PROPOSAL AND ANALYSIS
.
The applicant is requesting a conditional use permit to allow seating (twenty
stools) to be used in conjunction with existing food counters within the Vons
Pavilion market. Specifically, three stools would be for the ice cream
counter and seventeen stools would be placed along a food counter by the deli
area, as shown on the floor plan (enclosed for your review).
.
.
.
A conditional use permit is required for this particular request to ensure that
the proposed seating areas, if approved, shall remain as a convenient and
incidental use to the market facility. It is staff's opinion that to allow a
limited number of seating in market facilities only provides a convenience for
customers and will not create a situation that is detrimental to the site or
neighboring properties.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for the project.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 87-6 subject to the
following conditions:
1. Seating shall be limited to a maximum of twenty (20) persons.
2. Fire safety shall be provided to the satisfaction of the Fire
Department.
3. That the proposed seating shall be maintained per the review and
approval of the Planning Department.
4. That C.U.P. 87-6 shall not take effect until the owner and applicant
have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
5. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for the immediate suspension or
revocation of said permit.
FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific
findings and conditions of approval set forth in the staff report (or as
modified by the Commission).
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of
that decision.
