PLANNING COMMISSION RESOLUTION NO. 1345
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-18 TO
OPERATE A RESTAURANT AT THE ARCADIA GATEWAY CENTRE - SOUTH
SIDE OF HUNTINGTON DRIVE BETWEEN SECOND AND FIFTH AVENUES.
WHEREAS, on August 3, 19B7 an app 1 i cat i on was fil ed by S & A Restaurant
Corporation to operate a restaurant, Planning Department Case No. C.U.P. 1l7-18,
on property located on the south side of Huntington Drive between Second and
Fifth Avenues (Arcadia Gateway Centre), more particulary described as fol"lows:
Lots 1 through 8, Portion of Lot 9, all of Tract 5205,
Map Book 54-61 and those portions of Third and Fourth
Avenues that would pass with the legal conveyance of the
above said land, City of Arcadia, in the County of
Los Angeles.
WHEREAS, a public hearing was held on August 25, 1987, at which time all
interested persons were given full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Departml~nt in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use appl i ed fo r at the 1 ocat i on i ndi cated is prope rly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the 1.3nd and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
. 6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate a restaurant upon the following conditions:
1. That a landscape and irrigation plan be submitted to the Planning
Department for its review and approval prior to issuance of any building permits.
2. That the fire safety shall be complied with to the satisfaction of
the Fire Chief.
3. That the trash enclosure shall be constructed of the same material
as the restaurant building.
4. That C.U.P. 87-18 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
5. Noncompliance with the provisions and conditions of this
Conditional Use Pennit shall constitute grounds for the immediate suspension or
revocation of said Permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of August 25, 1987 and the following

PROPOSAL
The applicants are proposing to construct a 7,200 square foot restaurant
with seating for 260 people.

Parking
The restaurant is part of a mixed commercial center proposed on the ~;outh
side of Huntington Drive. The center will have 745 parking spaces. &lsed
upon the City.s code requirements, 72 parking spaces are required for
Bennigan's restaurant and an additional 56 parking spaces will be required
for the restaurant on Pad D (a total of 128 spaces). There are approximately
158 parking spaces around the perimeter of the restaurants. However, this
parking is not specifically designated for the restaurant uses.
The Arcadia Gateway Center is requesting an overall parking modification
(M-87-69) for the entire complex of 745 parking spaces in lieu of 83()
spaces required.
It is staff's opinion that the parking as proposed is adequate for the
restaurant use.

ARCHITECTURAL DESIGl,i REVIEW
The building will be 16'-6. in height. The exterior of the building will be tan
sb1cco witll green and red accent bands around the building.
The entrance is located on tlle west side of tlle building. Tile paving "1'111
enhance tlle entrance waJ}{way.
The building along Huntington Drive is 112+ feet in lengUl; tlle westerly 65
feet of tlle facade will have an atrium-type dining area extending from tlle
face of the building approximately 10.-6.. This dining atrium area wraps
around the westerly face of the building extending south to tlle building
entrance. Green and White striped awnings will extend over tlle atrium
dining area as well as over tlle Windows on tlle westerlY and soutllerl}'
facade.
Gooseneck lights will be located over tlle awnings.
A 8 1/2' by 20 1/2' trash enclosure is proposed at the southeast porti(~n of
tlle building.

Landscaping will be proVided around the perimeter of the building. A
detailed landscape plan Will be required prior to issuance of a building
permit.
Signing
The applicants are proposing signs on the north, south and west walls ,of the
building. Code allows a maximum of 2 square feet per linear foot of building
frontage wbich would allow a signs not to exceed 144 square feet of area on
each wall. The signs on the northerly and southerly facade are 62.5 square
feet. The sign on the front of the building (westerly facade) w1l1 be
approximately 7.5 square feet.
All signs Will be neon cbannellettering which When lighted w1l1 be red.
A free-standing monument sign is proposed in the planting area along
Huntington Drive. Plans have not not been submitted for review at th:ls time.
. ~ECJAL INFORMATION
The restaurant is located within the City's redevelopment area and is E;ubfect
to Redevelopment Agency review. This review has been scheduled for the
City Council's September 1st meeting.
ANALYSIS
A restaurant is a permitted use in the CPD-l zone with an approved
conditional use permit. The proposed plan is consistent with the site plan
and specific uses set forth in the Redevelopment Agency's Disposition and
Development Agreement.
It is staff's opinion that the proposed project is consistent with the intent of
the design criteria set forth in the City's Architectural Design Review
Guidelines.
An environmental impact report was prepared for the Arcadia Gatewa.y
Center.

RECOMMENDATION
The P!llnnlng Department recommends approval of C.UP. 87-18 subje(:t to
the folloWing conditions:
1. That a landscape and irrigation plan be submitted to the Planning
Department for its review and approval prior to issuance of any'
building permits.
2. That fire safety shall be complied with to the satisfaction of the Fire
Chief.
3. That the trash enclosure shall be the constructed of the same material
as the restaurant building.

have executed a form available at the P!llnnlng Department indicating
awareness and acceptance of the conditions of approval.
4. Noncompliance with the provisions and conditions of this Conditional

FINDINGS AND MOTIONS
Ap-p-roval
If the Planning Commission intends to take actJ.on to approve this proj,ect, the
Commission should move to approve and file the Negative Declaration and
find that the project will not have a significant effect on the environm<&nt
and direct staff to prepare the appropriate resolution incorporating tha
specific findings and conditions of approval set forth in the staff report (or as
modified by the Commission).
Denial
If the PIllnning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in SUP]port of
that decision.
