PLANNING COMMISSION RESOLUTION NO. 1359
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-26 FOR A
MARTIAL ARTS INSTRUCTION STUDIO AT 32 EAST LIVE OAK AVENUE.
WHEREAS, on December 18, 1987 an application was filed by Thomas Anthony
Ramirez for a martial arts instruction studio, Planning Department Case No.
C.U.P. 87-26, on property commonly known as 32 E. Live Oak Avenue, more
particularly described as follows:
The easterly 20' of Lot 12, Tract 15628, in the
City of Arcadia, County of Los Angeles, State of
California, as per Map recorded in Book 354, Pages
24-25 of Maps, in the office of the said County
Recorder.
WHEREAS, a public hearing was held on January 12, 1988, at which time all
interested persons were given full opportunity to be heard and to present
eVidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.

4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for a martial arts instruction studio upon the following
condit ions:
1. That 40 shall be the maximum number of students to occupy the
subject space at anyone time.
2. That any improvements to the subject space are done to the
satisfaction of the Arcadia Fire Department.
3. That the subject site shall be maintained as per the plan on file
in the Planning Department.
4. That a modification be granted for 37 existing parking spaces in
lieu of 128 required spaces.
5. That a modification be granted for the existing landscaping in lieu
of the required 5% and trees within the parking area and 5'-0" buffers around the
park; ng area.
6. That C.U.P. 87-26 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
7. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of January 12, 1988 and the following
vote:

and shall cause a copy to be forwarded to the City Council of the City of

PROPOSAL AND ANALYSIS
The applicant is requesting a conditional use permit to operate a 1,600 square foot
martial arts instruction studio, Code requires a conditional use permit for all schools
in any zone (9275,1.35,1), The proposal states there will be a maximum of 40 students
at anyone time with the hours of operation to be 8:00 a,m. to 10:00 p,m, on Monday
through Friday, and 8:00 a,m, to 5:00 p,m, on Saturday and Sunday, The applicant is not
proposing any parking or landscaping improvements,
The subject space is part of a 12,000 squore foot strip retail center which fronts on
East Live Oak Avenue, The parking area has 0 total of 37 spaces, is located at the
rear, and is accessed by an alley, Other uses in this center are a 2,000 square foot
restaurant, a 4,800 square foot printing business, a 1,600 square foot bakery, and a
2,000 square foot retail clothing store,
The current Code requires a total of 128 parking spaces based on the proposed mix of
uses, as well as landscaping in and around the parking area. This retail center and the
adjacent uses were developed prior to annexation into the City, Staff has not observed
a parking problem in this area, A recent parking survey, conducted by Staff, resulted
in an average of 19 cars parked in the parking area and similar underutilization of the
adjacent parking areas, It is not anticipated that the proposed martial arts instruc-
'tion studio will generate an excessive parking demand in this area,

Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of
the physical conditions within the area affected by the project including land, air,
water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic
significance, Therefore, a Negative Declaration has been prepared for this project.
RECOMMENDA T I ON
The Planning Department recommends approvlIl of Conditional Use Permit No. 67-26
ond the related modificotions subject to the following conditions:
1. That 40 shall be the maximum number of students to occupy the subject space
at anyone time,
2. That any improvements to the subject space are done to the satisfaction of the
Arclldio Fire Deportment.

If the Planning Commission intends to take action to approve COnditional Use Permit
No, fl7-26, the Commission should move to approve and file the Negative Declaration and
find that the project will not have a significant effect on the environment and direct
staff to prepare the appropriate resolution incorporating the speCific findings and
conditions of approval set forth in the staff report or as modified by the Commission.
