PLANNING COMMISSION RESOLUTION NO. 1338 A RESOLUTION GRANTING CONOITIONAL USE PERMIT 87-11 TO OPERATE AN EATING ESTABLISHMENT WITH SEATING FOR TWELVE PATRONS AT 46 WEST LAS TUNAS DRIVE. WHEREAS, on June 1, 1987 an application was filed by Messrs. Jaml!s Kefallinos and Peter Vagenas to operate an eating establishment with seating for twenty persons, Planning Department Case No, C.U.P. 87-11, on property cl)mmonly known as 46 West Las Tunas Road, more particulary described as follows: SEE EXHIBIT "A" WHEREAS, public hearing was held on June 23, 1987, at which time a'll interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCAOIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and snape to accommodate said use. All yards, spaces, walls, fences, parking, loadin'9, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood, 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . . . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6, That the use applied for will not have a substantial adverse impact on the environment, Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to operate an eating establishment with seating for twelve patrons upon the following conditions: 1, Seating shall be limited to a maximum of twelve (12) persons. 2. A modification shall be granted for 58 parking spaces in lieu of 102 parking spaces. This approval shall not constitute an approval for a general reduction in parking for the total site. That this parking modification shall only be for the use approved by C.U.P. 87-11 (eating establishment). 3. Fire protection shall be provided to the satisfaction of the Fire Department, 4, Any changes in water service shall be installed by the Arcadia Water Department at the developer's expense. 5, Signs for the propsoed business shall be subject to Architectural Design Review. 6, The site shall be maintained as per the plans on file in the Planning Department. 7, That C.U.P. 87-11 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 8, Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4, The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 23, 1987 and the following vote: AYES: Commissioners Amato, Fee, Galinski, Hedlund, Kovacic, Szany NOES: None ABSENT: Commissioner Papay Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. 1338 -2- . . . The applicant Is requesting a conditional use permit to operate an eating establishment with seating for twenty persons. By addIng tables with chairs, the business chenges from e retell activity to en eating establishment which requires a conditional use permit. The subject eating establishment, which contains 1,682 squere feet, Is p!Jrt of e 12,552 squere feet retail center. On July 10, 1984 a modlflcetlon (M-84-77) wes granted to permit 5B parking speces In lieu of 63 speces for a proposed commercial retan center. It was determined that the lot was unique since It hes frontage on both Las Tunes and Live Oak, elso the lot was like an "Island: Due to the addltlonell street frontege and the lack of abutting commercial lots, more than the normal street parking would be available to the subject property. On October 28, 1986 the Planning Commission voted 5 to O'with 2 memben absent to approve C.u.p 86-10, a request for a 906 square eating establishment et 30 West Les Tunes, which Is within the same retell center es 46 West Las Tunas. Approval of C.U.P. 86-10 was subject to limiting the business to seating for twelve persons. Also, a modification was grantelj for 58 parking spaces In lieu of 77 spaces. Note that the parking modlflcetlon was not an approval for a general reduction In perking for the total site, but only for the use approved by C.U.P 86-10. With the addition of the proposed 1,682 square foot eating establishment, 102 parking spaces are required for the site. The two eating establishments will totel 2,588 square feet, which requires 52 parking spaces. This Increase Is due to the difference In required perking; retail areas need 5 spaces per 1,000 square feet of gross floor area while an eating establishment requires 20 spaces per 1,000 square feet of gross floor area. By restrlctlng the seating within these eating estebllshments the Plllnnlng Department feels the parking requirement of 5 spaces per 1,000 squllre feet Is adequate. Restrlctlons on seetlng are not placed on eating establishments which comply with the 20 spaces per 1,000 square feet. It 18 staff's opinion that allowing a limited number of seating In food establishments would not be detrlmental to the site or surrounding propertIes, but would serve as a convenience for customers.
