RESOLUTION 1410 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 89-006 TO EXPAND THE CURRENT PRESCHOOL TO 35 CHILDREN AND TO INCLUDE A FULL-TIME SCHOOL FOR 80 STUDENTS (KINDERGARTEN THROUGH 10TH GRADE) WITHIN THE EXISITNG FACILITIES AT 805 N. FIRST AVENUE. WHEREAS, on May 1, 1989 an application was filed by Victory Chapel, to expand the current preschool to 35 children and to include a full-time school for 80 students (kindergarten through 10th grade) within the existing facilities, Planning Department Case No. c.u.P. 89-006, on property commonly known as 805 N. First Avenue, more particularly described as follows: The area bounded by Forest Avenue on the north, First Avenue on the east, and the Foothill Freeway on the southwest, except Lots 74, 75 and 76 of Tract 7820, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 29, Pages 68 of Maps, in the Office of the County Recorder of Said County. . WHEREAS, a public hearing was held on May 23, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper llse for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. . 1410 -1- . 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to expand the current preschool to 35 children and to include a full-time school for 80 students (kindergarten through 10th grade) within the existing facilities, upon the following conditions: 1. That 35 shall be the maximum number for pre-school enrollment and 80 shall be the maximum for first through tenth grade enrollment. 2. That room and building occupancy limits, as determined by the Arcadia Fire Department shall be posted and complied with at all times. 3. That a central station fire alarm system shall be installed and maintained in operating condition by the applicant to the satisfaction of the Fire Department. 4. That traffic signs alerting drivers to the presence of children and to reduce speed shall be provided at the applicant's expense at locations to be specified by the Public Works Department. 5. That if students walk or bicycle to get to and from school, the applicant shall provide the necessary crossing guard(s). 6. That the applicant either provide evidence of, or execute and record, a covenant holding all of the church property, except 721 N. First Avenue, as one parcel. 7. That the masonry wall between the adjacent residential properties and the Church property be repaired as needed, and maintained at a minimum height of six feet. . . 8. That an 8 foot barrier be provided and maintained behind the residences along First Avenue. 9. That any play areas be 50 feet away from the residences along First Avenue, with the exception of the church owned property. 10. That an 8 foot high gate, which can be locked, be provided and utilized between the freeway fencing and the southwest comer of the masonry wall behind the residence at 701 N. First Avenue. 11. That all drop-offs and pick-ups of children be conducted on-site at the northerly portion of the parking lots and none are to occur along the public rights-of way. 1410 -2- 12. That the subject site shall be maintained as per the plans on file with the Planning Department. 13. That c.u.P. 89-006 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 14. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of May 23, 1989 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None Section S. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Kasama, Assistant Planner SUBJECf: Conditional Use Permit No. 89-006 SUMMARY This application was filed by the Victory Chapel to expand the preschool, and add an elementary through junior high school at the existing church facilities at 805 North First Avenue. The Planning Department is recommending approval subject to the conditions outlined in this report. GENERAL INFORMATION APPLICANT: Clayton Robinson, Pastor Victory Chapel 805 North First Avenue LOCATION: REQUEST: A conditional use permit to expand the current preschool to 35 children and to Include a full-time school for 80 students (kindergarten through lOth grade) within the existing facilities. LOT AREA: 77,783.6 square feet (1.79 acres) 193.01 feet and 108.26 feet along North First Avenue 218.40 feet along East Forest Avenue FRONTAGE: EXISTING LAND USE & ZONING: Church and preschool, zoning is R-2 SURROUNDING lAND USE & ZONING: North: Single family residences, R-1 South: Foothill Freeway, not zoned East: Single & multiple family residences, R-2 West: Single family residences, R-2 GENERAL PLAN DESIGNATION: SF-6, 0 to 6 dwelling units per acre . .. . HISTORY The church was constructed in 1963. prior to the requirement for a conditional use permit. In 1967, CUP 67-8 was granted to operate a pre- school for 40 children. In 1976. CUP 76-8 was granted to expand the parking lot and operate a pre-school for 15 children. In 1979. CUP 79-11 was granted to expand the church facilities with the construction of the annex and class- room buildings. PROPOSAL AND ANALYSIS The applicant is requesting this conditional use permit to operate a preschool for 35 children. and an elementary and junior high school for 80 students. The subject property, which is one parcel by virtue of a consolidation covenant. Is at the southwest comer of North First and East Forest Avenues and backs up to the Foothill Freeway. The proposal states that operating hours will be from 7:00 a.m. to 6:00 p.m. Monday through Friday. The applicant is not proposing any parking or land- scaping improvements. The proposed daily schedule is as follows: Time 7:00 a.m. 8: 15 a.m. 8:30 a.m. 9:30 - 10:10 a.m. 10: 10 - 10:30 a.m. 12:15 - 1:15 p.m. ActivHy drop-offs begin. children will be entertained indoors assembly for flag raising classes begin recess for preschoolers and kindergartners recess for first through tenth graders lunch - preschoolers and kindergartners eat indoors and nap afterward classes end outdoor recreation for extended day care children indoor study hall for extended day care children all children should have been picked-up by their parents 3:00 p.m. 3:00 - 4:30 p.m. 4:30 - 6:00 p.m. 6:00 p.m. There are six single family residences adjacent to the site. The house nearest the school building is owned by the Church. In 1976. CUP 76-8 requLTed that six foot high walls be constructed between these properties and the Church's property. These walls are in place. but. are in need of some maintenance. The applicant feels that the above schedule will minimize the impacts that the school will have upon the immediately adjacent residences. The 80 on-site parking spaces are adequate for the operating of a school. Drop-offs and pick-ups are to be conducted at the north end of the parking lot. Church staff will park in the spaces closest to Forest Avenue and School staff CUP 89-006 May 23, 1989 Page 2 . . . will park at the southern end of the parking lot. This will leave the larger. middle portion of the parking lot open for recesses and lunch time. The conducting of a full-time school at this location will have some impact on the traffic along First Avenue. However. since this street is already a through arterial. the additional traffic due to morning drop-offs and evening pick-ups can readily be accommodated. Nevertheless. having children in the area does increase the traffic hazards. Additional street signs should be provided to alert drivers to the presence of children and indicate a reduced speed limit. Also. if any of the children walk or bicycle to the school. crossing guards should be provided. Pursuant to the provisions of the California Environmental Quality Act. the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land. air. water. minerals. flora. fauna. ambient noise and objects of historical or aesthetic significance. Therefore. a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No. 89-006 subject to the follOwing conditions: 1. That 35 shall be the maximum number for pre-school enrollment and 80 shall be the maximum for first through tenth grade enrollment. 2. That room and building occupancy Umtts. as determined by the Arcadia Fire Department. shall be posted and complied with at all times. 3. That a central station fire alarm system shall be installed and maintained in operating condition by the applicant to the satisfaction of the Arcadia Fire Department. 4. FINDINGS AND MOTIONS Aooroval If the Planning Commission intends to take action to approve Conditional Use Permit No. 89-006, the Commission should move to approve and file the Neg- ative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare tlle appropriate resolution incor- porating the specific findings and conditions of approval set forth in the staff report or as modified by the Commission. Denial If the Planning Commission intends to take action to deny Conditional Use Permit No. 89-006, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of tllat decision. There will be additional noise due to the school activities. In particular will be the noise of children playing during recesses and lunch times. Such noise should not be of an extreme nature and can be limited by the staggering of recess and lunch schedules. Also, the noise will not be constant and may no1 actually increase the noise level in the area. The adjacent Foothill Freeway generates the most noise in the area and the additional noise of the school activities will probably not be greater than the existing noise level. 13. Transoortation/Circulation. Will the proposal result in: a Generation of substantial additional vehicular movement? The school will increase the traffic in the area during morning drop.offs and evening pick- ups. The site has adequate on-site area available for such activities, as well as, curbside parking lanes on both adjacent streets. First Avenue is a north-south arterial and is adequate to serve the additional traffic. The proposed project is consistent with the City's General Plan and Zoning Ordinance and should not have a significant effect upon 1he existing transportation systems. d Alterations to present patterns of circulation or movement of people and/or goods? It is anticipated that the students of this school will be from this community, themfore, the traffic drawn to this site will only result in a rerouting of existing vehicular movements. Therefore, the proposal will not result in any adverse affects. f. Increase in traffic hazards to motor vehicles, bicyclists or pedestrians? The additional 1raffic drawn 10 the school could increase the traffic hazards in this area. Such an Impact can be ameliorated by the posting of warning signs along First Avenue to alert drivers to the presence of a school and the children. A crossing guard could also be a mitigating factor. However, such may not be warranted since the amount of bicycle and pedestrian traffic drawn' to the school could be nil since the enrollment of a private school is not necessarily from the immediate neighborhood and most of the students may arrive by car. - 3- .
