PLANNING COMMISSION RESOLUTION NO. 1334 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-9 TO OPERATE AN EATING ESTABLISHMENT (PENGUIN'S FROZEN YOGURT SHOP) AT 815 NAOMI AVENUE. WHEREAS, on April 6, 1987 an application was filed by Teri Mc Whorter, District Manager for Penguin's Frozen Yogurt, to operate an eating establishment (Planning Department Case No. C.U.P. 87-9) on property commonly known as 815 Naomi Avenue, more particulary described as follows: SEE EXHIBIT "A" WHEREAS, a public hearing was held on April 28, 1987, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Departml!nt in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. . . . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to operate an eating establishment (Penguin's Frozen Yorgurt Shop) upon the following conditions: 1. Seating shall be limited to a maximum of sixteen (16) people in conjunction with a maximum four (4) tables. 2. A modification be granted for 427 parking spaces in lieu of 454 spaces. This approval shall not constitute an apprvoal for a general reljuction in parking for the total site. That this parking modification shall only be for the use approved by C.U.P. 87-9 (eating establishment). 3. Fire safety shall be provided to the satisfaction of the Fire Department. 4. That C.U.P. 87-9 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of April 28, 1987 and the follOWing vote: AYES: NOES: ABSENT: Commissioners Amato, Galinski, Hedlund, Kovacic, Papay, Szany None Commissioner Fee Section 5. LOT AREA: 286,764 square feet (6.58 acres) FRONTAGE: Approximately 496 feet on Naomi Avenue Approximately 359 feet on Duarte Road EXISTING LAND USE & ZONING: The subject site is developed with the Vons Pavilion market (64,872 square feet) and retail shops (19,881 square feet): zoned C-2 (General Commercial). SURROUNDING LAND USE & ZONING: North: Mixed residential and a office building: zoned R-3 and C-2 & D respectively Multiple-family dwellings: zoned R-3 Hinshaws department store and retail shops; zoned C..2 Multiple-family units and a shopping center; zoned C-1 & D GENERAL PLAN DESIGNATION: South: East: West: Commercial PROPOSAL AND ANALYSIS The applicant is requesting a conditional use permit to allow an existing frozen yogurt shop (Penguin's) to have seating for sixteen patrons (four tables with twelve chairs and four stools along an existing service counter). . By adding the requested seating the business changes from a retail activity to an eating establishment which requires a conditional use permit. The yogurt shop contains approximately 1,470 square feet, and is one of several shops within a 19,881 square foot retail building, as illustrated on the site plan. On-site parking consist of 427 spaces; 424 spaces are required for the Vons' facility and the retail shops. This request requires 30 spaces, which results in a net increase of an additional 27 spaces. Said increase is due to the difference in the required parking standards (5 spaces per 1,000 square feet .' for retail as compared to 20 spaces per 1,000 square feet for an eating establishment). Since 1982 there have been approximately twelve conditional use permits granted for requested seating in food establishments, and as of this date staff is not aware of any problems that have been caused by the operation of these establishments. It is staff's opinion that to allow a limited number of seating in small food establishments only provides a needed convenience for customers and does not create a situation that is detrimental to the site or neighboring properties. Based on staff's past experiences with food establishments, staff is recommending that the applicant's proposed seating be limited to a maximum of 12 persons. . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for the project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 87-9 subject to the following conditions: 1. Seating shall be limited to a maximum of twelve (12) persons. 2. A modification be granted for 427 parking spaces in lieu of 454 spaces. This approval shall not constitute an approval for a general reduction in parking for the total site. That this parking modification shall only be for the use approved by C.U.P. 87-9 (eating establishment). 3. Fire safety shall be provided to the satisfaction of the Fire Department. 4. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. . .
