RESOLUTION 1407 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 89-003 TO OPERATE AN EATING ESTABLISHMENT WITH SEATING FOR 6 PERSONS AT 529 E. LIVE OAK AVENUE, UNIT B. WHEREAS, on March 29,1989 an application was filed by Robert and Christina Jenkins, to operate an eating establishment with seating for 6 persons, Planning Department Case No. CU.P. 89-003, on property commonly know as 529 E. Live Oak Avenue, Unit B, more particularly described as follows: SEE EXHIBIT "A" . WHEREAS, a public hearing was held on April 25, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such conditional use permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a conditional use permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such conditional use permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit 0 operate an eating establishment with seating for 6 persons, upon the following conditions: 1. Seating shall be limited to a maximum of six (6) persons. 2. A modification shall be granted for 27 parking spaces in lieu of 35 parking spaces. This approval shall not constitute an approval for a reduction in parking for the entire retail center/automobile service station. Rather, this parking modifiction shall only be for the eating establishment approved by CUP 89-003. . - I - 1407 . 3. Fire protection and building occupancy shall be maintained to the satisfaction of the Arcadia Fire Department. 4. Any changes in water service shall be installed by the Arcadia Water Division at the applicant's expense. Also, backflow protection may be required, subject to field inspection by the Water Division. 5. The subject site shall be maintained as per the plans on file in the Planning Department. 6. That Cu.P. 89-003 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 7. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of April 25, 1989 and the following vote: AYES: Commissioners Amato, Hedlund, Szany, Papay NOES: None ABSTAIN: Commissioner Clark Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. WONG, ASSOCIATE PLANNER CASE NO.: c.u.P. 89-003 SUMMARY This Conditional Use Permit application was filed by Robert and Christina Jenkins for an eating establishment with seating for six people at 529 East Live Oak Avenue, #B. The Planning Department is recommending approval. GENERAL INFORMATION APPLICANT: Robert and Christina Jenkins . LOCATION: 529 East Live Oak Avenue, #B REQUEST: Conditional Use Permit for an eating establishment with seating for 6 people. Parking modification required. LOT AREA: Approximately 24,000 square feet (.55 acre) FRONTAGE: 137.44 feet on Live Oak Avenue 139.27 feet on Sixth Avenue EXISTING LAND USE & ZONING: Automobile service station and a 3,600 square foot retail building; zoned C-2 SURROUNDING LAND USE & ZONING: North: South: East: West: Multiple-family dwellings; zoned R-3 Mixed commercial; zoned C-2 Church; zoned C-2 Multiple-family dwellings; zoned R-3 . . . . GENERAL PLAN DESIGNATION: Commercial/Multiple-family residential BACKGROUND The City Council at its May 6,1986 meeting approved CUP 86-2 (on appeal from the Planning Commission denial), a request to reconstruct the garage portion of an existing automobile service station and construct a 3,600 square foot retail building at 529 East Live Oak Avenue PROPOSAL AND ANALYSIS The applicants are requesting a conditional use permit so that seating for 6 people could be added to an existing take-out only food business (ice cream and yogurt). Seating for 6 people presently exists within the building. It appears that one of the two previous owners had been using 3 tables and 6 chairs without applying for a conditional use permit. The applicants recently purchased the business and were informed about the seating restrictions. The business occupies 500 square feet (14%) of the 3,600 square foot retail building. A take-out food business is permitted without a conditional use permit. By adding tables with chairs the business changes from a retail activity to an eating establishment which requires a conditional use permit. When the site was developed 18 parking spaces were required for the retail building, 9 spaces were added for the garage and 1 loading space was provided (total 27 spaces and 1 loading). A retail business requires 5 parking spaces per 1,000 square feet of gross floor area, but an eating establishment needs 20 spaces per 1,000 square feet. Due to the difference in required parking, the proposed eating establishment increases the required parking for the entire center to 35 spaces. Following is a parking survey conducted by the Planning Department which shows the number of parking spaces used, if the loading space is occupied and other vehicles parked on the site but not in designated spaces. Vehicles were not counted if they were parked in front of the service bays. Note that in every case some cars were found to be not parked in designated spaces. These cars were being offered for sale which is not permitted under CUP 86-2. The owner of the property has been informed about this situation. c.u.P. 89-003 4/'25/89 Page 2 . It is staff's opinion that by limiting the seating, which is not done for the typical eating establishment (Burger King, McDonalds, etc.), this eating establishment would not be detrimental to the site or the surrounding properties. The parking impacts from this one eating establishment with 6 seats within this shopping center is by itself not significant. Since 1982 there have been numerous conditional use permits approved for ,eating establishment with limited seating. In most cases the Planning Department has reconunended that the maximum seating be limited to 12 persons. By restricting the seating within these eating establishments the Planning Department feels the parking requirement for a retail business of 5 spaces per 1,000 square feet is adequate. '. The Planning Department is concerned with the potential increase in traffic which may result from certain retail uses which may locate on this site. Uses such as eating establishments and restaurants require conditional use permits and traffic issues can be addressed as part of the consideration of such applications. Other uses such as convenience stores do not require conditional use permits and would be pennitted even though they generally are associated with increased vehicular traffic. At this C.U.P.89-o03 4/'25/89 Page 3 . . .. time we do not know all of the intended uses for this shopping center. Three stores are presently occupied (glass & mirrors, cleaners and ice cream/yogurt), a deli/market is going through tenant improvements and two storefronts are empty. While the Planning Department is recommending approval of this particular conditional use permit, we believe that before any other applications for eating establishments, restaurants or other uses which require a conditional use pem\it are considered for this center, a traffic study prepared by a licensed engineer should be submitted along with the conditional use permit application. Such traffic study would examine the cumulative impacts from all planned or anticipated uses. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 89-003 subject to the following conditions: 1. Seating shall be limited to a maximum of six (6) persons. 2. A modification shall be granted for 27 parking spaces in lieu of 35 parking spaces. This approval shall not constitute an approval for a reduction in parking for the entire retail center/automobile service station. Rather, this parking modification shall only be for the eating establishment approved by CUP 89-003. 3. Fire protection and building occupancy shall be maintained to the satisfaction of the Arcadia Fire Department. 4. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve Conditional Use Permit 89-003, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission.
