HomeMy WebLinkAbout1358 . . . PLANNING COMMISSION RESOLUTION NO. 1358 A RESOLUTION GRANTING CONOITIONAL USE PERMIT 87-25 FOR A DIET CENTER WITH GROUP COUNSELLING AT 921 S. BALDWIN AVENUE, UNITS F & G. WHEREAS, on December 15, 1987 an application was filed by Pritikin Pro9rams, Inc. for a diet center with group counseling, Planning Department Case No. C.U.P. 87-25, on property commonly known as 921 S. Baldwin Avenue, Units F & G more particulary described as follows: SEE EXHIBIT "A" WHEREAS, a public hearing was held on January 12, 1988, at which time all interested persons were 9iven full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted ~ the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. . . ~ 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a diet center with group counseling upon the following conditions: 1. Fire safety shall be provided to the satisfaction of the Fire Chief. 2. The subject site shall be maintained as per the plans on file in the Planning Department. 3. Occupancy shall be limited to the following: ~ Time Occupance M-F 8:00 a.m.-11:DD a.m. Max. 15 people for group counseling at anyone time and max. of 4 employees. M-F 11:00 a.m.-5:3D p.m. Max. 7 people for group counseling at anyone time and max. of 4 employees. M-F 5:30 p.m.-8:00 a.m. Max. 50 people for group counseling at anyone time. Sat. & Sun No restriction Max. 50 people for group counseling at anyone time. 4. That C.U.P. 87-25 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. 1358 -2- ~ Section 4. PROPOSAL AND ANALYSIS The applicant is proposing a diet center Which will include counseling. testing and rehabilitation of individuals either one-on-one or in groups up to 15 people (see Attachment "A" for furtber explanation of business). Since the Zoning Ordinance requires a conditional use permit for aU schools, the group counseling portion of the business requires a conditional use permit. The proposed business will occupy 2,130 square feet of a 9.99a square foot retail center, There will be a 762 sq. ft. test Be rehabilitation room, 400 sq. ft. display room, waiting and reception area, offices, changing rooms, a storage room and bathrooms. Other businesses in the center include a florist, computer sales. physical therapy (Body 2200) and a take-out food business limited to seating for 12. TW'O vacant stores remain. One other conditional use permit (CUP a 7 - 19) has been approved on the subject site for a take-out eating establishment (Mama's Pizza). Seating was limited to 12 persons to mlnlmlM its impact. It is staffs opinion that if the number of persons is restricted, group counseling on the subject property would not be detrimental to the site or the surrounding properties, The Planning Department recommends the folloWing occupancy restrictions: . Day M-F Time ~pancy 8:00 am-I 1:00 am Max 15 people for group counseling at anyone time and max. of 4 employees. M-F 11:00 am-5:30 pm Max 7 people for group counseling at anyone time and max of 4 employess. M-F 5:30 pm-a:oo am Max 50 people for group counseling at anyone time. Sat. Be sun. No restriction Max 50 people for group counseling at any one time. o C.UP. a7-25 11121M Page 2 . Staff believes the most restrictive occupancy should be during the afternoon weekday hours. This is when most businesses are open and the competition for on-site and street parking is the greatest. There is a maximum number of employees to limit the number of one-on-one counseling. The Planning Department's recommended occupancy for this time period would be consistent with the retail parking requirements, for which the site was designed. A larger occupancy is being recommended during the morning weekday hours because some retail businesses are not open and said time period is not the peak business hours. The least restrictive occupancy has been recommended for the evening to early morning weekday hours and the weekends. This is when most offices are closed and retail business activity decreases. Even though the weekend is a high retail period it is also the time when many businesses in the area are closed, allowing for more off-site parking (street and parking lots). . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora. fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 87-25 subject to the following conditions: 1. Fire protection shall be provided to the satisfaction of the Fire Department. 2. The subject site shall be maintained as per the plans on file in the Planning Department. .. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit FINDINGS AND MOTIO~ ARproval If the Plllnning Commic:c:ion intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the enVironment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report or as modified by the Commission. . The Pritikin Center will operate as an irxlividual as well as group cwnseling center to help irxlividuals with weight problems, high blood pressure, heart disease ani other diet related disorders. lAJr program is designed in such a marmer that we do one-on-one testing, evaluation ard cwnselling in the daytime tnIrs ani group cwnselli~ in the evening tnIrs after 5:30 p.m. Itln:Jay thrwgh Friday ard Saturday mondng. We generally have boo to three staff members on duty at any time during the day or evening. lAJr group cwnselling sessions generally have one professional instructor to ten to fifteen program participants. Many of the participants are married couples. We have fwrd this to be the greatest success IIDtivator Decause of the spouse support factor. 1be couple ratio in the last five years has been approximately 60'%.. On rare occasions, we do have group cwnse1ling sessions during the day if there is a special demand in the rnnnrllnity for daytime activity. Urder tl'k>se circumstances, we would reduce the group she to six or seven because of the lesser demani ard the absence of the spouse support IoIhich is so important for added success. In the evening tnIrs, we feel that we would like to limited restriction on the educational portion of our program; perhaps a limit of fifty (SO) people would give us the flexibility to grow the hJslness.
