A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, DENYING WITH
FINDINGS TENTATIVE PARCEL MAP 89-04 A PROPOSAL TO
CREATE TWO LOTS FROM ONE LOT AT 331 NORTH OLD
RANCH ROAD
WHEREAS, on February 21, 1989 an application was filed by Romani
Construction to create two lots from one lot at 331 North Old Ranch Road, Planning
Department Case No. Tentative Parcel Map 89-04, more particularly described as
follows:
Lot 20 of Tract 11215 in the City of Arcadia, County of Los Angeles, State of
California as per map recorded in Book 1998, Page 28 of Maps, in the Office of
the County Recorder
of said County.

WHEREAS, public hearings were held on March 14 and April 11, 1989, at
which time all interested persons were given full opportunity to be heard and to
present evidence;
WHEREAS, as part of the record, the Planning Commission reviewed and
considered:
a. The staff report and related attachments.
b. All oral presentations, written material received and testimony made
during the public hearings on March 14 and April 11, 1989.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the Planning Commission votes 5-0 to deny T.P.M. 89-004
based upon the findings set forth in the following section.
Section 2. The requested subdivision injuriously affects the neighborhood
wherein said lot is located for the following reasons: The existing lot fronts on Old
Ranch Road; the proposed lot split would change the configuration of the lot and
the new lots would front on San Simeon Road. Although both the proposed lots
meet the minimum lot size requirement of R.O 15,000, the reconfiguration of the
lots to front on San Simeon Road creates a setback problem along Old Ranch Road
which is totally incompatible with the existing neighborhood. All the existing
homes on Old Ranch Road are set back at least 50 feet from the property line. The

two homes to the south are set back 100:!:' from Old Ranch Road. A new home on
the proposed corner lot could be built within 20'-0" of the Old Ranch Road property
line. If the developer were allowed to build a home projecting 30'-0" beyond the
established setbacks for the other homes along Old Ranch Road, it would create
visual discontinuity. The Commission felt that the proposed lot split would change
the character of the street and the neighborhood and that a 20'-0" side yard setback
for a new home on the corner lot was inappropriate and thought that the open space
should be retained in the area.
Section 3. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of April 11, 1989 and the following vote:

Section 4. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia,

The applicant is proposing to create two new lots with the following lot

The property is located in the Rancho Santa Anita Residents Homeowners
Association (Lower Rancho); any new dwellings will be subject to review and
approval by the Homeowners Association's Architectural Review Board.
The Lower Rancho is the only association area which has never had tree
preservation requirements in its design overlay resolution.

The existing lot fronts on Old Ranch Road. The proposed lots will front on San
Simeon Road (narrowest street frontage of each lot), thus the existing front yard will
become a side yard for proposed Lot 1 which requires less of a setback. Conversely,
the existing side yard along San Simeon Road will become the front yard which
requires a greater setback than what is existing.
Because Lot 1 fronts on both Old Ranch Road and San Simeon Road and is
considered a reverse comer lot staff recommends that the house be designed so that
both the Old Ranch Road elevation and San Simeon Road elevation are
architecturally consistent.
Because of the numerous mature trees on the lot, a tree preservation wilI be
required. Staff is recommending that, at a minimum, the following trees should be
saved: the 34" Chinese Elm located approximately 25=1=' from the Old Ranch Road
property line; the 10" magnolia tree located at the comer of Old Ranch Road and San
Simeon; the 30" cedar adjacent to the San Simeon Road property line; and the 18"
pepper tree adjacent to Old Ranch Road. Homes should be designed so as to retain
all of the above trees.
All trees within the 12' wide City parkway along Old Ranch Road and San Simeon
Road must be retained unless approval for tree removal is obtained from the Public
Works Department.
Attached is a letter from Donald and Elizabeth Gammell, previous owners of the
property at 314 North Old Ranch Road in opposition to the proposed parcel map.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. Therefore, a Negative Declaration has beE!n
prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of TPM 89-04 subject to the
following conditions:
1. Conditions as outlined in the attached report from the Department of Public
Works shall be complied with to the satisfaction of the Director of Public
Works,
2. Water service shall be provided to the satisfaction of the Water Manager.

3. That a tree preservation plan identifying by size and type all trees with a
diameter in excess of 6" which are to be removed and which are to be saved
including the 34" Chinese Elm located approximately zsi:' from the Old
Ranch Road property line; the 10" magnolia tree located at the comer of Old
Ranch Road and San Simeon; the 30" cedar adjacent to the San Simeon Road
property line; and the 18" pepper tree adjacent to Old Ranch Road shall be
presented to the Planning Department for its review and approval priQIJ,g,
the issuance of a jp'adinlJ permit.

4. U the homes exceed 5,000 sq. ft., said homes shall be fire sprinklered to the
satisfaction of the Fire Department.
5. That the house on proposed lot 1 shall be designed so that the elevations on
Old Ranch Road and San Simeon Road are treated architecturally consistent
and said plans shall be submitted to the Planning Department for its review
and approval.
6. That building permits will not be issued for said project until a Rough
Grading Certificate certifying that all grading has been done in substantial
compliance with the final grading plan approved by the City Engineer has
been received and approved by the City Engineer.
7. That a Final Grading Certificate certifying that all finish grading operations
have been completed in substantial compliance with the final grading plan
approved by the City Engineer has been received and approved by the City
Engineer.
8. That Tentative Parcel Map 89-01 shall not take effect until the owner and
applicant have executed a form available at the Planning Department
indicating awareness and acceptance of the conditions of approval.
EINDINGS AND MOTION
Approval

A.l Find that the project together with the provision for its design and
improvement is consistent with the Arcadia General Plan.
A.2 Move to approve and file the Negative Declaration and find that the
project will not have a significant effect on the environment.

In response to your memorandum, the item(s) which this department has concern
or special knowledge of are listed below:
1. The existing parkway widths are twelve (12) feet on San Simeon Road and
twelve (12) feet on Old Ranch Road.
2, Traffic volume will be increased, but there will be no major impact.
3. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system,
The following should be made conditions of approval of the proposed
subdivision:
1, The preparation and recordation of a parcel map in accordance with the
requirements of the State Subdivision Map Act. The map shall be submitted
to the County Engineer for checking, and after checking, the County
Engineer's letter recommending approval and map shall be submitted to the
City Engineer for map certification.
Removal of buildings, structures, and fences from the property shall be
arranged with the Director of Public Works to his satisfaction,
Install six inch VCP sewer lateral to property line to service proposed
Lot 2.
Existing parkway trees in good condition shall remain.

protected in place or re-established where disturbed. This work will be

The above items are to be complied with to the satisfaction of the Director of
Public Works in accordance with the applicable provisions of the Arcadia
Municipal Code,
If the developer posts a bond for the required improvements, the subdivision
agreement has a 12 month expiration date and all work specified in subdivision
agreement shall be completed within 12 months.
If approved, it is requested that the Planning Commission authorize the
Director of Public Works to approve and execute the subdivision agreement for
this subdivision,

Gentlemen:
We have received from you Notice of Public Hearing of re-
quest by Romani Construction for: Parcel Map to create two
lots from one (TPM 89-04).
We are former residents of 314 North Old Ranch Road, ~rcadia.
who sold our home in May 1988 to Patricia and Forrest Heartline.
~s former longtime residents in that location we are appalled
at the mere idea of lot divisions in a residential area whose
charm and appeal is based on the lovely large- sized lots and
and beautiful trees.
.
The" present owners of 314 North Old Ranch Road purchased said
property in the belief that the area in which they were
buying had certain restrictions which included protection
against lot splitting. If the City of ~rcadia were to grant
such a request to divide lot 331 N. Old Ranch or any of the
lots in the Rancho area , it would seem the City has no de~ire
to protect the residents. The slogan "City of Beautiful Homes"
would be an empty one.
Arcadia is a much sought after city in which to live. There are
no lack of buyers for homes in the Lower Rancho. To divide
Lot 331 to build two homes is out of place in the area, The
request to do this appears to be a matter of greed.
Please check your records to see that the current owners of
314 N. Old Ranch receive a copy of the Notice of Public Hearing
regarding TPM 89-04 (PM 20791) so they may communicate
their opinions regarding this request.
