A RESOLUTION GRANTING ZONE VARIANCE V-87-1 TO EXPAND
AN EXISTING AUTOMOBILE GARAGE WHICH IS A LEGAL NON-
CONFORMING USE ON C-2 ZONED PRO PERT V AT 635 EAST LIVE
OAK A VENUE
WHEREAS, on January 16, 19B7, an application was flied by Eric
Duyshart on behalf of Jack Kawahata to expand an existing automobile
garage which is a legal non-conforming use on C-2 zoned property, Planning
Department Case No. V-87-1, on property commonly known as 635 East Live
Oak Avenue, more particularly described as follows:

Portion of Lot 126, Arcadia Acreage Tract in the Cay of Arcadia,
County of Los Angeles, State of California as per Map Recorded in Map
Book 10, Page 18 as fi I ed in the County Recorders offi ce of sai d
County.
WHEREAS, a pUblic hearing was held on February 10, 1987, at which
time all interested persons were given full opportunity to be heard and to
present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBV RESOLVES AS FOLLOWS:
Section 1. That the factual date submitted by the Planning
Department in the attached report is true and correct.
Section 2. This Commission finds:
1. That there are exceptional or extraordinary circumstances or
condaions applicable to the property involved, or to the intended use 01' the
property, that do not apply generally to the property or class of use in the
same zone or vicinity. The subject property is unusual in that it is
surrounded on three sides by pubHc rights-of-way; the County Flood Control

wash on the east, a City public right-of-way on the north and Live Oak
Avenue on the south, which buffers the subject site from the residentilll
propert les to the north.
2. That approval of this zone variance would not be detrimental to
the public health or Injurious to the property or improvements in such :~one
or vicinity. The proposed 925 sQ. ft. addition would upgrade the proper1ly and
enhance the buil di ng appearance.
3. That such variance is necessary for the preservation and
enjoyment of II substantial property right of the applicant possessed by
other property in the same zone and vicinity. The garage Is currently
existing and the proposed addition is consistent with the existing use.
4, That the granting of such variance will not adversely affect the
Comprehensive General Plan. The automobile garage is an existing use and
the proposed addition will not change the use of the site.
Section 3. That for the foregoing reasons this Commission grants a
zone variance for the expansion of an existing automobile garage which is a
legal non-conforming use upon the following conditions:
1. That the building shall be in compliance with the plans on mE' in
the subject case.
2. Conditions as outlined below from the Department of Public Works
shall be compiled with to the satisfaction of the Director of Public Works.
a. Submit grading and drainage plan prepared by a registered civil
engineer subject to the approval of the Director of Public Works,
b. Plant parkway trees at locations determined by the Director of
Public Works per City of Arcadia Standard S-13.

c. Graylty drainage outlets and driveway aprons shall be
constructed to conform to Drawing S-I1.
d. Remoye and replace deficient or damaged curb, gutter or
sidewalk.
e. Fumish proof of a County permit for the area to be paved.
1. All survey monuments, centerli ne ties and survey ref erencl~
points shall be protected in place or reestablished where disturbed. This
work will be the responsibility of the permittee and shall be at the
permittee's expense.
3. Fire Safety shall be provided to the satisfaction of the Fire Chief.
4. That a landscape and irrigation plan shall be submitted to the
Planning Department for Its review and approval.
5. That the existing County right-of-way shall be paved and strilJed if
it is to be used for vehicle parking. The applicant shall apply to the Los
Angeles County Department of Public Works to secure permission to
landscape the northerly portion of the County's right-Of-way, If approval is
granted, landscaping shall be provided consistent with the plans on file.
6, Upon completion of the building all work on vehicles shall be done
inside the building.
7. All the employee vehicles and vehicles to be serviced by the
facility shall be parked on the premises.
8. That the parking lot shall be striped in accordance with Section
9269.8.
9. That the applicant shall be allowed to utilize two hoists outside
the building without a cover until the new building is constructed but for a

period not to exceed a maximum of six months from the date of adoption of
the Resolution. The Commission may grant a time extension if the applicant
request such time extension in writing stating reasons why a time
extension to maintain the hoists should be granted. Upon completion of the
building, the hoists must be removed immediately.
10. That the applicant shall be allowed to place a rental storagl3 bin
on the site to store his inventory and supplies until the building is
completed, but for a period not to exceed a maximum of six months from the
date of adoption of the Resolution. The Commission may grant a time
extension if the applicant request such time extension in writing stating
reasons why a time extension to maintain the storage unit should be
granted. Upon completion of the building, the temporary storage unit must
be removed immediately.
11. That there shall be a minimum of five (5) parking spaces which
comply with code provided on the subject property (not including the County
easement to the east of the subject property),
12. That the hours of operation shall be limited to 7:00 a.m. to 7:00
p.m. Monday through Saturdays.
13, That V-87-1 shall not take effect until the owner and applic13nt
have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
14. Noncompliance with the provisions and conditions of this
Conditional Use permit shall constitute grounds for the immediate
suspension or revocation of said Permit.

Section 4. The Secretary shall certify to the adoption of this
Resolution and shall cause a coPy to be forwarded to the City Council of the
City of Arcadia.

On Januery 13, 19B7 the PIllnnlng Commission approved zone Yllrlence
\I-B6-1 to add a RQ.Q square foot addition which included one new work bay
and a storage aree to the existing 1,215 sq. ft. brake shop. The eppllcant
Jack Kawahete was proposing to continue operetlon of the existing brake
shop and relocate hiS muffler shop to this locetion.
Arcedle Muffler Is currently loceted et 310 East Huntington Drlye and Is
being purchased by the Clty's Redeyelopment Agency as part of the Grlbtlle
pro J ect.
The existing brake shOp has been located on this site since 1963. It is EI
legal non-conforming use. .
The appllcant's current appllcatlon Incorporates the City owned 25'-0. s;trlp
of property north of the subject site. On January 20th the City Council
authorized staff to obtain a title report and appraisal of the surplus
property located north of the properties fronting on Liye Oek between Sixth
AVenue and the Wash. Mr. Kawahata has offered to purchase this 25'-0. strip
of property.

egOPOSAL.

The owner of Arcadia Muffler, Jack Kawahata, Is purchasing the existing
Dick's Brake Shop property and reloclltlng his muffler shOp to this site. The
existing 1,215 sq. ft. building contains three beys, an office area and a
restroom. the llppllcant is proposing to expand the building by adding am
square foot addition which w111 proYlde two new bays and a storage area.
The building is concrete block and the new addition wl11 be concrete block.
The appllcant Is proposing to paint the building and add awnings on the
front.
All the bays face to the east. The exisllng building is 14'-0. in height. The
new addition w111 be 17'-0. In height to accommodate taller yehlcles suc:h
as yans, motor homes, etc.

There lire ,five exlsttng parking spaces. Five spaces are proposed behind the
bul.1dlng; two spaces are located within the 25'-0' city-owned property
north of the subject site. The llppllcllnt is proposing to pllve the existtng
County right-of-WllY adjllcent to the east side of the property. .

Because the applicant Is under time constraints to vacate his existing
business on Huntington Driye, he is requesting permission to: (1) utilize
two hoists outside the building without a coyer until the new building is
constructed but not to exceed a mllxlmum of six months and (2) place a
rental storage bin on the site to store his Inventory and supplies untill.he
building Is completed, but not to exceed a maximum of six months.

The Plllnnlng Commission should examine the Informetion and meke findings
which ere releyant to the prerequisite conditions below: .
Section 9291.1.2 of the Arcadle Munlcipel Code states: 'Prerequlslte
Conditions: before a yerience mey be grllnted, it shell be shown:
A. That there are exceptlonel or extrllordinery circumstllnces or
conditions applicable to the property Involyed, or to the Intended
use of the property, that do not apply generally to the property or
class of use in the slime zone or vicinity,
B. That the granting of such variance will not be materially
detrimental to the public health or welfare or InjuriOus to the
property or improvements in such zone or yiclnity in which the
property Is located.
C. That such variance is necessllry for the preservation and enjoyment
of a substantial property ri ght of the app II cent possessed by other
property In the same zone end Ylcinity,

D. That the granting of such yariance wl1l not adversely affect thl3
comprehensive General Plan.

Attached for your consideration are those peges of the eppl1cetlon In which
the eppl1cents have stated their case regarding the aforementioned
prerequl sl te condl t ions.

It Is staff's opinion that the proposed addition to the garllge would upgnlde
the property and enhance the building appearance. Approval of this zone
variance would not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity (6). Mso
approval of this variance would not adversely affect the comprehenslye
general plan since the garage Is currently existing (0).
If the applicant is able to secure the surplus city property (either through
sale or by along-term lease), the Planning Department would have no
objection to the proposed addition of the two bays. However, staff does feel
it is mandatory that a m1n1lmim of five marked parking spaces which comply
with all code requirements be provided on the subject site (Including or
excluding the surplus property).

If the appl1cant Is able to secure written permission from the Los Angeles
County Public Works Deportment to pove the County right-of-woy which is
located to the east of the subject property, staff would recommend that the
area not only be paved but striped in accordance with our parking
regulations. Also, if possible the applicant should secure permission to
lllndscape the northerly portion of the County right-of-way, consistent with
the plans on file,
In this part{cular case, staff has no objections to the temporary use of the
outdoor hoists or the rental storage unit until the building is completed or
for a period of not to exceed six months. If the building is not completed
within six months staff would recommend that the applicant be required to
secure approval from the Planning Commission for the continued use of the
temporary hoists and storage unit. Both the outdoor hoists and the
temporary storage unit must be removed when the building is completed.
Pursuant to the provisions of the California EnYironmental Quality Act, the
Planning Department has prepered an Initial study fpr the proposed project.
Said initial study did not disclose any substantial or potentially Bubste/IUal
adverse change In any of the physical conditions within the area affected by
. the project Including land, air, water, minerals, flora, fauna, ambient nOllse

and Objects of hIstorical or aesthetic sIgnIfIcance. Therefore, a NegatlYe
DeclaratIon has been prepared for thIs project.

The PlannIng Deportment recommends opproyol of 1,1-67-: 1 subject to the
followIng conditIons
I. That the buildIng shall be In compliance wIth the pIons on file In the
subject case.
2. CondItIons as outlined In the attoched report from the Deportmllnt

(Expansion of an Existing Auto~bile Brake Shop)
In response to your memorandum, the item(s) which this department has concern
or special knowledge of are listed below:
1. The existing parkway width is twelve (12) feet:
2. The subject property is served by a sewer line that has the Ca!lacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system.
The existing 25' strip, bordering the said property on the north, is owned in
fee by the City and is currently being appraised. It will beavai'lable for
purchase in the near future.
The following conditions of approval are recommended:
1. Submit grading and drainage plan prepared by a registered civil engineer
subject to the approval of the Director of Public Works.
. 2. Plant parkway trees at locations determined by the Director of Public
Works per City of Arcadia Standard $-13.
3. Remove and replace deficient or damaged curb, gutter or sidewalk.
4. Gravity drainage outlets, and driveway aprons shall be constructed to
conform to Drawing S-ll.
5. Proof of a County permit, for the area to be paved, must be furnished.
NOTE: All survey monuments, centerline ties and survey reference points shall
be protected in place or re-established where disturbed. This work
wi 11 be the responsibi lity of the permittee and shall be at the
permittee's expense.
The above items are to be complied with to the satisfaction of the Dir'ector of
