HomeMy WebLinkAbout1356 . PLANNING COMMISSION RESOLUTION NO. 1356 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-003 TO CONSTRUCT A RESTAURANT AT 301 EAST HUNTINGTON DRIVE. WHEREAS, on December 21, 1987 an application was filed by Souplantation, Brooke and Mack, Inc. to construct a restaurant, Planning Department Case No. C.U.P. 88-003, On property commonly known as 301 East Huntington Drive, more particularly described as follows: Parcel 4 of Parcel Map No. 18980, in the City of Arcadia, County of Los Angeles, State of California. WHEREAS, a public hearing was held on January 12, 1988, at which time all interested persOns were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: ~ Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry th~ kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the compr~hensive General Plan. . . . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to construct a restaurant upon the following conditions: 1. That the following conditions as outlined in the report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. A. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works. Provide calculations for both the gravity drainage system and the pump drainage system. Computations should show hydrology, hydraulics, elevations, and all the details requested on the City's "Pump Drainage" sheet. B. Obtain an Encroachment pemit for construction in State Highway. C. Complete all public works improvements as shown on the construction drawings prepared by Emkay Development for Parcel Map 18980 and comply with all the provisions required by CALTRANS for the State Encroachment Permit in Huntington Drive and L. A. County Public Works Department for any stom drain connections. NOTE: All survey monuments, centerline ties and survey reference points shall be protected in place or re- established where disturbed. This work will be the responsibility of the permittee and shall be at the pemittee's expense. 2. Fire safety shall be provided to the satisfaction of the Fire Chief. 3. That the number of seats for the proposed restaurant shall be subject to the review and approval of the Building Division and Fire Department. 4. That a modi fication be granted for 71 parki ng spaces in lieu of 75 parking spaces required. 1356 -2- . . . 5. That the primary color of the building shall be a neutral color compatible with the surrounding development. Said color to be submitted to the Planning Department for its review and approval. 6. That the entryway to the restaurant shall be enhanced with colored or textured paving to be approved by the Planning Department. 7. That the landscape plans shall include palm trees to provide continuity in landscaping with the existing and proposed development. 8. That an access easement and maintenance agreement be executed and recorded between the Souplantation and Derby Restaurant. 9. That C.U.P. 88-003 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 10. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 12, 1988 and the following vote: AYES: Commissioners Amato, Clark, Papay, Szany NOES: None ABSENT: Commissioner Hedlund Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. 1356 -3- . . . LOT AREA: 39,039 square feet FRONTAGE: 1~072 feet on Huntington Drive EXISTING LAND USE & ZONING: The subject property is developed with the Derby parking lot and a single-family dwelling; zoned CPD-l SURROUNDING LAND USE & ZONING: North: Vacant land; zoned CPD-l South: Vacant (Arcadia Gateway Centre site); zoned CPD-l East: Arcadia Nissan; zoned CPD-l West: Derby Restaurant; zoned CPD-l GENERAL PLAN DESIGNATION: Planned Development-I . C.UP.88-3 January 12, 1988 Page 1 . PROPOSAL Building The applicant is proposing to construct a 7,500 square foot restaurant wiUl seating for 206 people. The restaurant operation is cafeteria-style, serving soup and salad. The building will be approXimately 20'-0" in height. The stucco is proposed to be a salmon/pink color wiUl a white cornice. A red neon accent will be located at Ule bottom of Ule cornice. The base of Ule building will be white ceramic tile with a green accent tile. Green awnings will be over all the windows and Ule entryway. The service yard will be located along Ule easterly side of the building. Entrance to tlle service yard will be from Ule parking lot. A steel roll-up door will screen tlle service yard from Ule parking area. o The building will be set back 10'-0" from the Huntington Drive property line and 10'-0" to 22'-8" from tlle proposed new street. The entrance to Ule restaurant will be on the souUl side of Ule building adjacent to Huntington Drive. Parking Parking will be located norUl and west of the building. Code requires 75 parking spaces for Ule proposed restaurant. The applicant is requesting a modification for 71 parking spaces, including 14 compact spaces and two handicap spaces. One 10' by 25' loading space will be provided in front of the service yard. Access to the parking area will be from two driveways; one driveway will be located along the westerly side of the building off of Huntington DriVe; the second driveway will be from the new street located on the east side of the subject property. The westerly driveway is located on two properties; Ule Souplantation site and tlle Derby Restaurant. . C.UP.88-3 January 12, 1988 Page 2 . In order to facilitate the use of this driveway, an access easement and maintenance agreement must be exe<:uted and re<:orded between the Souplantation and Derby Restaurant. Landscap-ing The CPD-l zone requires a minimum of 10:C of the lot to be landscaped, 5:C of which must be located within the parking area. The landscaping exceeds code requirements. The proposed plan has a minimum of l2.a:c of the site landscaped and exceeds the minimum 5:C in the interior of the parking area. At least 15 trees are provided within the parking area. Additional trees are located adjacent to the building. The perimeter of the building will be landscaped. Signing . A 25'-0. high free standing sign is proposed on the west side of the building. Although a design concept is shown on Sheet 2 of the plans, the specific sign has not been designed. Wall signs are proposed on all building elevations. All signs will have to comply with zoning regulations and will be subject to design review by the Planning Department staff. SPECIAL INFORMATION A reciprocal parking license agreement has been prepared between the Derby Restaurant and the Souplantation. This agreement would allow the reciprocal use of parking by both restaurants. The agreement is renewable on a year to year basis and can be terminated by either restaurant if the parking arrangement is not satisfactory. Because the proposed restaurant is within the Redevelopment Area, the plans are subje<:t to review by the Redevelopment Agency. . C.UP. 88-3 January 12, 1988 Page 3 . ANALYSIS The restaurant is a permitted use in Ule CPD-l zone wiUl an approved conditional use permit. The design of Ule building is compatible wiUl the existing Embassy Suites Hotel and Ule proposed Hampton Inn which will be located immediately norUl of Ule subject site. However, Ule color of Ule building is inconsistent with the color selections established for downtown revitalization. Staff would recommend Ulat the building color be changed to a more neutral color consistent WiUl the colors of Ule existing Embassy Suites Hotel, the proposed Hampton Inn and the proposed Residence Inn. The Architectural Design Review Regulations note that "Ule main pedestrian entrances to buildings shall be enhanced by the use of colored and textured paving materials, which are appropriate to Ule design of the building: The plans note that the entryway fronting on Huntington Drive Will be concrete. Stat! would recommend that the textured or colored paving be used to accentuate Ule entryway. . AIUlough there is a 5.6~ deficiency in parking (71 spaces in lieu of 75 required), staff does not feel Ulat Ulis is a significant reduction. It is anticipated that some of the restaurant patrons will be staying at the nearby hotels and walk to the restaurant. All landscaping complies with code. Based upon landscape plans for the Hampton Inn and the Residence Inn, and Ule existing landscaping at Ule Embassy Suites, staff would recommend Ulat some palm trees be incorporated in the landscape plan for the proposed Souplantation. The palm trees will integrate development on the north side of Huntington Drive and provide a continuity through the use of landscape materials. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for Ule proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land. air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. . C.UP.88-3 January 12, 1988 Page of . ARCHITECTURAL DESIGN REVIEW Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or deny the applicant's design concept plans. It is staff's opinion that the applicant's proposal, with the minor changes recommended by staff; Le., changing the color of the building and enhancing the entryway area, complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. RECOMMENDATION The Planning Department recommends approval of c.u P. 88-3 subject to the fOllowing conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public works. . 2. Fire safety shall be provided to the satisfaction of the Fire Chief. 3. That C.U P. 88-3 shall not take effoct until the owner and applicant have exocuted a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 10. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDINGS AND MOTIONS Ap.p.roval . If the Planning Commission intends to take action to approve this projoct, the Commission should move to approve and file the Negative Declaration and find that the projoct will not have a significant effoct on the environment and find that the design concept plans are in compliance with the ADR criteria and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the COmmission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. The Commission may wish to consider the following findings in regards to architectural design which must be expanded upon with Specific reasons for denial: D.l Find that the location and configuration of the structures are not visually harmonious with their sites and with surrounding sites and structures, and that the structures dominate their surroundings to an extent inappropriate to their use. . D.} Find that the plans for the landscaping of open spaces do not conform to the requirements set forth in the code, and that they do not provide visually pleasing settings for structures on the site and on adjoining and nearby sites and conflict With the natural landscape. D.4. Find that the design and location of signs and their materials and colors are not consistent With the character and scale of the buildings to Wbich they are attached or Wbich are located on the same site. and that the signs are not visually harmonious With surrounding development. D-5. Find that the archite<:tural design does not enhance the visual environment of the city, preserve and prote<:t property values and mitigate against degradation and depreciation. . 0.6. Find that the proposal does not promote and protect the health. safety, comfort and general welfare of the community and does not promote the standards of appearance in the community or encourages the appropriate use of land Within the City. D.7. Find that the proposed expanses of flat building walls exceed 25 feet in Width Without providing archite<:tural indentations and/or projections so as to provide opportunity for shade, shadow, and visual relief. D.8 Find that long straight driveways and walkways are not mitigated througn curvilinear approaches, landscaping and changes in texture and/or colors. 0.9. In response to your memorandum, the item(s) which this department has concern or special knowledge of are listed below: 1. The existing parkway width is fifteen (15) feet on Huntington Drive, 2. The subject property is served by a sewer line that is tributary to a deficient City trunk sewer line. However, based on past charges paid by the property owner and considering the future charges that will be paid, in time these payments will provide the property's share of the costs necessary for taking care of downstream sewer line deficiencies. 3. Traffic volume will be increased, but there will be no major impact. This department has reviewed the subject CUP and reconunends the following conditions of approval: 1.
