A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 89-005 FOR A RESIDENT MANAGER'S APARTMENT WITHIN A SELF STORAGE FACILITY AND TO CONSTRUCT A BUILDING CONTAINING MORE THAN 20,000 SQ. Fr. WITHIN 100 FEET OF RESIDENTIALLY ZONED PROPERTY AT 10-16 W. LIVE OAK A VENUE. WHEREAS, on April 17, 1989 an application was filed by Icon Companies, Inc., for a resident manager's apartment within a self storage facility and to construct a building containing more than 20,000 sq. ft. within 100 feet of residentially zoned property, Planning Department Case No. C.U.P. 89-005, on property commonly know as 10-16 W. Live Oak Avenue, more particularly described as follows: Lots 5 & 6 in Block A of Tract No. 10898 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 189,Pages 42-43 of Maps, in the office of said County Recorder. . WHEREAS, a public hearing was held on May 9, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, lHEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such conditional use permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a conditional use permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such conditional use permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a resident manager's apartment within a self storage facility and to construct a building containing more than 20,000 sq. ft. within 100 feet of residentially zoned property, upon the following conditions: . 1409 -1- . 1. The following conditions from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. A. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works. B. Existing parkway trees in good condition shall remain. C. Driveway on Live Oak Ave. shall be located so as not to conflict with mature parkway trees. D. Close existing driveways not to be used and reconstruct curb, gutter and sidewalk to match existing. E. Remove and replace deficient or damaged curb, gutter or sidewalk. F. Construct P.c.c. driveway apron according to Arcadia Standard Drawing No. 5-n. G. All public works improvements shall be completed to the satisfaction of Director of Public Works prior to final acceptance by Building and Safety Department and prior to occupancy. H. All survey monuments, centerline ties and survey reference point shall be protected in place or re-established where disturbed. this work will be the responsibility of the permittee and shall be at the permittee's expense. 2. Fire protection, building occupancy and water requirements shall be maintained to the satisfaction of the Arcadia Fire Department. Note that the project is not in Arcadia's service area. 3. That a restrictive covenant, or other appropriate agreement as deemed necessary by the City Attorney and Planning Department, be recorded to insure that the proposed building shall remain self storage as per the plans on file and that it shall not be subdivided for individual industrial users or used as an industrial warehouse or have any office or retail square footage unless parking is provided as required by the Arcadia Municipal Code. Also, any change in use shall comply with all other pertinent zoning regulations. This shall be completed prior to the issuance of building permits. 4. Outdoor storage of any kind shall be prohibited unless a conditional use permit is granted. 5. That the manager's unit shall be occupied only by the manager who is employed to manage the self storage facility and his/her family. 6. A modification shall be granted for 3 parking spaces in lieu of 91 spaces. 7. A 6'-0" high masonry wall shall be constructed along th rear property line. Height of the wall shall be measured from the lowest adjacent grade. 8. A landscape and irrigation plan shall be submitted to the Planning Department for review and approval prior to issuance of building permits. A minimum of ten 15 gallon trees shall be required. 9. The subject site shall be maintained as per the plans on file in the Planning Department. 10. That c.u.P. 89-005 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. . . 1409 -2- . 11. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of May 9, 1989 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. WONG, ASSOCIATE PLANNER CASE NO.: C.U.P. 89-005 SUMMARY This Conditional Use Permit application was filed by Icon Companies for a resident manager's apartment within a self storage facility and to construct a building; containing more than 20,000 square feet within 100 feet of residentially zoned property at 10-16 West Live Oak Avenue. The Planning Department is recommending approval. GENERAL INFORMATION APPLICANT: Icon Companies LOCATION: 10-16 West Live Oak Avenue REQUEST: Conditional Use Permit for a resident manager's apartmlmt within a self storage facility and to construct a building containing more than 20,000 square feet within 100 feet of residentially zoned property LOT AREA: Approximately 43,875 square feet (1.01 acre) FRONTAGE: 160.27 feet on Live Oak Avenue EXISTING LAND USE & ZONING: The site is developed with a bar, restaurant and a single-family dwelling; zoned CoM . SURROUNDING LAND USE & ZONING: North: Automobile service station and commercial retail center; zoned C-2 Multiple-family dwellings; zoned R-2 (Temple City) Commercial retail; zoned C-2 (Temple City) Mixed commercial; zoned CoM South: East West: GENERAL PLAN DESIGNATION: Commercial PROPOSAL AND ANALYSIS The applicant is proposing to construct a 47,378 square foot self storage facility consisting of two buildings with an office and resident manager's apartment. Excluding the office and apartment 44,978 square feet will be available for storage. Each building will be two-stories 25'-0" in height. The outer building will be 15,138 square feet and the inner building 32,240 square feet. The buildings will have a stucco finish using the colors silver gray and blush. 1 1/2" wide white channels will be used to separate the colors. A white trim cap will be . used on top of the building walls. The roll up doors will be gray. A minimum 17'-6" landscaped front yard setback will be maintained and a 25'-0" rear yard will separate the buildings from the residentially zoned property to the south. Parking spaces will be buffered from the street by a 5'-0" wide landscaped area. The City's Zoning Ordinance does not address parking requirements for self storage buildings, Industrial uses require two parking spaces per 1,000 square feet of gross floor are. Based upon this standard 91 parking spaces would be required. Three parking spaces are proposed at the entry of the facility. In April 1985 the Planning Department contacted nine cities which had self storage facilities ranging in size from 70,000 to 180,000 square feet. Parking ranged from 5 to 11 spaces for these buildings. It was the opinion of each of these cities that the parking was more than adequate for the use. Since 1985 the City of Arcadia has approved three self storage facilities with resident managers. The Planning Department has not received any complaints about parking, nor has staff observed any parking problems. . CUP 89-005 5/9/89 Page 2 . . . 5630 Peck Rd. 153,775 square feet 5 parking spaces CUP 85-14 Lower Azusa Rd. 62,800 square feet 11 parking spaces CUP 85-23 SW Comer Colorado Blvd & Second Ave. 23,965 square feet 3 parking spaces CUP 86-9 In each of these cases to insure that the buildings could not be converted to any other type of use, a restrictive covenant has been recorded which prohibits other uses unless parking is provided per code. A storage facility is a permitted use in the CoM zone. A conditional use permit is required due to the manager's apartment and one of the buildings containing more than 20,000 square feet within 100 feet of residentially zoned property, It is staffs opinion that this is an appropriate use for the site and less intense than most industrial and commercial developments. Parking needs are limited to persons paying bills and inquiries. Loading and unloading is done at the storage unit. Pursuant to the provisions of the California Environmental Quality Act, the Plan- ning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ARCHITECTURAL DESIGN REVIEW Concurrent with the consideration of this modification, the Planning Commission may approve, conditionally approve or deny the applicant's design concept plans. Staff believes that the applicant's proposal complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. CUP 89-005 5/9/fJJ Page 3 . . .. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 89-005 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. Fire protection, building occupancy and water requirements shall be maintained to the satisfaction of the Arcadia Fire Department. Note that the project is not in Arcadia's service are. 3. That a restrictive covenant, or other appropriate agreement as deemed necessary by the City Attorney and Planning Department, be recorded to insure that the proposed building shall remain self storage as per the plans on file and that it shall not be subdivided for individual industrial users or used an an industrial warehouse or have any office or retail square footage unless parking is provided as required by the Arcadia Municipal Code. Also, any change in use shall comply with all other pertinent zoning regulations. This shall be completed prior to the issuance of building permits. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve Conditional Use Permit 89-005, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial . If the Planning Commission intends to take action to deny Conditional Use Permit 89-005, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and supporting findings. The Planning Commission may wish to consider the following motions and findings which should be expanded upon with specific reasons for denial: 0.1 Find that the granting of this conditional use permit will be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 0.2 Find that the use applied for at the location indicated is not properly one for which a conditional use permit is authorized. 0.3 Find that the site for the proposed use is not adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to' adjust said use with the land and uses in the neighborhood. 0.4 Find that the site abuts streets and highways inadequate in width and pavement type to carry the kind of traffic generated by the proposed use. 0.5 Find that the granting of this conditional use permit will adversely affect the comprehensive general plan. . CUP 89-005 5/9/89 Page 5 . 0.6 Find that the location and configuration of the structures are not visually harmonious with their sites and with surrounding sites and structures, and that the structures dominate their surroundings to an extent inappropriatE' to their use. 0.7 Find that the architectural design of the structures and their materials and colors are not visually harmonious with surrounding development. 0.8 Find that the plans for the landscaping of open spaces do not conform to the requirements set forth in the code, and that they do not provide visually pleasing settings for structures on the site and on adjoining and nearby sites and conflict with the natural landscape. 0.9 Find that the design and location of signs and their materials and colors are not consistent with the character and scale of the buildings to which they ilJ'e attached or which are located on the same site, and that the signs are not visually harmonious with surrounding development. 0.10 Find that the architectural design does not enhance the visual environment of the city, preserve and protect property values and mitigate against degradation and depreciation. .. 0.11 Find that the proposal does not promote and protect the health, safety, comfort and general welfare of the community and does not promote the standards of appearance in the community or encourages the appropriate use of land within the City. 0.12 Find that the project contains expanses of flat building walls which needs additional architectural indentations and/or projections so as to provide opportunity for shade, shadow, and visual relief. .
