HomeMy WebLinkAbout1357 . . . PLANNING COMMISSION RESOLUTION NO. 1357 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-24 TO EXPAND THE TOTAL SEATING OF AN EXISTING EATING ESTABLISHMENT AT 845 S. BALDWIN AVENUE. WHEREAS, on December 3, 1987 an application was filed by Carlson Desi9n for Kentucky Fried Chicken to expand the total seating of an existing eating establishment. Planning Department Case No. C.U.P. 87-24, on property commonly known as 845 S. Baldwin Avenue, more particulary described as follows: Portions of Lot 22 and 23, Tract 2731, in the City of Arcadia, County of Los Angeles. State of California, as per map recorded in Book 33, Page 29, of maps in the office of said County Recorder. WHEREAS, a public hearing was held on January 12, 1988. at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking. loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. . . ~ 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. S. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to construct a building addition to expand the total seating of an existing eating establishment upon the following conditions: 1. That the number of seats shall be limited to the maximum determined through plan check but shall in no case exceed a total seating for 44 people. 2. The subject site shall be maintained as per the plans on file in the Planning Department. 3. That the existing landscaping in the front be maintained. If removal is necessitated by construction, a detailed replacement landscape plan shall be provided prior to issuance of a building permit. 4. That a modification be granted for 37 existing parking spaces in 1 i eu of 38 requi red spaces. 5. That a modification be granted for a 10'-0" wide one-way driveway at drive-thru window in lieu of required 12'-6" width. 6. That C.U.P. 87-24 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 7. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. AddItions and Alterations The lIpplicllnt is requesting II conditional use permit to expllnd an existing 26 sellt eoting establishment with a drive-thru facility, which was permitted by Conditional Use Permit 77-5 in 1977. The proposal consists of expanding the seating area by lidding a 257 square foot solarium, addition of a 50 square foot drive-thru bubble and replacement of the cupola..and mansard ridge. The solartum wm be attached to the front of the exIstIng buildIng and the Intertor remodeled. The plans as submitted show seatIng for 44 people, however, prelimInary review by the Fire Department lInd the BuildIng DIvIsIon indicate that the maxImum occupancy of the dining area should be 38 people. The applicant wi1llimit the total number of seats to that whIch is prescribed through the plan check process but the maximum will not exceed seating for 44 people. The subject eetlng establ1shment Is currently a 1,564 square foot, stand alone structure. The operation of the establ1sh- ment will not change, however, the appl1cant is citing en increase in walk-in, lunch time bUSIness and wents to provIde additIonal seetlng for the convenIence of hIS cus- tomers. The addition wm reduce the amount of IllndscllPlng In front of the bUildIng, however, the remaining setback area will be landscaped. The drive-thru bubble lIddition is being provided to improve customer service by upgrading equipment lInd providing space for a cash register lInd other related equip- ment specifically for drive-thru customers. Steff concurs thllt a 10'-0. width at the bubble will be lIdequate. The cupola and ridge are beIng replaced because they wm have to be structurally remodeled due to the addItion of the solarium. The size and eppeerance of the cupolll end ridge, however, will vIrtually be unchanged. The exIsting cupolll WllS lidded through lIn lImendment to the origInal C.U.P. In 1979 and approve I wes conditioned that it be a sol1d color to blend with the roof of the existing buildIng. The eXIsting eating establlshment was developed with a parkIng ratio of 23.36 speces per 1,000 square feet for e totel of 37 splices whIch exceeds the current requIred ratio of 20 per 1,000 squIre feet by 6 spaces. The proposed expanSIon would increllse C.U.P. 67-24 1/12/66 Pege 2 . .. . the required parting to 38 spaces. Staff has not observed, nor been contacted regard- ing any parting problems at the subject eating establishment. In contrast, the exist- ing parting exceeds the demand generated by this particular establishment and the proposed expansion should not generate an excessive demand. The existing parting area, as it was designed, complies with all current parting lot design regulations with the exception that landscaped over1lang areas are not Included, Instead wheel stops were provided as was required at the time of development. Pursuant to the provisionsof the California Environmental Quality Act, the Planning Department has prepared an Initial study for the proposed project. Said Initial stUdy did not disclose any substantial or potentially substantial adverse Change In any of the physical conditions within the area affected by the project including land, air, water, mlnentls, flont, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declanttion has been prepared for this project. ARCHITECTURAL DESIGN REVI~ The solarium will be a glass structure with a 1'-6" high brick stem wall and anodized muntins. These muntins will be provided on the existing windows to maintain consistency. The drive-thru bubble will be stucco finished with accent bands along the upper portion to match the existing building. Staff recommends that a brick pilaster be provided along the easterly end of the drive-thru bubble to maintain consistency in the elevation. The cupola and roof ridge w111 be replaced to match the existing. Optional improye- ments shown on the plllflS include new doors with logo panels and a black wall light fixture with lll'IlIler glllS8. ~ The Planning Department recommendS approval of Conditional Use Pennit No. 87-24 md the related modifications subject to the following condtttons: 1. That C.U.P.-87-24 shall not take effect untl1 the owner and applicant have executed a fonn ayaUable at the Planning Department indicating awareness and acceptance of the conditions of approval. S. If the Planning Commission Intends to take actton to approve Conditional Use Penntt No. 87-24, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approyal set forth in the staff report or as modified by the Commission.
