PLANNING COMMISSION RESOLUTION NO. 1360
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-23 TO
EXPAND THE ENROLLMENT OF THE EXISTING SCHOOL FROM
200 TO 400 STUDENTS AT 758 WEST ANOAKIA LANE.
WHEREAS, on November 30, 1987 an application was filed by Anoakia School
to expand the enrollment of the existing school from 200 to 400 students,
Planning Department Case No. C.U.P. 87-23, on property commonly known as 758 W.
Anoakia Lane, more particulary described as follows:
Portions of Rancho Santa Anita, Portion of Lot 3
Tract 948, in the City of Arcadia, County of
Los Angeles, State of California, as per map
recorded in Book 17, Page 21, of maps in
the office of said County Recorder.
WHEREAS, a public hearings were held on January 26, and February 9, 1988,
at which time all interested persons were given full opportunity to be heard and
to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
~ 6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to expand the enrollment of the existing school from 200
to 400 students upon the following conditions:
1. Conditions as outlined in the attached report dated January 22,
1988 from the rire Department shall be complied with to the satisfaction of the
Fire Chief by March 1, 1988.
2. A plan shall be submitted to the Public Works Department showin9
how traffic congestion would be minimized. Said plan shall be subject to the
approval of the Director of Public Works.
3. All landscaped areas between the property line walls and the public
right-of-ways (Foothill Blvd., Baldwin Avenue and Anoakia Lane) shall be
maintained. Landscaping may be lawn, ground cover, shrubs or trees. This shall
be subject to the review and approval of the Planning Department.
4. The existing dirt parking lots shall be permitted if dust is
controlled and fire lanes are not blocked. If this is not possible, the
~ applicant should either cover the parking lots with gravel or pave said lots.
This shall be subject to the approval of the Planning Department.
5. The combined enrollment of the nursery, kindergarten and elementary
schools (grades 1 to 8) shall not exceed 400 students.
6. No new buildings shall be constructed west of the Arcadia Wash
(storm drain easement).
7. Elementary school classes (grades 1 to 8) shall be conducted east
of the Arcadia Wash (storm drain easement).
8. Ingress or egress shall be prohibited either vehicular or
pedestrian from any driveway, gate or opening onto Anoakia Lane.
g. That screen planting consisting of shrubs and/or trees shall be
maintained along the westerly property line in order to absorb any objectionable
noises emanating from the school or the parking lot.
10. That the westerly 50' of the subject property shall be a buffer
zone and shall not be used for parking, outdoor activities, picnicking or any
other purpose.

~ 11. The nursery school shall maintain a minimum of 75 square feet of
outdoor play area and 35 square feet of indoor area for each child.
12. No expansion of existing uses, services or buildings shall be
permitted unless a conditional use permit is filed and approved for the proposed
expansion.
13. The Building Division shall inspect the property and identify
buildings which are unreinforced masonry and buildings which are suspected to be
unreinforced masonry. A report shall be sent to the applicant and property owner
and within 45 days after receipt of said report, the applicant or property owner
shall provide to the City of Arcadia Building Division a seismic evaluation
report (testing guidelines per City of Los Angeles Building Code Chapter 88
Earthquake Hazard Reduction in Existing Buildings) prepared by a civil or
structural engineer or architect licensed by the State of California for any
unreinforced masonry building which is used or proposed to be used for classrooms
or other use by students. Said seismic evaluation report shall be subject to the
approval of the Chief Building Official. The use or occupancy by students of any
building identified in said report to consist of unreinforced masonry
~ construction which does not meet the requirements of Chapter 88 shall immediately
be terminated. Said buildings shall be posted as being unsafe for occupancy.
14. Before an unreinforced masonry building can be used by students it
shall be modified an/or strengthened to meet the requirements of Chapter 88.
15. The vacant building at the northwest corner of the lots shall only
be used as a single-family dwelling as defined by Arcadia Municipal Code Sections
9220.20, 9220.21 and 9220.25. A minimum 4'-0" high fence shall surround said
building by February 24, 1988. Said fence shall be located at least 25'-0" from
any wall of the building. If it is shown to the satisfaction of the Chief
Building Official that the building does not consist of unreinforced masonry or
if the building is repaired or demolished, the fence may be removed.
16. The pool house shall be surrounded by a minimum 4'-0" high fence by
February 24, 1988. Location of said fence shall be subject to the approval of
the Planning Department. If it is shown to the satisfaction of the Chief
Building Official that the pool house does not consist of unreinforced masonry or
if the pool house is repaired or demolished, the fence may be removed.

~ 17. The pool fence shall be repaired in compliance with the City's
building code by February 17, 1988.
18. The pond shall be fenced or drained by February 17, 1988. If a
fence is used it shall be 4'-0" in height and subject to the City's building
code.

19. That the pergola identifed as P3 on the revised site plan dated
February 4, 1988, shall be demolished, repaired or fenced off by February 17,
1988.
20. That the pergola identified at PIon the revised site plan dated
February 4, 1988 shall be repaired, demolished or fenced off by March 15, 1988.
2!. By March 15, 1988 the appl i cant shall provide scal ed and
dimensioned floor plans of each building on the site which is being used or
proposed to be used by the students. Each floor plan shall identify the proposed
use and occupancy.
22. The Fire Department and Building Division shall evaluate each
building on the site to determine its use and occupancy. The applicant shall
repair, vacate, demolish or bring said buildings into a use and occupancy in
compliance with the Building Division and Fire Department. Said work shall be
completed within 30 days after receipt of a correction notice from the Fire
Department or Building Divsion.
23. If a bUilding code variance is approved by the City Council, the
use of temporary trailers shall be permitted. The use and location of said
trailers shall be subject to the approval of the City Council. Said trailers
shall not be used for more than one year.
24. The subject site shall be maintained as per the plans on file in
the Planning Department.
25. That C.U.P. 87-23 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
26. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.

~ Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of February 9. 1988 and the following
vote:

The following is a list of
AnoakiR School under a new CUP.
all current code requirements.
Fire Department requirements for
Anv new construction must meet
1 . Provide a minimum of 20 square feet of classroom space
for each grade school student.
2.
Provide a minimum of 35 square feet of open floor space
in each classroom for each pre-school student.
3. The existing roadway serving as fire department
accessway does not meet the 20 foot minimum
requirement of the Uniform Fire Code and the State Fire
Code. The existing roadway will be acceptalbe with "No
Parking Fire Access Way" signs provided as follows.
Signs shall be posted every 100 feet along the
accessway alternating from side to side.
There shall be no more than 200 feet between signs
on one side of the accessway. No portion of the
accessway shall be more than 100 feet from a
legible "fire accessway no parking sign".
4. Classrooms shall be limited in the main building to the
northeast and northwest corner of the main floor as now
used and one classroom on the lower level southwest
corner of the buidling.
One hour fire resistive occupancy separation is
required between any classroom and any other use except
assembly use per Table 'i-B of the Uniform Building

Code. This applies if the areas not used as classrooms
are used for any other purpose. ie. Storage, Offices
etc.. .
Exceptible alternatives to the one hour fire resitive
separation are:
A. Areas not used for classrooms shall be
completely vacant and not used for any other
purpose.
R. Provide a complete automatic fire sprinkler
or detection system in all areas of the
building per section R09 of the Uniform
Building Code.
~. Recent State Law requires that all underground
flammable liquid storage tanks he tested and monitored.
Ahandoned tanks shall be removed per the Uniform Fire
Code. This applies to the storage tank and dispensing
machine in the garage area of the property.

Provide all yard hydrants with 1-1(2 inch national
standard hose threads. Additional yard hydrants may be
required. Yard hydrants or wet standpipes are required
so that all entrances to classrooms are not more than
150 feet from the nearest yard hydrant or wet
standpipe. Additional wet standpipes shall be
installed in accordance with Arcadia Fire Department
Standard. The yard standpipes are required because
there are no fire hydrants on the property. Fire
hydrants will he requirerl for any fnture development.
7. Repair and maintain the fire hose cabinets in the main
building per Suhchaptrer 5, Title 1q California
Administrative Code.
R. Maintain the premises in a fire safe condition in
accordance with all City and State fire corles and
regulations.

The Planning Commission at its January 26, 1988 meeting continued the
public hearing for C.U.P. 87-23 so that the applicant could have more time to
study the Planning Department's report. Staff has revised and added several
conditions of approval which are italicized and underlined in the report.
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit
87 -23 subject to the following conditions:

On August 17, 1954 the Los Angeles County Board of Supervisors approved
Zone Exception Case No, 1514, wtlich provided for the continuation of the
nursery school, construction of buildings for a kindergarten and grade school
(grades 1-8) and the expansion of outdoor play areas for Anoakia SChool.
The conditions of approval are set forth in the attached letter (Exhibit. A)
from the Chief Cleric. to Me, Lowry B. McCaslin dated August 18, 1954,
In August. 1975 the Anoalc.ia area was annexed to the City of Arcadia.
Because the Anoalc.ia SChool property does not have a conditional use permit
from the City of Arcadia, said school is considered to be an existing
nonconforming use.
PROPOSAL AND ANALYSrS
.
The applicant proposes to increase enrollment of the school from 200 to 400
students. The maximum enrollment was set by Los Angeles County Zone
Exception Case No, 1514, conditions of approval numbers I and 5 (Exhibit
"A "), Presently the school has an enrollment of 365 students. Any
expansion of the use or services approved by Zone Exception Case No, 1514
requires a conditional use permit.
Presently there are 3 caretalc.er residences, a vacant residence at the
northwest corner of the lot and the main residence wtlich is being used for
classrooms, offices and storage, Other structures on the lot are five buildings
used for classrooms, 4 storage buildings, a garage, vacant pool house, gazebo
and barbacue, There are tennis courts, a baslc.etball court, a multipurpose
asphalt area and a sWimming pool. Adjacent to each classroom building is a
playground and a dirt parking lot. A 5'-0" to 6'-0. high masonry block wall
completely surrounds the property,
Access to the property are from 2 driveways on Foothill Blvd., 2 driveways
on BaldWin A venue and a driveway on Anoakia Lane wtlich is not allowed to
be used (condition no. 8 of Exhibit . A.),
The spadousness of the property is more than adequate to handle the
increase of enrollment to 400 students and additional parking needed for
teachers. The loading and unloading of students will be done on site utilizing
the lot's networlc. of roads,

It is the Planning Department's opinion that the dirt parking lots woUld be
appropriate as long as dust is controlled and fire lanes are not blocked. If
this is not possible, the applicant shoUld either cover the parking lots with
gravel or pave the lots. Since the parking lots woUld be used primarily by
teachers and parents, the number of vehicles using the lots would be limited.
Also, unlike a commercial parking lot there woUld not be the constant use of
the lot, The property is completely screened from public view by the
existing masonry walls along the property lines,
Staff believes several of the original conditions of approval from Zone
Exception Case No, 1514 should be maintained or slighUy modified to protect
the adjacent residential properties. These conditions woUld be numbers 2, 4,
8, 9 and 12 of Zone Exception Case No. 1514.
Recent State legislation requires cities to identify and mitigate seismic
hazards in buildings with unreinforced masonry, The Building Division is
aware that there are some unreinforced masonry buildings on the subject
lot An inspection of the property will have to be done by the Building
Division to identify unreinforced masonry buildings and buildings wbich are
suspected to be of unreinforced masonry construction.

Seismic evaluation reports will have to be prepared by a registered engineer
for any unreinforced masonry building wbich is used or proposed to be used
for classrooms or other use by students, Before the school enrollment can
exceed 200 students, any unreinforced masonry building used for classrooms
or other student use shoUld be modified and/or strengt11ened to reduce the
risk of seismic hazard, As buildings are shown to be compliance with
relevant City codes, student enrollment coUld be allowed to increase.
The Planning Department would not be opposed to the use of temporary
trailers for up to one year to permit the school to operate during the
evaluation and repair period. The use of temporary trailers would require a
building code variance wbich requires approval by the City Council,
When comparing the approved site plan for Zone Exception Case No. 1514
with the existing improvements on the property, staff finds many
inconsistencies. Therefore, each building must be evaluated to determine if
the use of the building as indicated on the new site plan can be permitted.

. Pursuant to the provisions of the California Environmental Quality Act, the
PlatU1ing Department has prepared an initial study for the proposed project,
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions Within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance, Therefore, a Negative
Declaration has been prepared for this prOject.
RECOMMENDA TImi
The Planning Department recommends approval of Conditional Use Permit
87-23 subject to the following conditions:
I, Conditions as outlined in the attached report dated January n,
1988 from the Fire Department shall be complied With to the
satisfaction of the Fire Chief by March 1, 1988.
2, A plan shall be submitte<S to the Public Works Department
showing how traffic congestion would be minimi~. Said plan
shall be SUbject to the approval of the Director of Public Works.

pUblic right-of-ways (Foothill Blvd., Baldwin Avenue and
Anoakia Lane) shall be maintained. landsCaping may be lawn,

buffer zone and shall not be used for parking, outdoor activities,

11. The vacant building at the northwest corner of the lot shall only
be used as a single-family dwelling as defined by Arcadia
Municipal Code sections 9220.20, 9220,21 and 9220,25.
12, The nursery school shall maintain a minimum of 75 square feet
. of outdoor play area and 35 square feet of indoor area for each
child.
13- No expansion of eXisting uses, services or buildings shall be
permitted unless a conditional use permit is tiled and approved
for the proposed expansion.
14. The Building Division shall inspect the property and identify
buildings wbich are unreintorced masonry and buildings wbich
are suspected to be unreintorced masonry, A report shall be
sent to the applicant and property owner, and Within 30 days
after receipt of said report, the applicant or property owner
shall provide to the City of Arcadia Building Division a seismic
evaluation report prepared by a registered engineer for any

3. The existing roadwRv serving as fire department
accesswav does not ~eet the 20 foot minimum
requirement of the Uniform Fire Code and the State Fire
Code. The existing roadway will be acceptalhe with "No
Parking Fire Access IJay" signs provided as follows.

There shall he no more than 200 feet between sipns
on one side of the accessway. No portion of the
accessway shall he more than 100 feet from a

northeast and northwest corner of the main floor as now
used and one classroom on the lower level southwest
corner of the buidling.
One hour fire resistive occupancy separation is
required hetween any classroom and any other use except

Exceptible alternatives to the one hour fire resitive
separation are:

or detection system in all areas of the
building per section R09 of the Uniform
Ruild ing Code.

flammable liquid storage tanks hp. testerl and monitored.
Ahandoned tanks shall he removed per the Uniform Fire
Corle. This applies to the storage tank and dispensing
machine in the garage area of the property.

standard hose threads. Additional yard hydrants may he
required. '(ard hydrants or wet ,qtandpipes are required
so that all entrances to classrooms are not more than
150 feet from the nearest yard hydrant or wet

installed in accordance with Arcadia Fire Department
Standard. The yard standpipes are required because
there are no fire hydrants on the property. Fire
'wdrants will be required for any future development.
