A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL
USE PERMIT 89-002 TO OPERATE A SCHOOL AT 292 EAST
FOOTI-llLL BOULEVARD.
WHEREAS, on March 6, 1989 an application was filed by Ms. Mia Kim to operate
a school, Planning Department Case No. C.U.P. 89-002, on property commonly known
as 292 East Foothill Boulevard, more particularly described as follows:
Lots 1 and 2 of Block F, Tract 7723, in the City of Arcadia, County
of Los Angeles, State of California, as per Map recorded in Book 93,
Pages 41-42 of Maps, in the Office of the County Recorder of Said County.

WHEREAS, a public hearings were held on March 28 and April 11, 1989, at which
time all interested persons were given full opportunity to be heard and to present
evidence;
NOW, 1HEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in such
zone or vicinity.
2. That the use applied for at the location indicated is proper use for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood,
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission grants a Conditional
Use Permit to operate a school, upon the following conditions:
1. Fire protection shall be provided to the satisfaction of the Fire Department
which shall include the following:
2. Water service shall conform to the Uniform Plumbing Code and any new
water service shall be installed by the Arcadia Water Division upon the request and
payment of fees by the developer.

3. At any time the maximum occupancy of the school shall be ten students
and one teacher.
4. Maximum age of the students shall be sixteen (16) years old.
5. The school shall only be open from 2:30 p.m. to 6:00 p.m. Monday through
Friday.
6. The Planning Commission shall retain jurisdiction in so far as that if
there are parking and/or circulation problems resulting from this use which are found
by the Planning Department, at any time during the first twelve months, a public
hearing shall be scheduled for the purpose of determining the extent of the parking
and/or circulation problem(s), and for the consideration of modifying th original
conditions of approval, or imposing additional conditions so as to mitigate the
identified problem(s).
7. The applicant or operator of the school shall be responsible for the storage
of any bicycles and skateboards used by the school's students. Bicycles and skateboards
shall be stored within the building so that all walkways and parking spaces on the
subject site remain clear and open.
8. Architectural Design Review applications will be required for all signs.
9. That C.U.P. 89-002 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicated awareness and
acceptance of the conditions of approval.
10. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for the immediate suspension or revocation of said
Permit.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of April 11, 1989 and the following vote:

ABSENT: None
Section 5. The Secretary shall certify to the adoption of this Resolution and shall
cause a copy to be forwarded to the City Council of the City of Arcadia.

The Planning Commission at its March 28, 1989 meeting continued the public
hearing on CUP 89-002 for additional information on the format of the school. The
applicant has submitted a class time schedule, the prospectus for the Kumon
Method and other background information.
Classes are scheduled to begin every thirty minutes starting at 2:30 p.m. and ending
at 6:00 p.m. (seven classes maximum). The Planning Department called the regional
office for Kumon and was told that classes are usually from 3:00 p.m. to 6:00 p.m.
and last for approximately thirty minutes.
It is still the Planning Department's opinion that this school can be accommodated
on the site. However, the Planning Department shall periodically monitor the
parking and vehicular circulation at the site during the first twleve months
following the opening of the school. This is necessary because of the potential for
many vehicles to be parked and/or circulating through this site and because of the
presence of small children resultant from the approval of this conditional use
permit.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. Therefore, a Negative Declaration has been
prepared for this project.

RECOMMENDA nON
The Planning Department recommends approval of Conditional Use Permit 89-002
subject to the following conditions:

to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report or as modified by the
Commission.

Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of that
decision.

GENERAL PLAN DESIGNATION:
Commercial
PROPOSAL AND ANALYSIS
The applicant is proposing to operate a school (math classes) from a 449 square foot
commercial retail space which is part of a 2,954 square foot commercial building (see
site plan). School will be open from 2:30 pm to 6:00 pm Monday through Friday with a
maximum occupancy of ten students and one teacher. Maximum age of the students
will 16 years old. A conditional use permit is required for any school.
Surrounding the subject site are commercially zoned properties except to the south
where the lots are zoned R-l. Separating the subject site from the residentially zoned
properties is a 16 foot wide alley.
With limitations to the school's hours and days of operation, occupancy and age of
students the Planning Department believes a school can be accommodated on the site.
Limiting the age of the students will lessen the number of students driving to the
school. The parking lot and adjacent street parking should be able to handle the
loading and unloading of students.
The Planning Department does have a concern about the placement of bicycles and
skateboards used by students. The site does not have an area that could be used for this
purpose. The Planning Department is recommending that the applicant be responsible
for the storage of these items within the building so that all walkways and parking
spaces remain clear and open.
Any new signs or changes to the building's facade will need a Architectural Design
Review application.
The proposal would be consistent with the Zoning Ordinance and General Plan.
Pursuant to the provisions of the California Environmental Quality Act, the Planning
