HomeMy WebLinkAbout1335 . . . PLANNING COMMISSION RESOLUTION NO. 1335 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-7 TO CONSTRUCT A NEW AUTOMOTIVE GARAGE AT 333 NORTH FIRST AVENUE. WHEREAS, on April 6, 1987 an application was filed by Robert A. Ruiz to construct a new automotive garage, Planning Department Case No. C.U.P. 87-7, on property commonly known as 333 North First Avenue, more particulary described as follows: See Exhibit "A" WHEREAS, a public hearing was held on April 28, 1987, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, 10adin9, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. . . . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to construct a new automotive garage upon the following conditions: 1. That conditions listed below from the Department of Public Ilorks shall be complied with to the satisfaction of the Director of Public Works. A. Plant parkway trees at locations determined by the Director of Public Works per City of Arcadia Standard S-13. B. Construct P.C.C. sidewalk, as per City Standard. C. Gravity drainage outlets, and driveway aprons shall be constructed to conform to Drawi ng S-l1. D. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the permittee and shall be at the permittee's expense. 2. Fire protection shall be provided to the satisfaction of the Fire Department which includes the following: A. Forced ceiling ventilation system in battery repair or charging room with ventilation system interlocked with any charging system. Motor of ventilation system shall be for hazardous locations. B. Electrical equipment in charging room shall be explosion proof and comply with electrical code for Class I Division 1 hazardous locations. C. Electrical lamps shall be totally enclosed by suitable guards to prevent physical damage and prevent falling of hot particles within the charging room or within 20 feet of the room if not separated by a partition. D. Charging batteries to be in compliance with C.A.C. Tit'le 8 Subchapter 7 section 5185 and section 3400 (d). E. Fire alarm system to central station. F. Automat i c Fi re Spri nkl ers may be requi red dependi ng on the type of occupancy classification as determined by the Building Department. Appears that possible classifications are B-1, B-2 H-1, and H-4. Occupany separation walls may be required between different types of occupancy. H. Garage area may require floor drainage with a separator in drain to sewer. Also mechanical ventilation may be required in the repai r area. 3. Any change in water service shall be installed by the Arcadia Water Department at the developer's expense. 4. The City Council shall approve the proposed industrial site of 7,050 square feet in lieu of 15,000 square feet (9266.2.3). 5. A modification shall be granted for a zero street side yard setback (La Porte Street) in lieu of 10'-0" for a portion of the garage (9266.2.2.1.(d)). 6. After completion of the new automotive garage, excluding t1e covered carport, the existing building shall be demolished or removed within thirty (30) days. The proposed parking lot and landscaping shall be completed within thirty (30) days after the removal of the existing building. 12. That C.U.P. 87-7 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 13. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. -3- 1335 . . . Section 4. GENERAL PLAN DESIGNA nON: Industrial HISTORY Building permits show that originally a store building and a dwelling wetl~ built in 1958 on the subject site. Since 1978 Howard's Tire and Battery hils been in business in the front half of the building and a dwelling was located in the rear half. Presently, there is no landscaping, striped parking lot or trash enclosure. .. On January 13, 1987 the Planning Commission voted 7 to 0 to approve C.U.P. 86-17, a request to operate an automotive garage at 333 North First Avenue. The applicant had proposed to expand the garage into the area which the dwelling occupied, eliminating a nonconforming use. A portion of the roof was to have been raised from 9'-0" to 14'-0" to make servicing vehicles easier. Other remodeling would have included paving the City parkway, planting street trees and on-site landscaping to buffer the parking lot, relocating a telephone pole guy wire to allow for a new driveway, paving and striping the parking lot, building a block wall with wrought iron fencing along La Porte Street, providing for a trash enclosure and adding a new mansard roof. Modifications were granted for an existing zero front yard setback in lieu of 10'-0" and a partial reduction of landscaping along La Porte Street. PROPOSAL The applicant proposes to construct a new two-story 2,896 square foot automotive garage. To avoid closing during construction the new garage is being built at the rear of the lot, which will not disturb the existing building. The Planning Department wlll be recommending a timetable for the demolition of the existing building and completion of the parking lot with landscaping. Two modifications are being requested. A portion of the garage will have a zero street side yard setback (La Porte Street) in lieu of 10'-0". The adjacent industrial building, which was built in 1960, at 56 La Porte Street has a similar setback from the street. Also, the appearance of the wall facing La Porte has been taken into consideration with the use of a variety of split face blocks. . C.U.P 87-7 4/28/87 PIge 2 . The lot contains 7,0::)0 square feet in lieu of I ::),000 square feet required for an industrial devleopment in the M-l zone. Code Section 9266.2.3 states that the City Council may approve an industrial development on a lot less than 15,000 square feet where a hardship by reason of surrounding development, location or configuration is clearly demonstrated. Surrounding the subject site are either buildings or streets, therefore a hardship exists due to surrounding developments. ANALYSIS It is the Planning Department's opinion that the development can be accommodated on the lot as long as the business does not include auto body painting or auto body work. These activities require vehicles to be stored on the premises for longer periods of time, which would eliminate on-site parking spaces for employees and patrons. To alleviate this problem, it is staff's opinion that a separate parking lot, screened from public view, should be required for the storage of vehicles. Staff has no objection to the dispensing of tires, batteries, oil and accessories; tuning of motors, wheel and brake adjustment and other minor repairs and services. . On April 21, 1987 the Arcadia Redevelopment Agency approved the Design Review for the proposed garage subject to the approval of C.U.P 87-7. An automotive garage is a permitted use in the M-l zone with an approved conditional use permit. Approval of this conditional use permit would remove a nonconforming residential use and allow for a substantial upgrading of the property. Also, the proposal would be consistent with the zoning and general plan for the area. Pursuant to the provisions of the California Environmental Quality Act, tb,e Planning Department has prepared an initial study for the proposed projl~ct. Said initial study did not disclose any substantial or potentially substantial adverse chllnie in any of the physiCal conditions within the area affected by the project including land. air, water, minerals, flora. fauna. ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. . C.U.P 87-7 4/28/87 Pltge 3 ~ . The Planning Department recommends approval of C.U.P. 87-7 subject to llhe following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. Fire protection shall be provided to the satisfaction of the Fire Department. Conditions as outlined in the attached report dated April 9, 1987 from the Fire Department shall be complied with. 3. Any change in water service shall be installed by the Arcadia Water Department at the developer's eI.pense. 4. The City Council shall approve the proposed industrial site of 7,0:;0 square feet in lieu of 15,000 square feet (9266.2.3). 5. If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, tbe Commission should move to deny and direct staff to prepare an approprillte resolution incorporating the Commission's decision and findings in SUppOl't of that decision. ..
