PLANNING COMMISSION RESOLUTION NO. 1340 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-14 TO OPERATE A TONING HEALTH SALON WITH FACILITIES FOR A MAXIMUM OF FOURTEEN PATRONS AT ANY ONE TIME AT 815 NAOMI AVENUE.-#B WHEREAS, on June 22, 1987 an application was filed by Peter P, Sylchak to operate a toning health salon with facilities for a maximum of fourteen patrons at anyone time, Planning Department Case No. C.U.P. 87-14, on property commonly known as 815 Naomi, more particulary described as follows: SEE EXHIBIT "A" WHEREAS, a public hearing was held on July 14,1987. at which time all interested persons were gi ven full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct, Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injuriOUS to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loadin!l, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated b1 the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact ~ on the environment. . fit . . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to operate a toning health salon with facilities for a maximum of fourteen patrons at anyone time upon the following conditions: 1. That the total number of fitness/exercising machines shall not exceed fourteen for a maximum of fourteen patrons at anyone time. 2, That aerobics, nautilus weight training, gymnastic, exerecise and other similar clases shall not be conducted. 3. That the exercising area shall not exceed 870 square feet, as shown on the proposed floor plan. 4. A modification be granted for 427 parki ng spaces in lieu of 463 spaces. This approval shall not constitute an approval for a general reduction in parking for the total site, That this parking modification shall only be for the use approved by C.U.P. 87-14 (toning health salon). 5. Fire safety shall be provided to the satisfaction of the Fire Department. 6, That the total number of employees shall not exceed three (3) individuals. 7, That all employees park behind the subject building. 8, That C,U.P. 87-14 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval, 9, Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. GENERAL PLAN DESIGNATION: Commercial PROPOSAL AND ANALYSIS Health clubs/salons are permitted uses in the C-2 zone with an approv~ld conditional use permit, The applicant is seeking a conditional use permit to operate a toning hE'alth salon in which fitness programs are conducted using passive resistance types of exercising machines (see attached Exhibit "A"), Un1i1c.e many other health clubs, the proposed use does not have classell with large numbers of patrons, A total of 14 exercise maChines would be installed and during the peale, operation of this facility there would be one patron utilizing each machine, The applicant bas noted that the use of the facilities will be by appointment only. The ho,urs of operation are from 6 a.m. to 7 p.m. during the \ftekdays and on Saturdays, There will be a total of three employees. . This facility occupies 1.550 square feet of a 19,661 square foot retail b1Ui1ding located southwest of the Yons Pavilion market, as illustrated on the site plan, On April 26, 1967, the Planning Commission voted 6 to 0 With one member absent to approve C,UP, 67-9, a request to operate a 1,470 square foot eating establishment (Penguin's frozen yogurt shop) Which is also located within the building. ApprOVal of C,U,P,67-9 was subject to limiting the business to seating for siXteen poople and a maximum ot tour tables, Also, a modification was granted for 427 on-sdte parking spaces in lieu 446 spaces, This parking modification was not an appro~'al tor a general reduction in parking for the total site, but only tor the use approVed by C.UP.67-9. In this particular case the square tootage of the actual exercising area determines the number of required parking spaces, Within the proposed 1,550 square toot toning health salon there Will be an exercising area of approximately 670 square teet Which requires 25 parking spaces, Said spaces resutt in a net increase ot an additional 17 spaces for the site, This increase is due to the difference in the parking . C.UP.67-14 July 14, 1987 Page 2 . standards (i.e, 8 required spac~ based on 5 spac~ per 1,000 square t~~t tor retail as compared to 25 required spac~ based on I space per 35 square teet or exercising area), With the addition of the proposed toning health salon, 463 parking spaces are required tor the site, Staff recently made three random vehicle counts on the site to determine the percentage of available parking, It was noted that of the 427 parking spaces on the site a maximum number of 207 parked vehicl~ were counted during tile peak business hours Which seemed to be between 12:00 pm, and 4:30 p,m, It is staff's opinion that the proposed use is a unique "health club/Salon" and as such the existing parking is adequate, provided that the business be linlited to the proposed exercising area, number of fitness machi1:l~, and maximum number of patrons at anyone time, Pursuant to the provisions of the California Environmental Quality Act, the plannitlg Department has prepared an initial study for the proposed project. Saie! initial study did not disclose any substantial or potentially substantial adversl. Cbange in any of the pbysical conditions Within the area affected by the project iJJ:c1uding land, air, water, minerals, flora, fauna, ambient noise, and objects of his:torical or aesthetic significance, Therefore, a Negative Declaration has been prepared for the project. . RECOMMENDA T.lQli The Planning Department recommends approval of C.U P. 67-14 subject to the folloWing conditions: 1. That the total number of fitness/exercising machines shall not eXteed fourteen for a maximum of fourteen patrons at any given time. 2, That aerobics, nautilus weight training, gymnastic, exercise arId other similar classes shall not be conducted, 3.
