PLANNING COMMISSION RESOLUTION NO. 1341 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-13 FOR OUTDOOR REPAIR AND MAINTENANCE OF DRIVING SCHOOL VEHICLES ALSO TRUCK INSTRUCTION AND PARKING UPON AREAS COVERED WITH GRAVEL IN LIEU OF BEING PAVED AT'11631 CLARK STREET. WHEREAS, on June 22, 1987 an application was filed by Richard F. Dootson for outdoor repair and maintenance of driving school vehicles also truck instruction and parking upon areas covered with gravel in lieu of being paved, Planning Department Case No. C.U.P. 87-13, on property commonly known as 11631 Clark Street, more particulary described as follows: SEE EXHIBIT "A" WHEREAS, a public hearing was held on July 28, 1987, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. . . . Section 3. That for the foregoing reasons this Commission grants ,~ Conditional Use Permit for outdoor repair and maintenance of driving school vehicles also truck instruction and parking upon areas covered with gravl~l in lieu of being paved upon the following conditions: 1. Plans for all structures which do not have building permits shall be sumbitted to the Building Department within ten (10) days after final approval by the Planning Commission. Building permits shall be obtained by September 8, 1987. I f correct ions are requi red by the Bu iT di ng Department, sa i d corrlect ions shall be completed by September 22, 1987. 2. Minor maintenance and repair work shall be limited to driving school vehicles only. Said vehicles shall be registered to Dootson. 3. Maintenance and repair work shall not include the overhauling of engines. transmission work, body work or painting. 4. Wrecked or damaged vehicles shall not be stored on the property. 5. Said maintenance and repair work as well as the use of the graveled area for driving school instruction shall be terminated by July 28, 1989. By August 2B, 1989 all structures related to the maintenance and repair of school vechic1es shall be removed or demolished. 6. Outdoor storage shall be prohibited. This shall include engine parts, tires, wares, merchandise, crates and any item related to the repair or maintenance of driving school vehicles. 7. Fire safety shall be provided to the satisfaction of the Fire Department which may include the following: A. Comp1aince with Article 29 of the Uniform Fire Code including Section 29.104. B. Floor of work area shall drain to approved oil separator. C. Waste oil shall be stored in approved containers or tanks. 8. The Water Department noted that all repairs shall be made on a paved surface. No work with break fluid, oil, transmission fluids, solvents, etc. shall be done on the gravel area. Safeguards for proper disposal of any hazardous materials shall be established. 9. The operation of the driving school which includes the rep,~ir and maintenance of driving school vehicles shall comply with all statutory requi rements. -2- 1341 ~ 10. The site shall be maintained as per the plans on file in the Planning Department. 11. That C.U.P. 87-13 shall not take effect until the owner and applicant have executed a form available at' the Planning Department indicating awareness and acceptance of the conditions of approval. 12. Noncompliance with the provisions and conditions of this Conditional Use Pennit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of July 28, 1987 and the following vote: AYES: NOES: Commissioners Amato, Clark, Hedlund, Papay, Szany None . Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. GENERAL PLAN DESIGNATION: Commerci aI/I ndustri al HISTORY On March 11, 1986 the Planning Commission voted 7 to 0 to approve Conditional Use Permit 85-21, a request to operate an automobile and t.ruck driving school at the subject location. Approval is subject to several conditions listed in Resolution 1310 (attached) which includes the following: 1. Driving school trucks shall be parked on the designated pal/ed areas as shown on the plans on file in the Planning Department. Driving school trucks shall not interfere with parking spaces designated for the industrial buildings, loading areas and driveways (condition no. 6). 2. Automotive repair shall be prohibited unless a conditional use permit is granted for such use (condition no. 6). . On May 29. 1967 a letter was sent to Mr. Dootson notifying him that he was in violation of CUP 65-21 (conditions no. 6 and 6) and Section 9269.14 which states 'All parking areas shall be paved with a concrete or asphaltic surface to specifications and standards on file in the office of the Department of Public Works: On June 22, 1967 Mr. Dootson filed for a conditional use permit. PROPOSAL AND ANALYSIS The applicant is requesting for a period of 2 to 2 1/2 years a conditioOlll use permit. for outdoor repair and maintenance of driving school vehicles Wllich includes truckS. Also, truck instruction and parking upon areas covered with gravel in lieu of being paved with asphalt or concrete. The applicant states that they do not overhaul engines, transmissions, 110 body work or any major repairs. That they service and adjust brakes, replece light bulbs, windshield wipers and repJece clutches . Presently the site consists of four buildings (buildings Ito 4 on site pllln), the driving schoOl's office (building I) and three industrial buildings. The applicant plans to construct four other industrial buildings (buildings 5 to 8 C.U.P 87-13 7/28/87 Page 2 . on site plan) within 2 to 2 1/2 years. When the construction starts fOI' the new buildings this conditional use permit will no longer be needed. The outdoor repair work is taking place next to building 4 where a 16' t1Y 20' covered work area has been built (no permits on file). The area for truck instruction is the vacant portion of the lot (see practice course site pll3n). The Planning Department would not be in favor of this request. It is sti3ff's opinion that even temporary use of the site as proposed by the applicant would not be appropriate. Much of the development in the area is new end uniformity is important to maintain the Quality of development. The precedent which would be set by approving this request would be detrimental to the area. Garages have been required to do all work within the building. The pro~losed work area is not totally enclosed nor screened from public view. If this request is denied the applicant will be notified to remove the covered work area, or submit plans in compliance with the relevant City regulations which would include Architectural Design Review. . The gravel truck instruction and parking area covers approximately 58,530 square feet. It is also not screened from public view. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial stUdy did not disclose any substantial or potentially substelOtial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora. fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negat1ive Declaration has been prepared for this project. RECOMMENDA T I ON The Planning Department recommends denial of C.U.P. 87-13. If the Planning Commission intends to approve CUP 87-13. the Planning Department recommends the following conditions: J. Plans for all structures which do not have building permits shall be submitted to the Building Department within ten (10) days after final approval by the Planning Commission. Building permits shall be obtained by September 8, 1987. If corrections . Maintenance and repair work shall be limited to driving school vehicles only. Said vehicles shall be registered to Dootsol1. 3. Maintenance and repair work shall not include the overhauling of engines, transmission work, body work or painting. 4. Wrecked or damaged vehicles shall not be stored on the property. 5.
