HomeMy WebLinkAbout1349 . . . PLANNING COMMISSION ~~SOlUTION NO. 1349 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-21 FOR AN ADDITION TO THE EXISTING CHURCH AT 225 EAST LIVE OAK AVENUE. WHEREAS, on September 21, 1987 an application was filed by The Arcadia Community Church for an addition to the existing church, Planning Department Case No. C.U.P. 87-21, on property commonly known as 225 East Live Oak Avenue, more particularly described as follows: Lots 1 and 2 of Tract 13217, in the City of Arcadia, County. of Los Angeles as per map recorded in Book 259 Page 31 of Maps, in the office of the County Recorder of said County. WHEREAS, a public hearing was held on October 13, 1987, at which time all interested persons were 9iven full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2.. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood, 4. That the site abuts streets and highways adequate in width and pavement type to. carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. . . . 6. That the use applied for will not have a substantial on the environment. Section 3. That Conditional Use Permit conditions: adverse impact . . for the foregoing reasons this Commission grants a for an addition,to the existing church upon the following 1. Works shall 2. Conditions as outlined in the report from the Department of Public be complied with the satisfaction of the Director of Public Works. Fire protection shall be provided to 'the satisfaction of the Fire Department. 3. The existing asphalt parking lot shall be repaved with a concrete or asphaltic surface. 4. Final landscape and irrigation plan shall be subject to the approval of the Planning Department. 15 gallon trees or shurbs shall be planted along the north property line in between every other parki ng space. The parki ng lot shall contain a minimum of nine 15 gallon trees. Said landscape plan shall be required prior to issuance of building permits. 5. All parking spaces ahll comply with Sections 9269.7.1, 9269.7.3, 9269.8.1, 9269.8.3 and 9269.9.1 (size, striping and wheel stops or curbing). 6. All site improvements shall be done concurrent with the proposed addition. Final approval for said addition shall be subject to the completion of all site improvements. 7. The subject site shall be maintained as per the plans on file in the Planning Department. 8. That C.U.P. 87-21 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 9. Noncompliance with the provisions and conditions of this Conditional Use Pennit shall constitute grounds for the immediate suspension or revoc.ation of said Permit. -2- 1349 . . . Section 4. WONG, ASSOCIATE PLANNER CASE NO.: CONDITIONAL USE PERMIT 37-21 GENERAL INFORMATION APPLICANT: Arcadia Community Church LOCATION: 225 East live Oak Avenue REQUEST: Conditional Use Permit for an addition to the existing church. Existing pati9 area will be enclosed, sanctuary will not be enlarged. 45 parking spaces in lieu of 65 spaces will be provided. . LOT AREA: Approximately 34,000 square feet (.78 acre) FRONTAGE: 132 feet on live Oak Avenue 157 feet on Third Avenue EXI STING LAND USE & ZONING: The subject site is developed with a church; zoned R - 3 SURROUNDING LAND USE & ZONING: North: Single-family dwellings; zoned R-I and R-2 South: Commercial/manufacturing; zoned C-M D East: Mixed commercial; zoned C-2 D West: Mixed commercial; zoned C-I GENERAL PLAN DESIGNATION: Commercial . HISTORY . The church at 225 East Live Oak. Avenue was constructe<l in 1956 and a fellowship hall including sunday school rooms were added in 1960. BoUl of Ulese projects were constructed prior to Ule City's requirement for a conditional use permit. On February 27, 1979 Ule Planning Commission grante<l C.UP 79-2 to construct a one-story 1,143 square foot addition to Ule front of Ule churcl'l. On April 23, 1931 Ule Planning Commission granted C.UP. 61-2 for Ule operation of a school, limited to an enrollment of 40 students. SPECIAL INFORMATION Building Information: The existing buildings contain approximately 10,439 square feet and include a sanctuary, fellowship hall kitchen, library, offices, sunday school room, narUlex and nursery. Parking: .. Plans for previous conditional use permits show 50 parking spaces which do not comply wiUl code. A site inspoction by staff found Ule asphalt paving in poor condition and parking space striping badly faded. Striping for 4S to 47 spaces was barely visible. , . PROPOSAL AND ANALYSIS The applicant proposes to enclose and roof Ule existing 1,900 square foot patio, 'IoIt1ich is almost completely enclosed on all sides by Ule existing building. Part of said patio will become a foyer to Ule sancturary and ''Fellowship Patio" area. The only new elevation will be Ule west elevation, 'IoIt1ich will match Ule existing materials and colors of Ule church (wood shingles and tan stucco). The parking lot will be repaved, striped to comply wiUl code, 'IoIt1eel stops or curbing added, additional landscaping will be provided and stamped concrete at Ule driveway entrances. Also, Ule entry to Ule foyer will be concrete wiUl brick pavers. . C.UP, 67.2 I 10/13/67 Page 2 . Since the S3llctuary will not 00 enlarged, staff feels the proposed addition would not generate a significant demand for new parking even though Ul.e patio area will become more functional for churcb activities. A letter from Reverend Drell Butler states "the construction of a roof over our patio are.a is not in anyway intended to 00 used for additional church worship space: Also, the loss of 5 nonconforming parking spaces should not 00 detrimental to the site or the neighborhood. The new parking layout will have better circulation and more useable parking spaces. Due to the poor condition of the existing asphalt parking lot, the Planning Department recommends that the parking lot 00 repaved. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic sign.ificance. Therefore, a Negative Declaration has been prepared for this project. . RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 87-21 subject to the following conditions: I. Conditions as outlined in the attached report from the Department of Public Works shall 00 complied with to the satisfaction of the Director of Public Works. 2. Fire protection shall 00 provided to the satisfaction of the Fire Department. 3. The existing asphalt parking lot shall 00 repaved with a concrete of asphaltic surface. 4. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. .
