PLANNING COMMISSION RESOLUTION 1332 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-5 TO OPERATE AN AUTOMOBILE GARAGE SPECIALIZING IN AUTO ELECTRIC SYSTEMS ONLY AT 119 LA PORTE STREET WHEREAS, on March 23, 1987, an application was filed by Barry Samberg to operate a automobile garage which specializes in repair of auu) electric systems only, Planning Department Case No. C,U.P. 87-5, on property located at 119 La Porte Stroot, more particularly described as follows: Lots 5, 6 and 7 of Block 83, Arcadia Santa Anita Tract located in the City of Arcadia, County of Los Angeles, State of California as filed in Page 89 of Miscellaneous Records 15 in the County Recorder's Office. WHEREAS, a public hearing was held on April 14, 1937, at Which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for Which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and al1 yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. Th€' Commission noted that the applicant sp€'cializes in auto electric and related systems only and is a o!,!e-man operation; that based upon information submitted by the applicant he worl<s on only four to five cars a'day and three cars can be parked within the building. -1- 1332 . .. 4,That th& sit& abuts str&ets and highways ad&quat& in width and pav&m&nt ty~ to carry the kind of traffic generated by th& proposed use. . 5. Section 3. That for the foregoing r&asons this Commission grants a Conditional US& P&rmit to operat& an automobile garage specializing in &loctrical work subjoct to th& following conditions:. 1. Fir& saf&ty shall be complied with to th& satisfaction of the FirE~ Department. 2. That the use of the garage shall b& limited to auto &1&ctric and related syst&ms only. No g&nera1 automobil& r&pair work shall be allowed. 3. All automotiv& work shall be don& insid& the building. No'outsid& work shall be allowed. 4. That outdoor on-sit& parking for th& propoSed busin&ss shall bo? limited to two vehic1&s. 5. ThatC.UP. 87-5 shall not take effoct until the owner and applicant have &X&cuted a form availab1& at the Planning D&partment indicating aWar&n&ss and acceptanc& of th& conditions of approval. 6. Noncompliance with the provisions ~d conditions of tllis Conditional Use ~rmit shall constitut& grounds for the immediat& sus~nsion or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of April 14, 1987 and the following vot&: . C.U.P.87-5 April 14, 1987 Page I . PROPOSAL The subject site is developed with a new 12,000 sq. ft. industrial building divided into 10 units Which was completed in November 1986. ' The applicant is proposing to utilize a 1,000 square foot unit to operate ~Ln automobile garage Which specializes in auto electriC and related systems , only, The applicant is the solE? operator of the garage and has no employees. He has indicated that only electrical related repair work will be done; th'~re will ~ no general automobile repair conducted on the preII}ises. There are 28 parking spaces on the site. Two spaces have been allocated for the proposed 1,000 square foot unit (which complies with code requirement for an industrial use). The applicant has noted that 3 to 4 cars can be parked inside the building. Based upon the building size and configuration, stan feels a maximum of 3 cars can be located inside the building. . . Based upon inf~rmation submitted by the applicant, therE? will be an average of 4 to 5 customers a day. The proposed business hours are Monday through Saturday, 8:00 a.m. to 5:00 p.m. ANALYSIS A garage is a permitted use in the industrial zone with an approved conditional use permit. Two of the major problems thE? City has E?ncountered with automobile garages are: (1) work being donE? on automobiles outside the building and (2) the abundance of automobiles parked on the site, Because the proposed garage specializes in electrical work only and the applicant is the sole mechanic, staff feels the above concerns are mitigat?d. However, to ensure that this garage does not expand its services, staff woUld recommend that the permit be limited to a garage specializing in auto electric and related systems only (wiring harnesses, electronic engine controls, power accessories and automatic temperature control). o Pursuant to the provisions of the California Environmental Quality Act, tJle Planning Department has prepared an initial study for the proposed project. Said initial study did not dis<:lose any substantial or potentially SUbstantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise C.U.P.87-5 April 14, 1987 Page 2 . an<3 Objects of nlstorlcal or ~esUlet1C S1gnU1cance. Therefore, a Negative Declaratio~ has been prepar~ f()r this project. RECOMMENDATION The Planning Department recommends approval9f C.U.P. 87-5 subject to Ule following conditions: 1. Fire safety shall be complied with to the satisfaction of the Fire Department. 2. That Ule use of the garage shall be limited to auto electric and related systems only. No general automobile repair work shall toe allowed. 3. All automotive work shall be done inside Ule building. No outside work shall be allowed. 4. That C.U.P. 87-5 shall not take effect until Ule owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of Ule conditions of approval. . 5. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDINGS AND MOTIONS Ap-p-roval If Ule Planning Commission intends to take action to approve this project, Ule Commission should move to approve and file the Negative Declaration M.d find that the project will not have a significant effect on Ule environment and direct staff to prepare Ule .appropriate resolution incorporating the specific findings and conditions of approval set forth in Ule staff report (or as modified by Ule Commission). .
