RESOLUTION 1408
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL
USE PERMIT 89-004 TO EXPAND AN EATING
ESTABLISHMENT AT 27 & 29 WEST LAS TUNAS DRIVE.
WHEREAS, on April 6, 1989, an application was filed by Edmund and Lai
Wan Li Lowe to expand an eating establishment, Planning Department Case No.
c.u.P. 89-004, on property commonly known as 27 & 29 West Las Tunas Drive, more
particularly described as follows:

WHEREAS, a public hearing was held on May 9,1989, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOL YES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2, That the use applied for at the location indicated is properly one for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate an eating establishment upon the following
conditions:

1. Seating shall be limited to a maximum of 24 people.
2. A modification shall be granted for 285 parking spaces in lieu of 357 spaces.
This shall only be for the use approved by CUP 89-004, and does not constitute a
general reduction in parking for the total site.
3. A modification shall be granted for 3% landscaping in the parking area in
lieu of 5%. This shall only be for the use approved by CUP 89-004, and not for any
other new or changed uses on the site.
4. An automatic hood and duct fire extinguishing system shall be installed to
the satisfaction of the Arcadia Fire Department.
5. The subject site shall be maintained as per the plans on file in the Plan-
ning Department.
6. CUP 89-004 shall not take effect until the property owner and applicant
have executed the form available at the Planning Department indicating awareness
and acceptance of the conditions of approval.
7. Noncompliance with the provisions and conditions of this Conditional Use
Permit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of May 9, 1989 and the following vote:
A YES: Commissioners Amato, Clark, Hedlund, Papay and Szany

ABSENT: None
SECTION 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

the City of Arcadia, County of Los Angeles, State of California, Book 42,
page 87 of Miscellaneous Records, in the office of the County Recorder,
described as follow s:
Beginning at a point in the easterly line of said Lot 66, in the westerly
line of Janta Anita Avenue. 100 feet wide, as shown on said map distance
south 0 00' 15" wes~ 235 feet thereon from the northeast corner of said Lot
66; thence North 89 59' 30" west parallel with the northerly line of said
lot. 150 feet to a line that is parallel with and distant westerly 150 feet,
measured at right angles from the easterly line of said lot 66; thence South

GENERAL PLAN DESIGNATION:

. BACKGROUND
The applicants were granted CUP 89.001 in March to operate an eating establish.
ment with tables and seating for twelve (12) people at 27 West Las Tunas Drive.
Since that approval. the adjacent commercial space has become available and they
are therefore requesting approval of a larger eating establishment.
This business (Chow To Go) is currently operating at 16 West Live Oak Avenue.
The applicants expect to move their business sometime in June or July of this year.
PROPOSAL AND ANALYSIS
The applicants are requesting this conditional use permit. and parking and
landscaping modifications to expand an approved eating establishment and provide
tables and seating for 24 people.
The business is Intended to be primarily a take-out service, which would be con-
sidered a retail use, with the seating as a convenience. According to the Code. the
addition of any tables to the business changes it from a retail activity to an eatlgg
establishment which requires a conditional use permit. This technically rnord
intense use also requires that parking and landscaping be brought into compliance
with current standards.

The expanded eating establishment will contain approximately 2,450 square feet
and will be one of several accessory commercial uses at this shopping center. This
center has frontages on both Las Tunas Drive and Santa Anita Avenue. The uses
and required parking in this center are as follows:

The parking modification is to permit the expansion of the eating establishment
with the existing 285 on-site spaces in lieu of the 357 required for the combined
uses of the center.
A Variance (V 67-1) and a Conditional Use Permit (CUP 67-9) were approved in
1967 to permit development of the shopping center with a 25 space deficiency.
CUP 89-001 increased the deficiency to 54 spaces. This new request will raise the
deficiency to 72 spaces.
As of this date. Staff has not received any complaints, nor observed any parking
problems at this shopping center. lt is unlikely that the proposed eating estab-
lishment, expanded to permit seating for 24 people. would result in an excessive
parking demand.
The Planning Department feels the retail parking requirement of 5 spaces per
1.000 square feet is adequate for the limited seating within this eating establish-
ment. The seating Is not detrimental to the site or surrounding businesses, and is
a desirable convenience for customers.

A
CUP 67-9 required that 3 percent of the parking area be landscaped, and It ..
appears that such has been maintained. The current Code requires landscaping of
5 percent of commercial parking areas. Installation of new landscaping would be a
burdensome requirement for the minor change in use requested by the applicant.
The landscape modification Is for the existing 3 percent landscaping in lieu of 5
percent.
Pursuant to the prOVisions of the California EnVironmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial
study did not disclose any substantial or potentially substantial adverse change In
any of the physical conditions within the area affected by the project including
land, air, water. minerals. flora. fauna, ambient noise and objects of historical or
aesthetic significance. Therefore, a Negative Declaration has been prepared for
this project.
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit No,
CUP 89-004 subject to the following conditions:
1. Seating shall be limited to a maximum of 24 people.
2. A modification shall be granted for 285 parking spaces in lieu of 357 spaces.
This shali only be for the use approved by CUP 89-004, and does not consti-
tute a general reduction in parking for the total site.

Approval

ative Declaration and find that the project will not have a significant effect on the
environment and direct staff to prepare the appropriate resolution incorporating the
specific findings and conditions of approval set forth in the staff report. or as modi-
fied by the Commission.
