HomeMy WebLinkAbout1336 . . . PLANNING COMMISSION RESOLUTION NO. 1336 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-8 TO CONSTRUCT A VETERINARY HOSPITAL AT 311 NORTH SANTA ANITA AVENUE. WHEREAS. on April 6. 1987 an application was filed by Marvin F. Saya to construct a veterinary hospital, Planning Department Case No. C.U.P. 87-8, on property commonly known as 311 North Santa Anita Avenue, more particulary described as follows: See Exhibit "A" WHEREAS, a public hearing was held on April 28, 1987, at which time .311 interested persons were given full opportunity to be heard and to present evi dence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREB'! RESOLVES AS FOLLOWS: Sect ion 1. That the factual data submi tted by the Pl anni ng Depa rtment in the attached report is true and correct. Section 2, This Commission finds: 1, That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injuriOUS to the property or improvements in such zone or vicinity, 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use appl i ed for wi 11 not have a substantial adverse impact on the environment. ~ Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to construct a veterinary hospital upon the following conditions: 1. That condi ti ons 1 i sted below from the Department of Pub 1 i c Works shall be complied with to the satisfaction of the Director of Public Works" A, Dedicate a corner cut-off for street purposes (15' radius,). B. Plant parkway trees at locations determined by the Director of Public Works per City of Arcadia Standard S-13. C. Close existing driveways not to be used and reconstruct curb, gutter and sidewalk to match existing. D, Construct P,C.C, sidewalk, as per City Standard. E. Gravity drainage outlets, and driveway aprons shall be constructed to conform to Drawing S-ll. F. Construct P.C.C. ramp for the handicapped per City of Arcadia Standard Drawing No. S-22. G. Arrange with Edison Company to install street lights witll underground circuits. Location and number of lights subject to approval of the Director of Public Works. H. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the permittee and shall be at the permittee's expense, 2. Fire protection shall be provided to the satisfaction of the Fire . Department. 3. Any change in water service shall be installed by the Arcadia Water Department at the developer's expense. Any services abandoned shall be at the developer's expense. Also, nature of occupancy may require backflow protection. 4. Approval of C,U.P. 87-8 shall be subject to Design Review before the Arcadia Redevelopment Agency, 5. The following modifications shall be granted: A. Zero rear yard setback (west property line) in lieu of 20'-0" (9265.2.2). B. 20 parking spaces in lieu of 28 parking spaces (9269.5). C. Free-standing sign within 10'-0" front yard setback along Santa Anita Avenue (9320.65,5). . 1336 -2- . . . 6. The site shall be maintained as per the plans on file in thE! Planning Department, 7. After completion of the new veterinary hospital the remaining building shall be demolished or removed within thirty (30) days. The proposed parking lot and landscaping shall be completed within thirty (30) days after the removal of said building. 8. That C.U.P. 87-8 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval, g. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit, Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of April 28, 1987 and the following vote: AYES: Commissioners Amato, Galinski, Hedlund, Kovacic, Papay, Szany NOES: None ABSENT: Commissioner Fee Section 5. North: South: East: West: Offices; zoned C- M Mixed commercial; zoned C-M Mixed commercial; zoned C-2 & H Industrial; zoned C- M GENERAL PLAN DESIGNATION: Com mercial/ Industrial HISTORY The existing animal hospital building, which was constructed in 1946, contains 3,210 square feet of floor area, al ,500 square foot outdoor animlll run and eight parking spaces. PresenUy there is minimal landscaping and inadequate back-out Cor the parking spaces. . On April 9, 1986 the Planning Commission voted 6 to 0 with one member absent to approve C.U.P. 86-7, a request to enlarge the animal hospital by adding a 112 square foot reception room. New planters were to be added, the building was to be painted and a sidewalk constructed along S1. Joseph Street. The following nonconforming conditions were to remain: 1. Veterinary hospital with outside runs. 2. 8 parking spaces in lieu of 17 spaces. 3. Aisle width of 18'-6" in lieu of 25'-0" for parking spaces, 4, 2 compact spaces in lieu of 1 compact space maximum. PROPOSAL The applicant proposes to construct a new two-story 5,598 square foot veterinary hospital. 1,555 square feet of the building will be used for animal runs and cages, leaving 4,043 square feet for the operation of the hospital. To avoid closing during construction the new hospital will be built at the rear of the lot, which will cause minimal disturbance to the existing building. The Planning Department will be recommending a timetable fot the demolition or the existing building and completion oC the parking lot with landscaping. . C.U.P 37-8 4/28/87 Page 2 . Four modifications are being requested, A zero rear yard setback (west property line) is proposed in lieu of 20'-0", In this case the subject lot's rear property line is the adjacent lot's (15 St. Joseph Street) side property line, A side yard setback is not be required. Also, the elisting building at 15 St, Joseph Street has no side yard setback. 20 parking spaces are proposed in lieu of 28 spaces, which is 5 spaces per 1,000 square feet of gross floor area. If the rooms used for the animal rUl1S and cages are elcluded from the parking calculation, 20,} spaces would bt! required. A free-standing sign is proposed within the 10'-0" special setback along Santa Anita Avenue. Several properties along Santa Anita Avenue have received modifications to place their free-standing signs within the special setback (214, 253, 310, 325, 400 and 420 N, Santa Anita). S compact parking spaces are planned in lieu of 4 muimum, ANALYSIS .. It is the Planning Department's opinion that the development can be accommodated on the lot. The requested modifications are reasonable elcept for the additional compact space, It appears there is room to change a compact space into a standard space on the site plan shown on sheet no, 1, By doing so the landscaped area between the building and the handicap parking space will be shortened. Since this proposal is also within the jurisdiction of the Redevelopment Agency, approval of C.U.P, 87-8 should be subject to Design Review by the Arcadia Redevelopment Agency. A veterinary hospital is a permitted use in the C-M zone with an approved conditional use permit. Approval of this conditional use permit would allow for a substantial upgrading of the property. Also. the proposal would be consistent with the zoning and general plan for the area, . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed projE'ct. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land. air. water. minerals, flora, fauna, ambient noist~ and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. C,U.P 87-8 4/28/87 Page 3 . RECOMMENDA nON The Planning Department recommends approval of C,U,P. 87 -8 subject to lthe following conditions: 1, Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works, 2, Fire protection shall be provided to the satisfaction of the Fire Department which includes the follOWing: 3.
