PLANNING COMMISSION RESOLUTION NO. 1347 A RESOLUTION GRANTING CONOITIONAL USE PERMIT 87-19 TO OPERATE AN EATING ESTABLISHMENT WITH SEATING FOR TWELVE PATRONS AT 921-H SOUTH BALDWIN AVENUE. WHEREAS, on August 17, 1987 an application was filed by Mr. Frank Arden to operate an eating establishment with seating for twelve persons, Planning Department Case No. C.U.P. 87-19, on property commonly known as 921-H South Baldwin Avenue, more particularly described as follows: SEE EXHIBIT "A" WHEREAS, a public hearing was held on September 8,1987, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . . . such Condi tional Use Permit will not adversely Plan. for will not have a substantial adverse impact 5. That for the foregoing reasons this Commission grants a Conditional Use Permit to operate an eating establishment with seating for twelve patrons upon the following conditions: 1. The number of seats shall be limited to a maximum of twelve. 2. A modification shall be granted for 50 parking spaces in lieu of 65 parking spaces. This approval shall not constitute an approval for a general reduction in parking for the total site. That this parking modification shall only be for the use approved by C.U.P. 87-19. 3. Fire protection shall be provided to the satisfaction of the Fire Department. 4. the Planning 5. The subject site shall be maintained as per the plans on file in Department. Not more than two delivery vehicles shall be permitted upon the subject site at anyone time. 6. That C.U.P. 87-19 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 7. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of September 8, 1987 and the following vote: AYES: NOES: ABS ENT : Commissioners Clark, Hedlund, Papay. Commercial PROPOSAL AND ANALYSIS The prop:>sed business will occupy 1,013 square feet of a 9,998 square f':>ot retail center. Primarily the business will be for take-outfood, however the applicant would like to have five tables with seating for 12 persons. By adding tables witll chairs the business changes from a retail activity to an eating establishment which requires a conditional use permit When tlle retail center was developed parking was provided at the ratio of 5 spaces per 1,000 square feet of gross noor area for a total of 50 spaces. Due to the difference in required park.ing. the proposed eating establishment increases the required parking for the center by 15 spaces. An eating establishment requires 20 parking spaces per 1,000 square feet of gross noor area. . A take-out food business is permitted without a conditional use permit By restricting the seating within a take-out food business the Pl~nnil'1g Department considers the parking requirement of 5 spaces per 1,000 square feet to be adequate. Seating restrictions are not placed on eating establishments that comply with the requirement of 20 spaces per 1,000' square feet. It is staff's opinion that by restrictJ.ng the seating this food establishment would not be detrimental to tlle site or the surrounding properties. The parking impacts from one eating establishment With 12 seats within this shopping center is considered minimal. The Planning Department does not believe that more than one such use should be permitted within this center without a traffic study which would address the potential cumulative impacts. Since 1982 there have been 13 conditional use permits granted for similar requests. As of this date no complaints have been received, nor has Stat! observed any problems related to these eating establishments. , . C.UP.8'7-19 9/a187 Page 2 .. .'..... .' Pursuant to tl1e proVIsions of tl1e California Environmental Quality Act, the Planning Department has prepared an initial study for tl1e proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of Ule physical conditions wiUlin Ule area affected by Ule project including land, air, '-'later, minerals, flora, fauna, ambient noise and objects of historical or aesUletic significance. Therefore, a Negative Declaration has boon prepared for this project. . RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 87-19 subject to Ule following conditions: . . 1. The number of seats shall be limited to a maximum of t~lve. 2. Denial If the Pl~nning Commission intends to take action to deny this project, Ule Commission should move to deny and direct staff to prepare an approprilate resolution incorporating the Commi!:!tion's decision and findings in support of that decision. . , .. Soccer Team Little League and Schools. The family has been in the pizza business for the past seventeen years, W~ will be using our location for Pizza Take-Out anB for here We invite you to visit our San Gabriel location that we feel has been kept very clean along with good service and our menu The Arcadia location we project the busy hour~ to be between 5:10 and ~:OO p.m., we feel that the other business's in the shopping center will not be open at this time giving adequit parking at those hours.
