PLANNING COMMISSION RESOLUTION NO. 1348
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-20 TO
PERMIT THE RETAIL SALE OF 8EVERAGES, FOOD, DAIRY AND
TOBACCO PRODUCTS AT 5 WEST HUNTINGTON DRIVE.
WHEREAS, on August 17, 1987 an application was filed by Mr. John
Wortmann, Jr., on behalf of Wortmann Oil Co., Inc. to permit the retail sale of
beverages, food, dairy and tobacco products, Planning Department Case No. C.U.P.
87-20, on property cOOlmon1y known as 5 West Huntington Drive, more partic:u1ar1y
described as follows:
The East 100' of the South 125' of Lot 3 of
Tract No. 949, in the City of Arcadia, County
of Los Angeles as per map recorded in Book
17 Page 13 of Maps, in the office of the
County Recorder of said County.
EXCEPT the South 20' of said land conveyed
to the City of Arcadia, by deed recorded
July 10, 1947 in Book 24803 Page 28,
Official Records.
WHEREAS, a public hearing was held on October 13, 1987, at which time all
interested persons were gi ven full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Sect ion 1. That the factual data submitted by the P1 anni ng Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.

3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to permit the retail sale of beverages, food, dairy, and
tobacco products upon the following conditions:
1. Conditions as outlined in the report from the Department of Public
Works shall be complied with the satisfaction of the Director of Public \to'orks.
2. Fire protection shall be provided to the satisfaction of the Fire
Department.
3.
Following modifications shall be approved:
A. 5'-0" rear yard (north property line) in lieu of 20'-0" for
existing service station (9263.2.4).
B. Deletion of requirement for 5'-0" wide landscape planters
along the street side property lines (Santa Anita and
Huntington) except for driveway openings (9275.4.11.1).
C. 28 sq. ft. of landscaping in lieu of 150 sq. ft. at the
intersection of Santa Anita and Huntington (9275.4.11.3).
New free-standing sign (replace existing sign) to be located
within 10'-0" setback along Santa Anita Avenue (9320.65.5).
4. Final landscape and irrigation plan shall be subject to the approval
of the Planning Department. Said landscape plan shall be required prior to
issuance of bu1l di ng permits.
5. All parking spaces ahll comply with Sections 9269.7.1, 9269.7.3,
9269.8.1, 9269.8.3 and 9269.9.1 (size, striping and wheel stops or curbing).

6. All site improvements shall be done concurrent with the proposed
snack shop. Final approval for said snack shop shall be subject to the
completion of all site improvements.
7. The automobile service station shall cOOlply with Section 927!..4.7 of
the Arcadia Municipal Code which includes in part:
A. The service station shall be equipped wi ht a pump emergl!ncy
shutoff switch located at the cashier's station.
B. All retail sales shall be limited to beverages, food, d,liry,
and tobacco products that are bottled, canned, packaged or
sealed. The display, sale or storage of books, periodic:als,
magazines, health and beauty aids, household soaps and
cleaners, and alcoholic beverages is prohibited.
C. No food, snack or beverage shall be prepared, cooked, hl!ated
or wanned on the premises. The room used to di splay, sf!ll or
store the merchandise shall not contain any cooking
facilities; i.e., oven, microwave or heating utensil.
8. The Snack Shop wall signs shall be individual channel letters if
internally illuminated.
9. The subject site shall be maintained as per the plans on file in the
Planning Department.
10. That C. U. P. B7 -20 shall not take effect unt 11 the owner and ilppl i cant
have executed a fonn available at the Planning Department indicating awal'eness
and acceptance of the conditions of approval.
11. Noncompliance with the provisions and conditions of this Conditional
Use Pennit shall constitute grounds for the immediate suspension or revol:ation of
said Pennit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of October 13, 1987 and the following
vote:

PROPOSAL AND ANALYSIS
The applicant is proposing to remodel the existing office of the service
station for the retail sale of beverages, food, dairy and tobacco products.
Also. new signs are proposed, additional landscaping and restriping of
parking spaces.
Code permits service stations to sale beverages, food, dairy and tobacco
products if the station has a valid conditional use permit. The service station
was built in 1965 prior to the requirement for a conditional use permit.
The Arcadia Redevelopment Agency at its September 15, 191H meeting
approved the proposed project subject to obtaining a condtional use permit
and receiving Archite<:tural Design Review approval.

Modification requests A, B, C and E are due to the existing limitations of Ithe
property. Request A is an existing situation and the subject site's rear
property line is the adjacent lot's (25 N. Santa Anita) side property line
which does not require a setback. Compliance with request B would limit the
accessibility to botll existing gasoline pump islands, Compliance with request

C would require the closing of a portion of two driveways, presently there is
no landscaping at the intersection. The new free-standing sign will replace
the existing sign at the same location which is presently within the 10'-0"
setback along Santa Anita Avenue. Relocating the new free-standing sign
while keeping its location at the intersection would interfere with the vehicle
circulation on the property
The Planning Department is not.in favor of granting modification request D.
The property is within the Downtown RevitiliZation Area Which requires that
internally illuminated signs shall be individual channel letters. The
applicant proposes to use the existing metal frame sign cans with new plastic
faces (Snack Shop). If the existing sign cans are used they should not be
internally illuminated.
Pursuant to the provisions of the California Environmental Quality Act, tlle
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substanti.al
adverse change in any of the physical conditions within the area affecte<:l by
the project including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
. RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit
87-20 subject to the following conditions:
1. Conditions as outlined in the attached report from the
Department of Public Works shall be complied with to the
satisfaction of the Director of Public Works.
2. Fire protection shall be provided to the satisfaction of the Fire
Department.
3. Following modifications shall be approved:

immediate suspension or revocation of said Permit.

Commission should move to approve and file the Negative Declaration and
find that the project will not have a significant effect on the environment
and direct staff to prepare the appropriate resolution incorporating the
specific findings and conditions of approval set forth in the staff report or as
modified by the Commission.

If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of
that decision.

In response to your memorandum, the item(s) which this department hils concern
or special knowledge of are listed below:
1. The existing parkway widths are twelve (12) feet on Huntington and zero
(0) feet on Santa Anita Avenue.
2. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system.
The following conditions of approval are recommended:
1. A grading and drainage plan will be required if the A.C. pavement is
entirely reconstructed.
2. Provide a 15' corner cut-off (radius) in the form of an irrevocable offer
of dedication for street purposes.
3. Dedicate five (5) feet on Santa Anita Avenue for street purposes.
4. Plant parkway trees at locations determined by the Director of Public
Works per City of Arcadia Standard S-13.
5. The proposed sign may encroach the public right-of-way as follows:

ENVIRONMENTAL SETTING OF THE PROJECT SITE
The site is located on the northwest corner of Huntington Drive
and Santa Anita Avenue. Three of the four corners and adjacent
property of the crossing of these streets are being used for
commercial purposes. The southwest corner is utilized by the
County park.
PROPOSED ALTERATIONS TO THE PROJECT SITE
No site alterations are contemplated except for a minor change
in building signage and the conversion of the gas station office
to a snack shop. Two trees are also being added along the west
property lines.
THE USE AND DEVELOPMENT OF THE SURROUNDING PROPERTIES
The surrounding properties to the west and east are developed
and being used for commercial sales. The property to the
south is a portion of the Arcadia County Park. The property
to the north is developed as the Santa Anita Professional
Building.
