SIXTH) AND ITS RECONSTRUCTION ON A NONCONFORMING R-1 LOT CONTAINING THREE SINGLE-FAMILY DWELLINGS AT 1118, 1118-A AND 1120 S. SIXTH AVENUE. WHEREAS, on July 17, 1987 an application was filed by Mr. and Mrs. Kevork Belikian for the removal of an existing single-family dwelling (1118-A S. Sixth) and its reconstruction on a nonconforming R-1 lot containing three single-family dwellings, Planning Department Case No. Zone Variance V-87-2, on property canmonly known as 1118, ll18-A and 1120 S. Sixth Avenue, more particularly described as follows: The South 77' of the North 308.34' of Lot 63, Tract #808, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 16, Pages 82-83 of Maps, in the Office of said County Recorder. WHEREAS, a public hearing was held on August 11, 1987, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREI3Y RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Departm,ent in the attached report is true and correct. Section 2. This Commission finds: 1. That there are no exceptional or extraordi nary ci rcumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or Vicinity in that there is no evidence of any unique circumstance or condition applicable to the subject property, its configuration, size, condition or any other characteristic. . . . 2. That such variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity in that property owners in the R-l zone possess a substantial property right to develop and utilize their propert.y as a single-family residence and the applicants can continue to use the legal nonconforming single-family dwelling without making the proposed development. 3. That the granting of such variance could adversely affect the comprehensive General Plan in that the granting of this variance encourages the retention of a nonconforming R-2 multiple-family development type use in an area designated for single-family residential by both the General Plan and the Zoning Ordinance, which would be tantamount to spot zoning the property R-2 in conflict with the General Plan. Section 3. That for the foregoing reasons this Commission hereby denies the application for Zone Variance V-87-2 for the removal of an existing single- family dwelling and its reconstruction on a nonconforming R-l lot containing three Single-family dwellings. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August II, 1987 and the following vote: AYES: NOES: None Commissioners Amato, Clark, Hedlund, Papay, Szany 1343 -2- . FRONTAGE: 77 feet on Sixth Avenue EXISTING LAND USE & ZONING: The subject site is developed With three single-family dwellings (building permit records show two dwellings); zoned R-I SURROUNDING LAND USE & ZONING: SUrrounding the subject site are single-family dwellings; zoned R-I . GENERAL PLAN DESIGNATION: . Single-family residential (0-6- du/ac) SPECIAL INFORMAIION According to the records on file in the Building Department, the dwelling at 1118 S. Sixtl1 (front dwelling) was constructed in 1926 and a garage was built in 1941. A service porch was added in 1951 to 1118 S. Sixtll. In 1953 a second dwelling (1120 S. Sixtll) with a garage was built at the back of the lot. There are no permits on file for a third dwelling (1118-A S. SiXth). . It is the opinion of the Plllnning and Building Departments after a site inspection that unit number 2 (1118-A S. Sixth), which the applicant proposes to demolish and rebuild, was not originally built as a dwelling. This conclusion is due to the type of construction, ceiling height and lack of permits on file. The May 3, 1949 Zoning Ordinance (Ordinance 760) and an April 6, 195'i amendment (Ordinance 878) permitted additional single-family dwellinllS . for lots zoned R-l. One dwelling was permitted for each full 7,500 sqlW'e feet of lot area, but not more than three dwellings were permitted on aII,y one lot. On July 7, 1959 Ordinance 1060 was adopted which permitted additional single-family dwellings on R-l zoned lots with an approved variance. If a variance was approved, lots with 18,750 square feet would be permitted two dwellings and a maximum of three dwellings on lots with 30,000 square feet or more. The present code permits only one single-family dwelling on a R-I zone<! lot, which ma1c.es the subject lot nonconforming. ~QUIRED F1NDINGS The ptllnning Commission should e~mine the information and make findings Which are relevant to the prerequisite conditions below: . That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally te) the property or class of use in the same 20ne or vicinity. B. That the granting of such variance will not be materially detrimental to the public health or welfare or injurious to tbe property or improvements in such 20ne or vicinity in whicb the property is located. C. That such variance is n~ for the pres&rvation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. D. That the granting of such variance will not adversely affect the comprehensive General Plan. . Attached for your consideration are those pages of the application in wtlich the applicants have stated their case regarding the aforementioned prerequisite conditions. PROPOSAL AND ANALY..sIS The applicant is proposing to demolish a building which they have been using as a rental dwelling (unit 2 on site plan, 1118-A S. SiXth) and construct a new single-family dwelling on a lot zoned R -1. A variance is being requested since code does not permit the construction of a new dwelling on a R-l zoned lot white other dweWngs eXist. Since the subject lot contains more than one single-family dwelling, the buildings are nonconforming. Section 9244.2 states that a nonconformi1:l,g building may be continued, provided no additions or enlargements are made thereto and no structural alterations are made therein, . . . If such nonconforming building is removed, every future use.of such premises shall be in conformity with the provisions of this Chapter. . V-87-2 8111/87 P.age 3 41 sectJon 92 ~~.3 woUld permit restoratJon of a nonconforming building under the following circumstances: Subject to all other regulations of this Chapter, a building destroy'~ to the extent of not more than seventy-five percent (7S~) of its reasonable value by fire, explosion or other casualty or Act of God or the public enemy, may be restored and the occupancy or use of such building or part thereof which existed at the time of such partial destruction may be continued. It is staff's opinion that although the proposal provides for a new residence which may be more aesthetically appealing and functional than the existing building, it also provides for the expansion and retention of a nonconforming building and use. Also, staff does not feel that evidence has been presented which supports all of the prerequisite findings required for granting a zone variance. No other lots in the R -1 zone are permitted to construct an additional single-family dwelling. Also, approval of this variance \I1OUld set a detrimental precedence in the R-l zone by allowing the lot to be used in a fashion ~mitar to the R-2 zone. . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed prc1e<:l said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions Within the area a1fede<1 by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project RECOMMENDA TIOl{ The Planning Department recommends denial of V-87-2. If the p];tnning Commission intends to approve V-87-2, the Planning Department recommends the following conditions: 1. That the existing unit number 2 (1118-A S. In conjunction With the construction of a new single-family dwelling an attached four (4) car garage shall be built. Said dwelling and garage shall comply With pertinent City regulations. . 3. The sioo shall be maintained as per the plans on file in the Planning Department or as amended to comply With pertin-mt City regulations. 4. That V-87-2 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance With the provisions and conditions of this Variance shall constituoo grounds for the immediaoo suspeIIlSion or revocation of said Variance FINDINGS AND MOTIOf.f~ ~proval . If the Plllnning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project Will not have a significant effect on the environmet1tt and direct staff to prepare the appropriaoo resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Application Form for Zone Variance Supplement to G G. The subject property consists of three units. Unit 1 and 3 are in good shape, but unit 2 needs extensive renovation. The property was acquired by the current awners in April 1978. Unit 2 wos occupied by the same tenant who reportedly rented the place oround 35 years ogo and resided there until his recent death in early Moy 1987. He was a bachelor, a very undemanding, uncomplaining bachelor. who spent a larger portion of his life in that same unit. It is reported that Unit 2 was built in 1928. When Mr. Mann, the tenant died, upon inspection and in preparation far finding a new tenant, we discovered that the Unit was no more fit for any human habitation. Foundations, wails, roofs, ceiling, windows, plumbing, drainage, electrical wiring, almost every component of the unit needs serious attention. A few contractors were approached and their response was $65,000 to $70,000 for remodeling and somewhat same for rebuilding. They Invariably concluded that It would be advisable to rebuild the unit than to remodel, since the cell1ng Is so low, no natural light In-doors at any. time of the day; Inadequate ventilation all over and Insulotlon almost Is nil. The advice offered was that it would be extremely difficult to meet the minimum expected standards of the current building codes. The Unit Is beyond repair and not fit for habitation. The only possible prospective tenants would be those economically underprivileged or radical kinds of pec'ple, whose presence might cloud the homogeneity of the existing neighborhood, and possibly affect adversely the overall atmosphere and consistency of the currently desirable and delJghtful neighborhood. The present tenants in the other two units, and other neighbors are very concerned and warrled, although we have reassured them that we do intend to rent anly to desirable tenants. We have given serious consideration to renovation; but builders could not find a single wall that was worth keeping or doors or any other building components avoiloble for use. We are sad and worried about the whole situation, and would rather repair than replace, if only that was feasible and justifiable. The above factors force us for asking for a Zone variance. In our opinion th,. new Unit would be attractive and enhance the beauty of the neighborhood.
