WITH SEATING
FOR 12 PERSONS AT 1 WEST DUARTE ROAD. UNIT A.
WHEREAS, on January 12, 1988 an application was filed by G. 8arton Payne
to allow operation of an eating establishment with seating for 12 persons,
Planning Department Case No. C.U.P. 88-004. on property commonly known as 1 West
Duarte Road, Unit A, more particulary described as follows:

WHEREAS, a public hearing was held on February 9,1988, at which time all
interested persons were given full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HERE8Y
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls. fences, parking, loading.
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.

.... 4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to allow operation of an eating establishment with seating
for 12 persons upon the following conditions:
1. The number of seats shall be limited to a maximum of twelve.
2. A modification shall be granted for 55 parking spaces in lieu of 64
parking spaces. This approval shall not constitute an approval for a reduction
in parking for the entire retail center. Rather, this parking modification shall
only be for the eating establishment approved by C.U.P. 88-004.
3. Fire protection shall be provided to the satisfaction of the Fire
Department.
4. That the subject site shall be maintained as per the plans on file
in the Planning Department.
5. That C.U.P. 88-004 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
6. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of February 9, 1988 and the following
vote:

PROPOSAL AND ANALYSIS
The proposed business will occupy 1,152 square feet (12 .5lt) of a 9,186
square foot retail shopping center. Primarily the business will be for take-
out fOOd, however the applicant would like to have 6 tables with seating for
12 persons, A take-out food business is permitted without a conditional use
permit. By adding tables with chairs the business changes from a retail
activity to an eating establishment which requires a conditional use permit.
When the retail shopping center was developed 55 parking spaces were
provi<1ed in lieu of 46 spaces required, An eating establishment requires 20
parking spaces per 1,000 square feet of gross floor area, A 1,152 square foot
eating establishment requires 23 parking spaces, Due to the difference in
required parking, the proposed eating establishment increases the required
parking for the entire center to 64 spaces,
It is staff's opinion that by limiting the seating, this eating establishment
would not be detrimental to the site or the surrounding properties. The
parking impacts from this one eating establishment with 12 seats within this
shopping center is by itself not significant,

The Planning Department is concerned with the potential increase in traffic
which may result from certain retail uses which may locate on this site, Uses
such as eating establishments and restaurants require conditional use
permits and traffic issues can be addressed as part of the consideration of
such applications, Other uses such as convenience stores do not require
conditional use permits and would be permitted even though they generally
are associated with increased vehicular traffic, At this time we do not know
all of the intended uses for this shopping center, While we are
recommending approval of this particular conditional use permit, we believe
that before any other uses for eating establishments, restaurants or other
uses Which require a conditional use permit are considered for this shopping
center, a traffic study prepared by a licensed engineer be submitted along
with the conditional use permit application, Such traffic study would
examine the cumulative impacts from all planned or anticipated uses,

Pursuant to the provisions of Ute California Environmental Quality Act, Ute
Planning Department has prepared an initial study for the proposed project,
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of Ute physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise

and objects of historical or aesthetic significance, Therefore, a Negative
Declaration has been prepared for this project,
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit
1}8-004 subject to the following conditions:
1. The number of seats shall be limited to a maximum of twelve,
